As used in this article, the following terms
shall have the meanings indicated:
An individual, group or individuals, partnership, firm, corporation,
association, county city, town, or village or improvement district.
All putrescible and nonputrescible solid wastes including
garbage, rubbish, ashes, incinerator residue, street cleanings, dead
animals, offal and solid commercial and industrial wastes.
Land used for the depositing of refuse except that it shall
not include the land used for the depositing of refuse from a single
family, a member of which is the owner, occupant or lessee of said
land, or any part of a farm on which only animal wastes resulting
from the operation of such farm are deposited.
No person shall throw, dump or deposit, or cause
to be thrown, dumped or deposited, on any lands, in the Town of Stillwater,
any refuse from any source whatever, originating outside the Town
of Stillwater; and no person shall permit such throwing, dumping or
depositing thereof upon property owned, leased or controlled by such
person.
A.Â
No person shall maintain a refuse disposal area within
the Town of Stillwater or shall engage in the business of collecting
refuse who has not procured a license therefor from the Town Clerk.
The Town Clerk shall issue such license upon proper application made
to him and upon payment of an annual fee of $25. If such license is
issued for a period less than six months, the fee for such period
shall be $15.
B.Â
Any license issued pursuant to this section may be
canceled by action of the Town Board for cause, upon evidence that
the refuse disposal area maintained by the license has not been maintained
in compliance with the provisions of Part 19 of the New York State
Sanitary Code, or for any other reason prescribed by law.
Any person who violates any provision of this
article shall be guilty of a misdemeanor.
This article shall take effect 10 days after
the publication and posting thereof pursuant to the provisions of
the Town Law; except that any person who is subject to the provisions
of § 173-3 hereof shall not be deemed in violation thereof
if, within 20 days of such publication and posting, he shall procure
the license herein provided for.

As used in this article, the following terms
shall have the meanings indicated:
Includes waste food, papers, dead animals, waste or discarded
wood, lumber, metal or vegetable matter of any kind or any other matter
which shall be inflammable or capable of fermentation or decay.
Includes any individual, society, clerk, firm, corporation
or association.
Includes waste metal, tin cans, ashes, cinders, glass, pottery
and all discarded substances of a solid and incombustible nature.
The premises leased by the Town of Stillwater
situated a short distance west of Stillwater Avenue and a short distance
north of the City of Mechanicville, at the date hereof owned by Elting
H. Doughty, are hereby designated as the garbage and refuse dumping
area for the residents of the Town of Stillwater, subject to the provisions
of this article.
The following rules and regulations, with respect
to said site, shall apply to commercial users thereof:
A.Â
No person regularly collecting garbage or refuse as
a business from households, businesses, mobile home parks, or apartment
houses shall use the landfill site as a disposal area unless and until
he shall have obtained a commercial permit from the Town Clerk.
B.Â
Commercial permits shall be issued by the Town Clerk
to persons picking up garbage and refuse as a business at locations
in the Town of Stillwater. Applications for such permits shall be
made to the Town Clerk, who shall issue such permits upon payment
of a permit fee of $100 for each application. Permits shall expire
on June 30 following the year in which issued and new permits, effective
July 1 of the following year applied for.
C.Â
Each holder of a commercial permit shall pay to the
Town of Stillwater the sum of $35 per load of garbage dumped at the
landfill site. The Town Board may, if it determines it to be in the
public interest, grant use of the landfill to commercial users for
such other consideration as it shall deem appropriate.
D.Â
The landfill site shall not be used for the dumping
of garbage or other refuse originating outside the Town of Stillwater.
E.Â
Commercial dumping at the landfill site shall be under
the direction of the operator of the landfill as designated by the
Town Board.
F.Â
No commercial vehicle carrying garbage for disposal
at the landfill site shall be admitted unless the user's commercial
permit is prominently displayed thereon.
G.Â
The landfill site shall be open for the use of commercial
users at such times as the Town Board, by resolution, shall determine.
The following rules and regulations with respect
to said site, shall apply to private users thereof:
A.Â
The landfill off Stillwater Avenue shall be used for
the disposal of garbage only, by residents of the Town holding landfill
permits.
B.Â
The landfill shall be open to the residents of the
Town on Saturday of each week from 10:00 a.m. to 4:00 p.m.
C.Â
Residents of the Town may obtain permits upon application
therefor to the Town Clerk, without charge.
D.Â
Dumping at the landfill site shall be under the direction
of an employee of the Town, who shall be in attendance during public
dumping hours.
E.Â
The landfill site shall not be used for the dumping
of garbage or other refuse originating outside the Town of Stillwater.
F.Â
No vehicle carrying garbage for disposal at the landfill
site shall be admitted unless the user's permit is prominently displayed
thereon.
