There is hereby created in and for the Township of Montville a Recreation Commission, which shall consist of seven members to be appointed by the Township Committee. There may also be appointed up to two alternate members who shall serve when the regular members are unavailable. All appointments shall be made from among the citizens and residents of the Township of Montville.

Appointments of regular members shall be for the term of five years, which terms shall be staggered, and vacancies shall be filled for the unexpired term only. Appointments of alternates shall be for a term of two years. The members shall serve until their respective successors are appointed and shall qualify.
The members of the Recreation Commission shall receive no salary or other compensation for their services.
Upon the appointment of the members of said Recreation Commission, said Commission shall organize and elect such officers and adopt such rules and regulations as the Commission may deem necessary for the faithful discharge of its duties and for the proper exercise of the powers conferred on said Commission as provided for in N.J.S.A. 40:12-1 through 40:12-8, as amended and supplemented.
The Recreation Commission shall have full control over all lands, playgrounds and recreation places acquired or leased pursuant to and under the provisions of N.J.S.A. 40:12-1 through 40:12-8, as amended and supplemented, and may adopt suitable rules, regulations and bylaws for the use thereof and the conduct of all persons while on or using the same.
The Commission may, subject to the direction and supervision of the Administrator and within available appropriations, appoint such personnel, either full- or part-time, as the Commission may deem necessary or desirable to carry out the programs instituted by it. The Administrator may appoint any appointee of the Commission as the head of the Department of Parks and Recreation.
The custodians, supervisors and assistants appointed by the Recreation Commission shall, while on duty, for the purpose of preserving order and the observation of the rules, regulations and bylaws of the Recreation Commission, have all the power and authority of police officers of the Township of Montville, and any person who shall violate any such rules, regulations or bylaws of the Recreation Commission shall be deemed and adjudged to be a disorderly person.
The Recreation Commission shall make an annual written report on or before the first day of January each year and transmit the same to the Township Committee of the Township of Montville. Said annual written report shall contain an itemized accounting of all activities, receipts, disbursements, expenditures and the number of employees for the full year.
The Recreation Commission shall, in addition to the powers and duties defined herein, be chargeable with the performance of all duties and be vested with all of the powers as are more particularly set forth in N.J.S.A. 40:12-1 through 40:12-8, as amended and supplemented.
