This chapter shall be known and cited as the "Zoning Ordinance of the Village of Superior."
A. 
All words in the present tense include the future tense; all words in the singular number include the plural and all words in the plural number include the singular number; unless the natural construction of the wording indicates otherwise, the word "shall" is mandatory. The word "used" includes the words "designed or intended to be used." All distances shall be measured horizontally unless otherwise specified. The word "Village" shall mean the Village of Superior.
B. 
For the purpose of this chapter, certain terms used herein are defined as follows:
ALLEY
A thoroughfare less than 30 feet in width.
APARTMENT
A room, or a suite of two or more rooms, which is designed for, intended for or occupied by one family doing its cooking therein.
AUTOMOBILE WRECKING
See "junkyard."
BLOCK
The property abutting a street between the two nearest intersecting or intercepting streets. A railroad right-of-way or the boundary line of unsubdivided acreage or a body of water shall be regarded the same as an intersecting or intercepting street for the purpose of defining a "block."
BUILDING
Any structure intended for the support, shelter or enclosure of any person, chattel or property of any kind. For the purpose of this chapter, the word "building" shall include the word "structure."
BUILDING, ACCESSORY
A subordinate building, the use of which is incidental to the main building on the same lot. On any lot on which a dwelling is located, any building used for or incidental to any agricultural use shall be deemed to be an accessory building.
BUILDING, MAIN
A building in which is conducted the principal use of the lot on which it is situated. In any residential district, any dwelling shall be deemed to be a main building on the lot on which it is situated.
DWELLING, MULTIPLE
A building or portion thereof used or designed as a residence for three or more families living independently of each other and doing their own cooking in said building; including apartment houses, apartment hotels and flats, but not including automobile courts.
DWELLING, ONE-FAMILY
A detached building designed for or occupied exclusively by one family.
DWELLING, TWO-FAMILY
A detached building designed for or occupied exclusively by two families living independently of each other.
FAMILY
One or more persons occupying a premises and living as a single, nonprofit housekeeping unit.
GARAGE, PRIVATE
An accessory building or portion of the main building used only for the storage of self-propelled vehicles, in which the storage space does not exceed that necessary for, in a one-family residence or two-family residence district, two vehicles on a lot and, in addition, one vehicle for each 3,000 square feet of lot area in excess of 6,000 square feet; and in a multiple-dwelling district, two vehicles on a lot and, in addition, one vehicle for each family housed on the lot; on any lot or parcel of land of one acre or more in area, in lieu of the foregoing specified storage space, the storage space shall not exceed that necessary for the vehicles used by the families housed on such lot or parcel, including visitors, servants and farm help. Except for vehicles used in agriculture, not more than one commercial vehicle shall be stored in a private garage.
GARAGE, PUBLIC
Any premises, except those herein defined as a private garage, used for the storage or care of self-propelled vehicles or where any such vehicles are equipped for operation or repair or kept for remuneration, hire or sale.
GARAGE, STORAGE
Any premises, except those herein defined as a private garage, used exclusively for the storage of self-propelled vehicles.
HEIGHT OF BUILDING
The vertical distance to the level midway between the eaves and the highest point of the roof, at the center of the building's principal front, measured as follows:
(1) 
From the established grade, if the front of the building is not more than five feet from the property line.
(2) 
From the average elevation of the finished grade along the front of the building, if the building is set back more than five feet from the property line.
HOME OCCUPATION
Any use customarily conducted entirely within a dwelling and carried on by the inhabitants thereof, which use is clearly incidental and secondary to the use of the dwelling for dwelling purposes and does not change the character thereof. Clinics, hospitals, barbershops, beauty parlors, tea rooms and animal hospitals shall not be deemed to be home occupations.
HOTEL
Any building or portion thereof which provides or which is intended, arranged or designed to provide meals or lodging or both to guests for compensation, whether the compensation is paid directly or indirectly, and containing five or more sleeping rooms for such guests, with no provision for cooking in any such guest room.
JUNKYARD
The use of more than 200 square feet of the area of any lot or the use of that half of any lot which adjoins any street for the storage, keeping or abandonment of any junk, including scrap metals or other scrap material, or for the dismantling, demolition or abandonment of automobiles or other vehicles or machinery or parts thereof; provided, however, that this definition shall not be deemed to include any of the foregoing uses which are necessary and incidental to any agricultural uses permitted in the district.
LOT
Land occupied or to be occupied by a building and its accessory building, together with such open spaces as are required under this chapter, and having frontage on a street.
LOT, CORNER
A lot abutting on two or more streets at their intersection.
LOT, INTERIOR
A lot other than a corner lot.
LOT, THROUGH
A lot other than a corner lot having frontage on two streets.
SETBACK
The minimum distance between the street line on that side of a block on which interior lots have been platted, or the street line along unplatted land, and the building or any projection thereof other than steps, uncovered porches or entrance canopies not exceeding 20 square feet of roof area.
STORY
That portion of a building included between the surface floor and the surface of the next floor above it, or if there is no floor above it, then the space between the floor and the ceiling next above it. A basement shall be counted as a story if its ceiling is over five feet above the level from which the height of the building is measured or if it is used for business purposes or for dwelling purposes.
STORY, HALF
A story with at least two opposite exterior sides meeting a sloping roof not more than three feet above the floor of such story.
STREET
A thoroughfare 30 feet or more in width, dedicated to the public, or privately owned before the passage of this chapter, or privately owned hereafter and approved by the Village Board.
STRUCTURAL ALTERATIONS
Any change in the supporting members of a building, such as bearing walls, columns, beams or girders.
STRUCTURE
Anything constructed or erected, the use of which requires location on the ground or attachment to something having location on the ground.
USE
The purpose for which land or a building thereon is designed, arranged or intended, or for which it is or may be occupied or maintained.
USE, ACCESSORY
A use incidental and accessory to the principal use of a lot or a building and located on the same lot as the principal use.
USE, NONCONFORMING
Use of a building or of land that does not conform to the regulations for the district in which it is situated.
YARD
An open space, other than a court, on the same lot with a building, unoccupied except as otherwise herein provided.
YARD, REAR
A yard extending across the full width of the lot and lying between the rear line of the lot and the nearest line of the building.
YARD, SIDE
A yard between the side line of the lot and the nearest line of the building and extending from the front lot line to the rear yard.
