Animals — See Ch. 72.
The purpose of this chapter is to protect the public safety and welfare
and it is not meant to constitute regulation and control of wildlife except
as trapping of such wildlife affects public safety.
As used in this chapter, the following terms shall have the meanings
indicated:
Any structure with four walls and a roof.
Any metal or waterproof paper bearing the operators name, address
and telephone number or any of the foregoing.
Any box with a body hold trap contained therein or any spring hold,
figure four, or box wire or cage trap excluding only:
Taking, killing and capturing wildlife with traps, deadfalls and
other devices, commonly used to take wildlife, or shooting or killing of wildlife
lawfully trapped. This definition shall include all lesser acts such as placing,
setting or staking such traps, deadfalls and other devices whether they result
in taking or not, and in every attempt to take and every act of assistance
to any other person in taking or attempting to take wildlife with traps, deadfalls
or other devices.
A.
Unless authorized by permit as set forth below, no person
shall set or cause to be set, or assist in setting any traps as defined herein
within 500 feet of any building, playground, ball field or recreation area
or within 300 feet of any road.

No trap shall be set for the taking of any animal unless
said trap is tagged with the operator's name, address and telephone number
as set forth in § 11-1109 of the Environmental Conservation Law.
A.
Any person may apply to the Town Clerk on his own behalf
or on the behalf of any organization for a permit to set a trap or traps by
completing an application which shall specify:

Such traps shall be tagged as prescribed in § 11-1105,
Subdivision 1, of the Environmental Conservation Law.
C.
The Chief of Police shall review each application to
ascertain whether the proposed trapping will create an undue hazard considering
the location, purpose, type of trap and type of animal to be trapped. If the
Chief of Police determines that trapping pursuant to the application may be
conducted consistent with the adequate protection of the public health, safety
and welfare, and that the application is in compliance with this chapter,
then the Clerk shall issue a permit.
