The owner or owners, tenant or tenants of lands abutting the public highways, streets and avenues in the Township of Montville shall remove all snow and ice from the abutting sidewalks and fire hydrants of such highways, streets and avenues within 24 hours after the same shall fall or be formed or accumulate thereon. This article shall be deemed to have been complied with when the sidewalk has been cleared to bare pavement to a width of 30 inches for its entire length. Any patches or minimum accumulation of snow which remains after clearing and which will not inhibit pedestrian traffic shall not be deemed to constitute a violation of this article. In the event that additional snow shall fall after initial removal or is deposited upon a clear sidewalk or hydrants by plowing, then an additional twenty-four-hour period shall be granted within which to clear this additional accumulation. In the event of ice which may be so frozen as to make removal impracticable, the owner or tenant shall cause the same to be thoroughly covered with sand, ashes, salt, sawdust or some other nonslippery or adhesive substance so as to make the same safely passable.
No owner or operator of premises having parking spaces reserved for handicapped drivers and no tenant, contractor or other person may block access to such parking stalls reserved for handicapped drivers by the plowing, piling or placement of snow or ice in such spaces.
A. 
The owner or owners or tenant or tenants of any lands abutting the public highways, streets and avenues in the Township of Montville shall remove all grass, weeds, hedges, bushes, low-hanging branches and other impediments from the abutting sidewalks, sidelines or gutters of such highways within three days after written notice to remove the same, and shall remove all grass, weeds, hedges, bushes, low-hanging branches and other impediments from the portion of any public highway, street or avenue which shall be a hindrance to or obstruct the view of operators of vehicles using such public highway, street or avenue within three days after written notice to remove the same.
B. 
Notice.
(1) 
The written notice hereinabove provided for directing the removal of such grass, weeds, hedges, bushes, low-hanging branches or other impediments shall be prepared by the Superintendent of Public Works, over his signature, and shall identify the lands abutting the highways, streets or avenues and shall contain a short statement relating in detail and identifying such grass, weeds, hedges, bushes, low-hanging branches or other impediments which are directed to be removed. Said notice shall also contain a statement that the violation of the terms of this article is punishable by fine.
(2) 
Said notice may be served upon the owner or owners, tenant or tenants resident in the Township of Montville, in person or by leaving the same at their house or place of residence with a member of their family above the age of 14 years. In case the owner of any such property is a nonresident, then such notice may be served upon him personally or mailed to his last known post office address or it may be served upon the occupant of the property or upon the agent in charge thereof. In case the owner of any such property is unknown or service cannot for any reason be made as above directed, notice thereof shall be published at least once in a newspaper circulating in the Township of Montville, and a copy of said notice shall be posted in a conspicuous place upon said premises.
If the owner or owners or tenant or tenants of any lands abutting the public highways, streets and avenues of the Township of Montville shall violate the provisions of § 330-38 or 330-40 hereof, or both, the Superintendent of Public Works may remove all such snow or ice or such grass, weeds, hedges, bushes, low-hanging branches or other impediments as aforesaid, and after such removal the Superintendent of Streets shall certify the cost thereof to the Township Committee of the Township of Montville, which shall examine the certificate and, if found correct, shall cause the cost as shown thereon to be charged against said lands. The amount so charged shall forthwith become a lien upon such lands and shall be assessed and levied upon such lands, the same to bear interest at the same rate as taxes, and shall be collected and enforced by the same officers and in the same manner as taxes.

A developer and/or owner of property which contains a road which is open for use but has not been accepted by the Township as a public road shall provide snow plowing and ice control on the road until such time as it has been accepted by the Township. It shall be a violation of this article for the developer/owner to fail to provide snow plowing and ice control within a reasonable time. The Township retains the right, but not the obligation, to provide snow plowing and ice control on unaccepted roads of subdivisions on which occupied residential properties exist when the developer fails to fulfill its obligation to provide these services. The Township will provide this service upon the default of the developer when the Township has available resources and deems it in the public interest. In the event the Township provides snow plowing and ice control services, the developer shall be charged a fee as provided for in Chapter 169, Fee Schedule.

It is hereby prohibited and unlawful for any residential homeowner or tenant, commercial property owner or commercial tenant or their employees, agents, contractors or contractors' employees to dump, plow, shovel or otherwise place snow onto streets or roadways.

Any person, firm or corporation violating any of the provisions of this article shall be subject to such penalties as are provided for in Chapter 1, Article III, General Penalty.
