This article shall be known as the "Licensing and Regulation Law for Persons Engaged in the Business of Trash Collection and Removal Within the Town of Highlands."
A. 
Licensing requirements. It shall be unlawful for any person, firm or corporation to engage in the business of trash collection or removal within the Town of Highlands without first obtaining a license from the Town Clerk.
B. 
The application for the license shall be in writing prescribed by the Town Clerk and must contain among other things the name and address of the applicant, the number of vehicles to be used by the applicant, and a description of each of them by manufacturer's name, year, model and vehicle identification number.

Prior to the issuance of any license pursuant to this article, the vehicles to be used in the licensee's business shall be inspected by the Town Sanitary Inspector and comply with all applicable health and safety codes, shall meet the requirements for such vehicles as prescribed by the State of New York and shall be constructed with a closed body so that waste, trash, garbage or other materials collected shall be completely confined therein.
Licenses issued hereunder shall be valid for a period of one year from the date of issuance. Such licenses may be renewed for additional one-year terms provided the applicant has not violated any provision of this article in the year prior to the renewal year.

The fee for each license shall be set from time to time by resolution of the Town Board, entitling the holder of the license to maintain one vehicle used in the business of trash collection. For each additional vehicle used in the applicant's trash collection business, there shall be an additional fee set from time to time by resolution of the Town Board.
All persons, firms or corporations licensed hereunder shall dump only at places authorized to receive solid waste by the County of Orange and/or the State of New York. The Town of Highlands shall in no way be liable for the cost of such dumping which will be borne exclusively by the holder of the license.
Any violation of any provision of this article shall be punishable by a fine of not more than $250 or imprisonment not to exceed 15 days, or both, for each such violation and shall result in the immediate cancellation of the license.
