§ 225-16 Types of zoning districts.

For the purpose of this chapter, Derry Township is hereby divided into 25 zoning districts:

§ 225-17 Zoning Map and Overlay Zoning Map.

The Zoning Map and Overlay Map of Derry Township, dated December 30, 1992, as may later be amended, are incorporated as part of this chapter[1] and shall define the zoning districts described in § 225-16, except for the Floodplain Overlay District, which is delineated in the most current Flood Insurance Study and Flood Boundary and Floodway Map of the Township of Derry, as prepared by the Federal Insurance Administration.

§ 225-18 Boundaries of zoning districts; interpretation.

The boundaries of the districts shall be as shown on the Zoning Map and Overlay Zoning Map of Derry Township which is on file in the Township Office, except for the Floodplain Overlay District, which is delineated in the most current Flood Insurance Study and Flood Boundary and Floodway Map of the Township of Derry, as prepared by the Federal Insurance Administration. Generally, the boundary lines follow lot lines or centerlines of streets. Boundaries that approximately follow the centerline of streams, rivers or other bodies of water, shall be construed as following such centerlines. In unsubdivided property, boundaries shall be determined by use of the scale or dimensions indicated on the Zoning Map or Overlay Zoning Map. Questions concerning the exact location of district boundary lines shall be determined by the Zoning Officer.

§ 225-19 Annexed territory.

All territory which may hereinafter be annexed to the Township shall be considered to be in the Agricultural/Conservation Zoning District unless it is reclassified.

§ 225-20 Authentication of Zoning Map.

Whenever there has been an amendment to the boundary of a zoning district or a reclassification of a zoning district, the Zoning Map or Overlay Zoning Map of Derry Township shall be accordingly revised and shall be duly certified by the Township Secretary.

§ 225-21 Zoning Map amendments.

Amendments to the Zoning Map of Derry Township are described as follows:

399 6-11-1996 Land of the National Golf Operating Partnership, located on the south side of East Derry Road at the intersection of East Derry Road and Laudermilch Road, changed from Commercial Golf District to Attached Residential District
441 5-26-1998 Lands located on the east side of Lucy Avenue are amended by changing the zoning classification from a Village Residential to a General Commercial classification
448 11-24-1998 Lands of Derry Township Municipal Authority located on Clearwater Road changed from Business Office and Agricultural/Conservation zoning classification to a Public zoning classification
453 2-9-1999 Lands located on the north side of the 400 block of East Chocolate Avenue changed from a Commercial Golf zoning classification to a Neighborhood Commercial zoning classification
457 4-27-1999 Lands located at the southwest quadrant of the intersection of Park Avenue and Hersheypark Drive changed from a General Commercial zoning classification to a Commercial Recreation zoning classification
459 3-25-2003 The area of land located at the southwest quadrant of the intersection of Cherry Drive and Governor Road is reclassified from a Village Residential to a Medical Campus zoning district classification; the area of land to be reclassified has formerly been identified on the Dauphin County Tax Maps as parcels 24-44-40 and 24-44-41 and is now part of parcel 24-32-37
461 6-22-1999 Lands located on the east side of North Lingle Avenue changed from an Agriculture/Conservation zoning classification to an Industrial zoning classification
463 8-10-1999 Tax Maps Parcel No. 24-005-024 is reclassified from its current zoning classification of Agriculture/Conservation to an Attached Residential zoning classification
Tax Maps Parcel No. 24-005-025 is reclassified from their current zoning classification of Agriculture/Conservation to a Village Residential zoning classification
Tax Maps Parcel No. 24-005-001, 24-005-017, 24-005-027 and 24-005-028 are reclassified from their current zoning classification of Agriculture/Conservation to an Economic Development zoning classification
464 8-24-1999 Lands located on the west side of Middletown Road and the north and south sides of Clifton Heights Road are changed from Agriculture/Conservation to Village Residential in part and Attached Residential in part
472 3-14-2000 All those certain parcels of land situated in Derry Township, Dauphin County, Pennsylvania, identified on the Dauphin County Tax Maps as Parcels 24-09-50 and the portion of Parcel 24-09-47 which, when subdivided, is the lot adjacent to Hersheypark Drive, changed in zoning classification from a Commercial Recreation classification to a Commercial Entertainment classification
475 5-9-2000 Land identified on the Dauphin County Tax Maps as Parcel No. 24-059-045 is reclassified from its current zoning classification of Agricultural/Conservation to a Multifamily Residential zoning classification
480 10-10-2000 Land identified on the Dauphin County Tax Maps as Parcel No. 24-009-037 from a Commercial Recreation zoning classification to a Commercial Entertainment zoning classification. The referenced parcel of land is located on the north side of Park Boulevard and is the site of the Chocolate World facility.
483 11-28-2000 Lands located to the west of Waltonville Road adjacent to the intersection of Roush Road and Waltonville Road changed from an Agricultural/Conservation zoning classification to a Suburban Residential zoning classification
499 11-27-2001 Land identified on the Dauphin County Tax Maps as Parcel 24-053-039 from an Agricultural/Conservation zoning classification to an M.H.S. Campus zoning classification. The referenced land is located on the northwest quadrant of the intersection of Meadow Lane and Bachmanville Road.
500 1-22-2002 Land owned by Derry Township known as Lot 251 of Deer Run, also known on the Dauphin County Tax Maps as Parcel 24-049-139 from a Multifamily Residential zoning classification to an Attached Residential zoning classification
525 1-27-2004 The tract of land identified on the Dauphin County tax maps as parcel 24-044-004, which is located at the southwest corner of the intersection of Sand Hill Road and Fishburn Road, is reclassified from a Village Residential to a Neighborhood Commercial zoning district
526 1-27-2004 The tract of land identified on the Dauphin County Tax Maps as parcel 24-055-001, which is located generally west of the Southpoint Commons development and east of Swatara Creek, is reclassified from an Agricultural/Conservation to a Village Residential zoning district
The tract of land identified on the Dauphin County Tax Maps as parcel 24-055-016, which is located generally south of the Southpoint Commons development and north of JoAnn Avenue, is reclassified from an Agricultural/Conservation to a Village Residential zoning district
532 7-13-2004 All those lands bounded on the south by the centerline of West Chocolate Avenue; bounded on the north by the centerline of Park Boulevard; bounded on the east by the centerline of Park Avenue; and bounded on the west by the centerline of Mill Road, which are not now classified as being in a Village Core zoning district are classified as being in a Village Core zoning district
540 1-3-2005 Land located west of Laudermilch Road and south of Swatara Road changed in zoning classification from an Agricultural/Conservation classification to an Economic Development classification

The portion of the Business Office District lying within the area bounded on the north by Route 322, on the east by Bullfrog Valley Road, on the south by Wood Road, and on the west by an existing Agricultural/Conservation District boundary line lying approximately 800 feet east of Waltonville Road, is designated as the Research Overlay District
549 9-13-2005 Land located on the south side of East Main Street changed in zoning classification from an Agricultural/Conservation classification to a Business Office classification
555 12-5-2006 Tracts of land known as 217, 229, and 235 Hockersville Road, also identified on the Dauphin County Tax Maps as parcels 24-034-001, 24-034-012, and 24-034-073, are reclassified from a Public zoning classification to a Downtown Commercial zoning classification
573 6-24-2008 Land located generally at the corner of Wood Road and Middletown Road, changed from an Agricultural/Conservation zoning classification to a Neighborhood Commercial zoning classification
578 10-27-2008 Two parcels of land located generally at the intersection of Old West Chocolate Avenue and Hersheypark Drive, changed from an Industrial zoning classification to a General Commercial zoning classification
579 11-11-2008 Rezone land from a Commercial Recreation zoning classification to a Commercial Entertainment zoning classification in accordance with the following description: All of that portion of land bounded on the west by the center line of Park Avenue (SR 0743), bounded on the north by the center line of Trinidad Avenue (T-519), bounded on the east and south by the Hershey Chocolate Factory property, and the Norfolk Southern Railroad, being all of the property commonly known as Zoo America, portions of Park Avenue, portions of Trinidad Avenue and portions of the Norfolk Southern Railroad.
582 2-10-2009 The tract of land known as 79 Lucy Avenue, also identified on the Dauphin County Tax Maps as parcel 24-031-127, is reclassified from a Village Residential zoning classification to a General Commercial zoning classification
600 10-25-2010 Land located generally south of and adjacent to Hershey Medical Center property, east of Appenzell Drive, is reclassified from a Suburban Residential zoning classification to a Medical Campus zoning classification
618 11-22-2011 Lands of LIT Palmyra, L.P. located on the east side of North Lingle Avenue and south of the railroad changed from an Agricultural/Conservation zoning classification to an Industrial zoning classification
623 5-22-2012 Changing the zoning classification of a western portion (7.07 acres) of the property located at 19 East Chocolate Avenue from an Industrial classification to a Village Core classification
