GENERAL REFERENCES
Water — See Ch. 115.
The purpose of these regulations is to safeguard the Village of Nassau's potable water supply by preventing backflow of hazardous and nonpotable material into the public water system through service connections. It is the intent of this chapter to recognize that there are varying degrees of hazard and to apply the principle that the degree of protection should be commensurate with the degree of hazard.
As used in this chapter, the following terms shall have the meanings indicated:
APPROVED PROTECTION DEVICE
A backflow prevention device that has been approved by the New York State Health Department, including double check valve assemblies, reduced pressure zone devices, and air gaps.
APPROVED WATER SUPPLY
A water source and system approved by the New York State Health Department.
AUXILIARY WATER SOURCE
Any water source on or available to the premises other than the Village of Nassau's public water system.
BUILDING INSPECTOR
The employee of the Village of Nassau in charge of overseeing building inspections and code compliance.
CERTIFIED BACKFLOW PREVENTION DEVICE TESTER
A person who has been certified as a tester in conformance with New York State Health Department regulations.
CERTIFIED WATER OPERATOR
The employees of the Village of Nassau overseeing the day-to-day operations of the Water Department, who are New York State certified water operators.
CROSS CONNECTION
Any connection between any part of the Village of Nassau's public water system and any source or system containing water or a substance that is not approved as equally safe, wholesome, and potable for human consumption.
PUBLIC WATER SYSTEM
The water mains, pipes, pumping stations, and storage facilities owned and operated by the Village of Nassau.
WATER SUPERINTENDENT
The Superintendent of Water as designated by the Village Board of the Village of Nassau, or his/her designated representative.
A. 
Where protection is required:
(1) 
An appropriate approved protection device shall be installed, at the customer's expense. for cross-connections at the following types of facilities:
(a) 
Premises having an auxiliary water source, unless that source is an approved water supply.
(b) 
Premises with existing plumbing connections or with potential plumbing connections to nonpotable water, liquids other than water, or any other hazardous or objectionable substances, including, but not limited to, swimming pools.
(c) 
Premises with fire protection systems, including sprinklers, fire pumps, auxiliary water sources, or fire-fighting water storage tanks.
(2) 
The approved protection device shall be installed on the service entrance near the water meter unless the water operator determines that another location is more appropriate, except for conditions described in § 116-4.
B. 
Type of protection. The type of approved protection device that is required for a particular connection shall be appropriate for the degree of hazard for the cross-connection, and shall be determined by the water operator.
C. 
Maintenance and inspection of approved protection devices.
(1) 
Any water customer who is required to have an approved protection device shall be responsible to maintain such device in working order.
(2) 
The water customer shall have any approved protection device, except an air gap, inspected at least annually by a certified backflow prevention device tester. Results of such testing shall be provided to the Water Commissioner and the Rensselaer County Department of Health within 72 hours of the test.
Where the potential cross-connection is limited to a single fixture in one building on the premises, the Water Commissioner may, after consultation with the water operator, allow the approved protection device to be installed on the piping to that particular fixture rather than the service entrance pipe.
In determining where an approved protection device shall be required, and the appropriate type of device, the water operator shall use the most current guidance material provided by the New York State Health Department.
A water customer required to install an approved protection device shall submit plans and specifications for such installations to the Building Inspector, who must approve the plans prior to installation. In the event the device to be installed is a reduced pressure zone device, the plan must be prepared by a New York State licensed professional engineer or registered architect, and must conform to the guidelines of the New York State Health Department. The Building Inspector may refer the plans to the Rensselaer County Health Department for review and approval.
A. 
Any violation of § 116-3 of this chapter may be punished by a fine of $50 per day for each day without an approved protection device, not to exceed a total of $500. Any such fine imposed shall be added to the water charges for the customer in violation of this chapter.
B. 
In addition to the foregoing penalties, the Water Commissioner may serve a written notice upon any customer advising of a failure to install, test and/or maintain an approved protection device, and demanding that the condition be cured within 10 days. Upon the failure to correct such condition within 10 days, the Water Commissioner may direct the discontinuance of water service to such premises until such condition has been corrected.
This chapter shall take effect on January 1, 2007. Compliance for existing customers shall occur on or before June 30, 2007.
