A Department of Health in and for the City of Watervliet is hereby established. The health officer shall be the head of such department. He shall serve for a term of four years unless sooner removed by the council. No person shall be eligible to appointment as health officer unless he shall possess the qualification established by the Public Health Council of the State of New York. (Ord. No. 5-B, 1-1-1920)
The health officer shall exercise all the powers and be charged with all the duties now or hereafter conferred upon or required of local boards of health or local health officers by the laws of this State, so far as the same pertain to cities, except as limited or extended by, the provisions of this ordinance should be "article". The health officer shall also possess such powers and perform such duties as may be prescribed by ordinances or resolutions of the council. (Ord. No. 5-B, 1-1-1920)
The health officer shall have an office at the city hall, and shall attend at said office at least two hours every business day of the year. The health officer shall have the aid and assistance of a clerk who shall be the clerk of the department of health and registrar of vital statistics for the city, and the duties of registrar of vital statistics heretofore reposed in the city clerk are now reposed in said clerk to the department of health. Any persons aggrieved by an order, decision or direction of the health officer may appeal therefrom to the council which may affirm, reverse or modify the order, decision or direction appealed from. (Ord. No. 5-B, 1-1-1920)
All plans for plumbing, sewers and drains shall be submitted to the health officer for his approval before contracts are let for the construction of the same, and in case he shall disapprove the same, such plumbing, sewers and drains shall not be constructed unless on appeal to the council, it shall approve of the same. The health officer has power, subject to the right of appeal as heretofore provided, to stop the construction or installation of plumbing or use of drains and sewers which are not properly constructed or properly used, or which are not in accordance with plans previously approved and adopted. The council of the city or the general manager thereof shall appoint a plumbing and sanitary inspector, who shall also act as water inspector. The sanitary and plumbing inspector, as such, shall be subject to the regulation, control and orders of the health officer, and as water inspector shall be subject to the regulation, control and orders of the director of public works.[1] (Ord. No plumbing shall be placed in any house, business structure, or building, until the plans for same shall have been filed with and approved by the health officer. Such plans shall be kept by said health officer, and be accessible to the owner or occupant of said building or structure affected by this section at all reasonable times. The plumbing in said building or structure shall be constructed according to said plans. If an alteration is desired, new plans showing the alteration shall be filed with said health officer, and approved in like manner as the original plans.
Said health officer shall as soon as possible after his appointment formulate rules and regulations for the better control and sanitary arrangement of plumbing in the City of Watervliet. Any plumber or contractor who shall put in any plumbing in the City of Watervliet, until his plans have been approved by the health officer, as herein provided, shall forfeit to the city the sum of one hundred dollars for each and every offense, which shall constitute disorderly conduct, and the party so offending, a disorderly person.
Architects or builders who shall hereafter draw plans for or construct buildings, business structures or dwellings, in the city, shall make and leave permanently with the owner or occupant of said building, structure or dwelling, a copy of the plumbing specifications and blueprint, showing the location of all drain pipes, sewer pipes, waste pipes, traps and other connections throughout the buildings, structures or dwellings herein referred to. After the passage of this ordinance, the provisions of this article shall apply and refer to any extensions, alterations or additions to the plumbing in any building, structure or dwelling within the city limits.
The health officer may enforce obedience to the foregoing provisions by prescribing therefor and therein penalties for each violation thereof, not exceeding $100.00 for any offense. In addition to the penalty the health officer may also determine that a violation thereof shall constitute disorderly conduct and that the person violating the same shall be a disorderly person. The council shall appoint an examining board of plumbers consisting of three persons who shall have all the powers and perform all of the duties prescribed in and by article 4 of the General Cities Law, relative to plumbing and drainage. The provisions of such article are hereby made applicable to the City of Watervliet. (Ord. No. 5-B, 1-1-1920)
