Wherever a space is marked off on any street for the parking of an individual vehicle, every vehicle parked there shall be parked wholly within the lines bounding that space, and it shall be a violation of this article for any person to park a vehicle or allow it to remain parked otherwise.
A. 
Only angle parking shall be permitted on the following portions of streets:

B. 
Parking on unimproved surfaces.
(1) 
Definitions. As used in this subsection, the following terms shall have the meanings indicated:
BUILDING LINE
A line parallel or approximately parallel to the street line and beyond on which buildings or fences may not be erected.
CORNER LOT
A residential property located at the intersection or confluence of two or more streets such that public street rights-of-way are directly adjacent to at least two contiguous sides of the lot.
DRIVEWAY
The primary improved or unimproved parking surface which provides egress and ingress from a garage, carport or off-street parking area to an adjacent street or alley.
FRONT YARD
The area from the front face of a residential structure to the front property line or street right-of-way line or, when a structure does not exist, the area from the front building line to the front property line or street right-of-way.
IMPROVED PARKING SURFACE
An area used for the parking or storage of vehicles that is overlaid or otherwise paved with concrete, asphalt, paving stones, compacted gravel and/or stone, or other hard surfaced durable material approved by the building official.
REAR YARD
The area from the rear face of a residential structure to the rear property line.
SIDE YARD
The area from the side of a residential structure to the side property line.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn or moved upon a street, highway, waterway or airway and shall include any automobile, bus, truck, tractor, motor home, farm machinery, motorcycle, scooter, moped, all-terrain vehicle, boat, aircraft, recreational vehicle, golf cart, go-cart, trailer, fifth-wheel trailer, camper, camper shell, wheeled towing frame, semi-tractor trailer, truck bed mounted on chassis, and mobile home. This definition does not include nonmotorized bicycles, small engine lawn mowers and devices of similar scale.
(2) 
Regulations.
(a) 
Parking on unimproved surfaces restricted. No person shall, upon a residential single-family, duplex, townhouse or other dwelling lot or tract:
[1] 
Cause, permit or allow the parking or storage of any vehicle in the front yard upon any surface other than an improved parking surface; or
[2] 
Cause, permit or allow the parking or storage of any vehicle upon the side yard or rear yard of a corner lot upon any surface other than an improved parking surface, unless otherwise concealed from view from all public street rights-of-way by:
[a] 
A solid, opaque, screening fence or wall at least six feet in height;
[b] 
Vegetation consisting of a solid hedgerow of evergreen shrubs, or trees and shrubs, providing full screening from the ground to a minimum height of six feet;
[c] 
Any combination of the above that effectively conceals the vehicle from view and accomplishes the required screening height; or
[d] 
Any other form of compatible and appropriate screening approved by the building official.
(b) 
Driveways and improved parking surfaces shall be permitted and constructed or installed only in accordance with and as provided in the Borough's Zoning Ordinance[1] or any other applicable Borough ordinance.

(c) 
It is an affirmative defense to prosecution for parking or storing vehicles on an unimproved surface or in an unconcealed or unscreened manner if such vehicles are parked in the rear yard and the rear yard is not a corner lot or directly adjacent to a public street right-of-way other than an alley.
(3) 
Borough Council, or any officer or employee, including Buffalo Valley Regional Police Department police officer, of the Borough designated thereby for this purpose, is hereby authorized to give notice, either by personal service or by the United States mail, to the owner of any property whereon a vehicle is parked or stored in violation of the provisions of § 345-27B(2) of this article, directing and requiring such owner to remove the said vehicle in order to conform to the requirements of § 345-27B(2) of this article within 10 days after receipt of such notice and to also pay an administrative charge in the amount of $40. Whenever, in the judgment of the designated official, it shall appear to be impracticable to give the aforesaid notice, either because the owner cannot readily be found or because a search for the owner would entail unreasonable delay, Borough Council, or any officer or employee, including Buffalo Valley Regional Police Department police officer, of the Borough designated thereby for this purpose, may give such notice by posting conspicuously on the property whereon a vehicle is parked or stored in violation of the provisions of § 345-27B(2) of this article a notice to conform to the requirements of § 345-27B(2) of this article within 10 days after the posting of the said notice and to also pay an administrative charge in the amount of $40. If any owner shall neglect, fail or refuse to comply with the aforesaid notice and/or to pay the aforesaid administrative charge within the required period of time, such owner shall be in violation of the provisions of § 345-27B(2) of this article and shall be cited and prosecuted by the Borough, or any officer or employee, including Buffalo Valley Regional Police Department police officer, of the Borough designated thereby for this purpose, as provided in the first sentence of § 345-34 of this article.

C. 
Removal of vehicles. The Borough may remove any vehicle parked in a prohibited location at a prohibited time in violation of this section by towing it or having it towed at the expense of the vehicle's owner. The Borough's removal of such vehicle shall not preclude penalization of the owner thereof as provided in § 345-34 of this article.
D. 
St. Mary street park parking lot. Parking shall be prohibited in the parking lot of the St. Mary Street Park located between St. Mary Street and North Fifteenth Street every day from dusk to dawn.

A. 
Except as provided in Subsection B hereof, it shall be unlawful for any person to park, or to allow to remain parked, on any streets, or parts of streets, or in off-street metered parking lots, the following vehicles:
(1) 
All trucks, buses, tractors and trailers listed in Classes 4 through 13 of the attached chart[1] published by the Federal Highway Administration;

(2) 
All farm equipment; and
(3) 
All trucks listed in Class 3 of the attached chart, unless they are able to be parked wholly within the lines or markings bounding or delineating the parking space as provided in §§ 345-25 and 345-38 of this article.
B. 
The following vehicles are exempt from the prohibition set forth in Subsection A hereof:
(1) 
Vehicles when making local deliveries, repairs or installations;
(2) 
Public utility vehicles conducting operations;
(3) 
Fire and rescue equipment;
(4) 
Rubbish and garbage vehicles;
(5) 
School and public transportation buses;
(6) 
Municipal vehicles;
(7) 
Construction vehicles actively involved in construction projects;
(8) 
Moving vans for a period of no longer than 48 hours; and
(9) 
Vehicles in compliance with the provisions of § 345-31 of this article.
No person shall park a vehicle, or allow it to remain parked, for longer than the time indicated, in any of the following locations, at any time on the days and between the hours indicated:

It shall be unlawful for any person to stop, stand or park a vehicle (other than a pedalcycle) on the roadway side of any vehicle stopped or parked at the edge or curb of any street, except that standing or parking for the purpose of loading or unloading persons or property shall be permitted Monday through Saturday, between the hours of 9:00 a.m. and 11:30 a.m. and between the hours of 1:30 p.m. and 4:00 p.m., and for no longer than necessary for the loading or unloading.

A. 
Findings and purpose: The Borough finds that:
(1) 
Certain residential areas in the Borough are subjected to commuter vehicle parkings, therefore depriving the residents of those areas of spaces in which to park their own vehicles;
(2) 
Those residential streets are also subjected to a high degree of commuter traffic which substantially reduces the quality of the ambient air level; and
(3) 
The establishment of a parking permit program for certain affected areas should facilitate efficient movement of traffic by providing for parking preference during certain hours of the day and days of the week. Therefore, the Borough considers it to be in the interest of the people of the Borough to provide for the establishment of a residential permit parking program to insure primary access to available parking spaces by neighborhood residents and also to provide a cleaner ambient air level.
B. 
Definitions: For the purpose of this section, words and terms listed in this subsection, as follows, shall have the following meanings:
COMMUTER VEHICLE
A motor vehicle parked in a residential area by a person not a resident of that residential area;
PROPRIETOR
A person who owns or leases real estate within a residential area of which he is not a resident, but who owns or manages a business enterprise or professional office maintained at that address; for the purpose of this section, a proprietor shall be entitled to one parking permit for that business or professional office address;
RESIDENT
A person who owns or leases real property within a residential area and who maintains either a voting residence, or bona fide occupancy, or both, at that address;
RESIDENTIAL AREA
A contiguous area containing public highways or parts of public highways primarily abutted by residential property or residential and non-business property (such as schools, parks, places of worship, hospitals and nursing homes).
C. 
Criteria: The residential areas designated in Subsection D of this section are those deemed impacted and hence eligible for residential parking on the basis of the following criteria:
(1) 
During any period between the hours of 7:00 a.m. and 6:30 p.m., Monday through Saturday, except legal holidays, the number of vehicles parked (or standing), legally or illegally, on the streets in the area is equal to 70% or more of the legal, on-street parking capacity of the area. For the purpose of this criterion, a legal parking space shall be 20 linear feet.
(2) 
During the same period as specified in Subsection C(1), directly above, 10% or more of the vehicles parked (or standing) on the streets in the area are not registered in the name of a person residing in the area. For the purpose of this criterion, the latest available information from the Bureau of Motor Vehicles and Licensing of the Pennsylvania Department of Transportation regarding registration of motor vehicles shall be used.
(3) 
Provided: in determining that a specific area identified as impacted and eligible for residential permit parking is designated as a residential permit parking area, the following factors are taken into consideration:
(a) 
The local and metropolitan needs with respect to clean air and environment;
(b) 
The possibility of a reduction in total vehicle miles driven in the Borough;
(c) 
The likelihood of alleviating traffic congestion, illegal parking and related health and safety hazards;
(d) 
The proximity of public transportation to the residential area;
(e) 
The desire and need of the residents for residential permit parking and their willingness to bear the administrative costs in connection with it; and
(f) 
The need for parking in excess of the residential permit parking program in proximity to establishments located in the residential permit parking area and used by the general public for religious, health or educational purposes.
D. 
Designation of residential permit parking areas:
(1) 
The following are designated as residential permit parking areas:

Signs shall be erected along the streets in each residential permit parking area, indicating the days, hours, locations and conditions under which parking shall be by permit only.
E. 
Application for permit: Application for a residential parking permit shall be made to the Police Chief of the Buffalo Valley Regional Police Department by the person desiring the permit, who shall be only the owner or the driver of a motor vehicle who resides on or is a proprietor of property immediately adjacent to a street or other location within a residential parking permit area. A separate application shall be required for each motor vehicle, and each application shall be accompanied by a $10 permit fee, which shall be for the use of the Borough, to be applied to the cost of administering the residential permit parking program. Each application shall contain the following information: the name of the owner or the driver, as the case may be, of the motor vehicle; the address of the resident or the proprietor, as the case may be; the make, model and registration number of the motor vehicle; and the driver number as taken from the applicant's current driver's license. At the discretion of the Police Chief of the Buffalo Valley Regional Police Department, the applicant shall be required, at the time of making application, to present his driver's license and the vehicle registration card.

F. 
Issuance of permit: Upon receipt of the application and the permit fee, and determination by him that the information upon the application shows that the applicant is entitled to a residential parking permit, the Police Chief of the Buffalo Valley Regional Police Department shall issue to the applicant a residential parking permit, which shall be valid for the remainder of the calendar year. The permit shall display the serial and registration numbers of the motor vehicles, the residential parking area number, and the expiration date. The permit shall be renewable annually before the expiration date, upon making application for renewal and payment of the $10 permit fee. It shall be unlawful and a violation of this section for any person to display other than the current and valid permit while standing or parking in a residential permit parking area at any time when those permits are to be displayed.

G. 
Temporary and exemption parking permits: Temporary parking permits may be issued by the Police Chief of the Buffalo Valley Regional Police Department, upon payment of a fee of $2, to bona fide visitors of residents of a designated residential permit parking area, and exemption parking permits may be issued, without payment of a fee, to handicapped persons.

H. 
Responsibility of permit holder:
(1) 
Notwithstanding any provision of this section to the contrary, the holder of a residential parking permit shall be permitted to stand or park a motor vehicle operated by him in any designated residential parking area during those times when parking of motor vehicles is permitted in that area. While a vehicle for which a residential parking permit has been issued is so parked, that permit shall be displayed so as to be clearly visible through the windshield of the vehicle. A residential parking permit shall not guarantee or reserve to the holder a parking space within a designated residential permit parking area.
(2) 
A residential parking permit shall not authorize its holder to stand or park a motor vehicle in any place where or at any time when stopping, standing or parking of motor vehicles is prohibited or set aside for other specified types of vehicles, nor shall the permit exempt its holder from the observance of any traffic or parking regulation other than residential permit parking regulation or restriction.
(3) 
No person other than the permit holder whose name appears on the permit shall use a residential parking permit or display it on a vehicle operated; any such use or display by a person other than the permit holder shall constitute a violation of this section by the permit holder and by the person who so used or displayed the parking permit.
(4) 
It shall constitute a violation of this section for any person falsely to represent himself as eligible for a residential parking permit or to furnish false information in an application to the Police Chief of the Buffalo Valley Regional Police Department in order to obtain a residential parking permit.

(a) 
Revocation of permits: The Police Chief of the Buffalo Valley Regional Police Department shall have authority to revoke the residential parking permit of any permit holder found to be in violation of any provision of this section. Upon written notification to him of the revocation, the permit holder shall surrender the permit to the Police Chief of the Buffalo Valley Regional Police Department. Failure to do so, when so requested, shall constitute a violation of this section. Provided: any person receiving such a notice may, within 10 days after the date of the notice, appeal to Council for a hearing on the revocation, and the decision of Council shall be final.

Any person who violates any provision of this article shall, upon conviction thereof in a summary proceeding before a District Justice, be sentenced to pay a fine of not more than $600 plus costs of prosecution, for each offense and, in default of payment of such fine and costs, be imprisoned for a period not to exceed 30 days. Provided, it shall be the duty of the police officers of the Buffalo Valley Regional Police Department and of parking enforcement personnel of the Borough to report to the appropriate official all violations of any provision of this article indicating, in each case: the section violated; the license number of the vehicle involved in the violation; the location where the violation took place; and any other facts that might be necessary in order to secure a clear understanding of the circumstances attending the violation. The police officer or other person making the report shall also attach to or place upon every such vehicle a notice stating that the vehicle was parked in violation of this article. The notice shall contain instructions to the owner or operator of the vehicle that if he/she will report to the Buffalo Valley Regional Police Department and pay the sum of $15 within 48 hours after the time of the notice, or if he/she will place the sum of $15, enclosed within the envelope provided, in any of the special parking fine boxes installed at various locations within the Borough, that act will save the violator from additional penalties and/or prosecution. Upon the failure of any owner or operator to pay the sum of $15 within the said period of 48 hours, the owner or operator shall, after the said forty-eight-hour period, pay as a penalty for and in full satisfaction of such violation the sum of $30, together with the cost of postage and certified or registered mail should a notice of such violation be forwarded to the said owner or operator by United States Mail. The failure of such owner or operator to make such penalty payment within the time and at the place so specified for such violation shall render such owner or operator, who shall be cited within 30 days of the violation, subject to the fine and costs prescribed in the first sentence of this section.
