The owner of every property fronting upon or along any of the streets in the Borough of Lewisburg is hereby required to remove, or cause to be removed, from all of the sidewalks in front or along the side of such property all snow and ice thereon fallen or formed within 12 hours after the same shall have ceased to fall or to form and to continue to remove, or cause to be removed therefrom, all such snow and ice; provided, however, that snow or ice that has ceased to fall or to be formed after 6:00 p.m. of any evening may be removed at any time before 10:00 a.m. of the next morning. It shall be unlawful for any owner of property, when clearing sidewalks, private driveways or parking areas, to deposit snow on the cartway, or within travel lanes, of all streets and alleys of the Borough of Lewisburg. All snow should be deposited on the property of the owner or deposited along the curb. It shall be unlawful for anybody other than Borough employees or contractors contracted by the Borough of Lewisburg to plow snow on any public right-of-way within the Borough limits. The owner of a property shall be solely responsible for conforming to the requirements of this section whether such property is occupied by the owner, a tenant or other occupier thereof, or is unoccupied.
The Borough Council, or any officer or employee of the Borough designated thereby for this purpose, is hereby authorized to give notice, either by personal service or by the United States mail, to the owner of any property whereon snow or ice is remaining in violation of the provisions of § 300-14 of this article, directing and requiring such owner to remove such snow or ice in order to conform to the requirements of this article within one day after receipt of such notice and to also pay an administrative charge in the amount of $10. Whenever, in the judgment of the designated official, it shall appear to be impracticable to give the aforesaid notice, either because the owner cannot readily be found or because a search for the owner would entail unreasonable delay, the Borough Council, or any officer or employee of the Borough designated thereby for this purpose, may give such notice by posting conspicuously on the property whereon snow or ice is remaining in violation of the provisions of § 300-14 of this article, a notice or order to conform to the requirements of this article within one day after the posting of the said notice or order and to also pay an administrative charge in the amount of $10. If any owner shall neglect, fail or refuse to comply with the aforesaid notice within the required period of time, the Borough Council, or any officer or employee of the Borough designated thereby for this purpose, may order the removal of such snow or ice and the cost thereof, plus an administrative charge in the amount of $25, together with a penalty of 10% of the cost thereof, shall be collected by the Borough from such owner in the manner provided by law.
Any person, firm or corporation who violates any provision of this article or fails to pay any cost, charge or penalty imposed pursuant to § 300-15 of this article shall, upon conviction thereof in a summary proceeding before a District Justice, be sentenced to pay a fine of not more than $600, plus costs of prosecution, for each offense and, in default of payment of such fine and costs, be imprisoned for a period not to exceed 30 days. Every day that a violation of this article continues shall constitute a separate offense.
