GENERAL REFERENCES
Peddling and soliciting — See Ch. 85.
No outdoor (including under porch or awning) sale or display of goods or merchandise shall be permitted unless:
A. 
The business is open.
B. 
No goods and merchandise block any sidewalk, public right-of-way, parking, traffic or access to fire hydrants or impair public services such as fire protection or ambulance services or the ingress or egress to or from the merchant's place of business or any nearby structure.
C. 
The sale or display does not constitute an unsafe or unsanitary condition or public nuisance.
The outdoor sale through coin-operated vending machines, ice chests or other storage facilities not larger, in aggregate, than one hundred (100) cubic feet are exempt from this chapter, provided that they do not impair or restrict ingress and egress to a place of business; sidewalks; rights-of-way; parking areas; or front yard, side yard or rear yard setbacks. The outdoor sale of vehicles is also exempt from this chapter, provided that it complies with the Zoning Local Law[1] and that all necessary municipal permits have been issued.

Any person violating any of the provisions of this chapter shall be guilty of a violation and, upon conviction thereof, shall be punished by a fine not to exceed two hundred fifty dollars ($250.) for each offense or imprisonment not exceeding fifteen (15) days, or both. Each day a violation continues shall constitute a separate and distinct offense.
The Village Board shall have the power, by resolution, to vary or modify the application of tiny provision of this chapter upon its determination and in its absolute legislative discretion if such variance or modification is consistent with the spirit of this chapter and is consistent with the health, safety, morals and general welfare of the village.
