The Board of Supervisors is authorized to enter into intergovernmental cooperation agreements with Ontelaunee Township with regard to all roadways in and near the vicinity of the common boundaries between Maidencreek Township and Ontelaunee Township, which may include, but shall not be limited to, Dries Road, Slater Road and Bewley Lane, and provide for allocating and/or sharing maintenance, repair, winter maintenance, construction, and reconstruction, including stormwater, drainage, and drainage facilities related to the same, both now and in the future. The agreement shall authorize (but not compel) joint bidding for road projects concerning roadways on or near the common boundaries when deemed to be in the best interest of both townships. The intergovernmental cooperation agreement proposed with this section is appended hereto marked "Exhibit A" and made part of this article.[1]

The terms, conditions and provisions of the intergovernmental cooperation agreement between Ontelaunee Township and Maidencreek Township are incorporated herein by reference.
Any substantial modification or waiver to the intergovernmental cooperation agreement shall be effective only if made with the same formality as the agreement authorized by this article. Notwithstanding the preceding sentence, however, both townships reserve the right to make minor adjustments and changes to the agreement at any time and from time to time by joint resolution of each respective Board of Supervisors, which may from time to time be recommended by the respective road masters of each township, and which does not fundamentally change the nature and scope of this intergovernmental cooperation agreement. The failure of either township to insist on strict performance of any of the provisions of the agreement shall not be construed as a waiver of any other term, condition, or provision thereof, or any subsequent default of the same or similar nature.
