Adoption of agreement. 

§ 14-16
Findings. 

An agreement entitled "Fire Protection Agreement – An Intergovernmental Agreement of Cooperation," dated December 1, 2003, herein after referred to as "agreement" or "Joint Fire Protection Agreement" between the Township of Daugherty and the Borough of New Brighton, a copy of which is attached hereto as Exhibit A and made a part hereof is adopted and approved by the Township of Daugherty.

Editor's Note: The agreement is on file in the office of the Township Secretary and is available for inspection during normal business hours.

As required by the Intergovernmental Cooperation Act,

the following matters are specifically found and determined:

A. 

The conditions of the agreement are as set forth in the Intergovernmental Fire Agreement, dated December 10, 2003, and are adopted by reference, with the same effect as if it had been set out verbatim in this section, a copy of which shall be filed with the minutes of the meeting at which this article was adopted.

B. 

The duration of the initial term of the agreement is two years, effective January 1, 2004, and ending December 31, 2005, and year-to-year thereafter as provided in the agreement.

C. 

The purpose and objectives of the agreement are as set forth in the Intergovernmental Fire Agreement, dated December 10, 2003.

D. 

The manner and extent of financing are as set forth in the Intergovernmental Fire Agreement, dated December 10, 2003.

E. 

The Chairman and the Township Secretary are hereby authorized and directed to sign the agreement on behalf of the Township of Daugherty.

F. 

The agreement marked as Exhibit A is entered into by and between the participants pursuant to the authority granted to the participants by the area government and Intergovernmental Cooperation Act, 1996, Dec. 19, P.L. 1158, No. 177 (53 Pa.C.S.A. § 2301 et seq.).

G. 

The agreement shall be in full force and effect upon the execution of said agreement by all of the participants and the adoption by the participants of an ordinance or resolution authorizing the same.
