[HISTORY: Adopted by the Legislature of the
Menominee Indian Tribe 3-18-2004 by Ord. No. 04-03. Amendments noted where
applicable.]
The purpose of this chapter is to create the
Menominee Tribal School Board of Education to oversee the administration
of the Menominee Tribal School and to list the powers and duties of
the School Board.
As used in this chapter, the following terms
shall have the meanings indicated:
The school for kindergarten through eighth grade which is
located in Neopit, Wisconsin, owned and operated by the Menominee
Indian Tribe.
A minimum of three members of the five-member Board.
The person employed by the Menominee Indian Tribe to run
the day-to-day operations of the Menominee Tribal School.
The Menominee Tribal School Board of Education created by
this chapter.
The Menominee Indian Tribe of Wisconsin.
A.Â
The School Board shall consist of five members appointed
by majority vote of the Tribal Legislature.
B.Â
The term for all School Board members shall be three
years, except for two of the initial appointees whose initial term
shall be for two years, and one will be for one year. Lengths of terms
for each initial Board member shall be chosen by lot conducted by
the School Board after all five have been appointed by the Legislature.
C.Â
Those persons who wish to be considered for appointment must submit to the Menominee Tribal Legislature a resume which, pursuant to § 56-4, lists their qualifications for appointment to the School Board.
D.Â
A member of the School Board may be removed by a majority
vote of the Tribal Legislature when, in the Legislature's judgment,
the best interests of the Menominee Tribal School will be served thereby
or when it is determined that a School Board member does not meet
the qualifying criteria for membership.
F.Â
Any vacancy on the School Board shall be filled by
appointment by the Menominee Tribal Legislature to complete the unexpired
term.
G.Â
The School Board shall meet at least once per month
when the Menominee Tribal School is in session. All other meetings
shall be governed by the bylaws of the School Board.
A.Â
To be appointed to the Tribal School Board a potential
member shall:

(1)Â
Be of good, moral, honest, reputable character and
shall not have been convicted for any crimes that would, pursuant
to tribal, federal, or applicable state law, prohibit that person
from working with children.
(2)Â
Consent to a criminal background investigation and drug screening test which tests for illegal drugs. "Illegal drugs" means a controlled substance as defined in Chapter 306, Article I, Controlled Substances, of this Code or listed in Schedule I or II, as defined by Section 802( 6) of Title 21 of the United States Code, the possession of which is unlawful under Chapter 14 of that title. The term "illegal drugs" does not mean the use of a controlled substance pursuant to a valid prescription or other uses authorized by law.

Be at least 24 years old and be an enrolled member
of the Menominee Tribe.
(4)Â
Reside within 25 miles of the Menominee Indian Reservation
boundaries.
B.Â
All members shall have a high school diploma or its
equivalent. At least two members shall have a minimum of a bachelor's
degree.
C.Â
At least one member will be a parent/guardian of a
student attending the Menominee Tribal School.
D.Â
An employee of the Menominee Tribal School shall not
be considered for appointment.
It shall be the duty of the School Board to:
A.Â
Maximize the educational opportunities available for
students of the Menominee Tribal School.
B.Â
Consult and advise the School Administrator on issues
related to the operation of the Menominee Tribal School.
C.Â
Assure adherence to Menominee Tribal School Policies
and Procedures.
E.Â
Develop amendments to Ordinance No. 83-6, Menominee
Nation Personnel Policies and Procedures, as they relate to the operation
of the Menominee Tribal School with the intent of maximizing functions
of an educational setting. The Menominee Tribal Legislature must approve
all such amendments.
F.Â
Supervise and evaluate the School Administrator. The
School Board shall have all the powers of a supervisor pursuant to
Ordinance No. 83-6. Hiring of a School Administrator shall be done
in accordance with Ordinance No. 83-6. The School Board shall appoint
two of its members and one Menominee Tribal School employee to interview
any prospective candidates for the School Administrator along with
one human resources representative and one administrative service
officer or administrative manager.
G.Â
Submit an annual budget to the Menominee Tribal Legislature
for approval.
H.Â
Ensure the School Administrator meets monthly with
the Labor, Education, and Training Committee, or any future legislative
committee which deals with education, for the purpose of creating
a collaborative effort that promotes a cohesive educational system
on the Reservation.
I.Â
Conduct expulsion hearings upon recommendations from
the School Administrator and hear appeals from students and parents
in accordance with the policies of the Menominee Tribal School and
all applicable tribal, federal and state rules and regulations.
J.Â
Draft bylaws governing the conduct of School Board
meetings. Those bylaws must be approved by the Menominee Tribal Legislature.
K.Â
Approve the curriculum to be used in the Menominee
Tribal School.
L.Â
Enact or revise any Menominee Tribal School policy(ies)
except for personnel policies which are governed by Ordinance No.
83-6.
M.Â
Negotiate terms of standard teacher contracts or other
Menominee Tribal School employee contracts.
N.Â
Consult with the administrative service officer assigned
to the Menominee Tribal School for technical assistance in regard
to contract funding to ensure funding compliance.
A.Â
The School Board shall have all powers necessary to carry out the duties listed in § 56-5 of this chapter. Decisions made by the School Board in applying the policies of the Tribal School are final and are not subject to review, except in Menominee Tribal Court pursuant to Article XVIII of the Menominee Tribal Constitution. Any powers not given to the School Board pursuant to this chapter regarding the administration of the Menominee Tribal School are retained by the Legislature.
B.Â
In the exercise of its powers, the School Board shall
conduct its duties in accordance with tribal and applicable federal
and state laws and regulations.
A.Â
Notwithstanding the powers and duties given to the School Board pursuant to § 56-5 of this chapter, the School Board is prohibited from taking any action regarding the following:
(1)Â
Employment issues, including but not limited to grievances,
complaints and disciplinary action involving any employee of the Menominee
Tribal School except in relation to disciplinary action taken by the
School Board against the School Administrator pursuant to Ordinance
No. 83-6.
(2)Â
Entering into contracts, memorandum of agreements,
or any other type of binding agreement without the written consent
of the Menominee Tribal Chairperson.
B.Â
A School Board member is prohibited from unilaterally
issuing orders or directing actions where those actions and directions
are not a result of a decision made by the School Board at a meeting
convened and conducted by the School Board in accordance with the
bylaws.
C.Â
Notwithstanding the powers and duties given to the School Board pursuant to § 56-5 of this chapter, the School Board is prohibited from taking any action which would be contrary to applicable tribal, federal and state laws and regulations or which would violate contracts entered into between the Tribe and a funding source.
A.Â
Members of the School Board are agents of the Tribe
and while acting within the scope of their duties shall be:

In any action otherwise authorized against the School
Board or individual members of the School Board arising from the performance
of their official duties, the following shall apply:
(1)Â
Neither the School Board nor individual members of
the School Board shall be liable for the payment of the costs or expenses
of the opposing party.
(2)Â
Neither the School Board nor individual members of
the School Board shall be required to post security by bond or otherwise
for any purpose.
(3)Â
No civil action brought against the School Board or
individual members of the School Board shall be tried before a jury.
All such actions shall be tried before a Tribal Court Judge.
(4)Â
Any action against the School Board or any individual
member of the School Board must be commenced within one year of the
date the cause of action accrued.
