Chapter 149: DUMPSTERS

§ 149-1 Permit required; fee; renewal; responsibilities of applicant.

A. No person shall park or leave unattended any waste or refuse container, commonly known as a "roll-off dumpster" or "roll-off container," on or along any highway, traveled roadway or dedicated roadway without a permit. The permit shall be issued by the Traffic Safety Officer. The fee for the permit is set forth in Chapter 169, Fee Schedule. The permit shall be valid and remain in effect for a period of seven days and renewed for like periods not to exceed a total of 28 days. B. The applicant assumes full responsibility for the integrity of the roadway upon which the dumpster or container is placed and agrees to repair and/or restore the roadway and the public right-of-way to its original condition should the dumpster or container cause any damage.

§ 149-2 Location of dumpster; bond or security.

A permit shall not be issued until the applicant has provided the Township with a clear identification on the anticipated location of the dumpster and has posted a bond, letter of credit or cash security with the Township in the amount of $1,000 for the assurance of removal or any restoration of the street, curb or surrounding area in the public right-of-way that may be damaged by the presence of the dumpster or container.

§ 149-3 Display markers.

In the event that a permit is issued for a dumpster to be placed on a public highway, to warn the operators of vehicles of the presence of a traffic hazard requiring the exercise of unusual care, any roll-off dumpster or roll-off container parked on or along any highway shall be equipped with and display markers consisting of all yellow reflective diamond-shaped panels having a minimum size of 18 inches by 18 inches. These panels shall be mounted at the edge of the dumpster or container at both ends nearest the path of passing vehicles and facing the direction of oncoming traffic. These markers shall have a minimum mounting height of three feet from the bottom of the panels to the surface of the roadway.

§ 149-4 Dumpsters prohibited on certain streets.

Notwithstanding any provision in this chapter to the contrary, no permit shall issue for an overnight dumpster on streets enumerated in § 10.20.070 of the Montville Township Code nor shall they be placed on any public roadway where the width of road passage is less than 15 feet.

§ 149-5 Violations and penalties.

A. Any person, firm or corporation violating any of the provisions of this chapter shall be subject to such penalties as are provided for in Chapter 1, Article III, General Penalty.

B. The fine shall be paid over to the board or body charged with the maintenance of the road or highway upon which the violation occurs.

§ 149-6 Removal.

If the roll-off dumpster or container is not removed when the same is requested or if a permit is not obtained and the condition is considered emergent, the dumpster or container will be removed by the Township of Montville and processed by any of the affected government entities at the expense of the applicant.
