The purpose of this chapter is to promote the health and welfare of the inhabitants of the Town of Jerusalem by regulating the burial of deceased human bodies in places other than established cemeteries.
No person shall inter any deceased human body in any place within the Town of Jerusalem that is not operated by a religious or a cemetery corporation unless the following rules are observed:
A. 
The written consent of the owner or person having charge of the place shall have been obtained.
B. 
The body shall be contained in a coffin or vault.
C. 
The grave shall be of the depth of not less than six feet and shall not be less than ten feet from the lands of any adjoining owner nor less than one hundred feet from any water well, lake or stream.
D. 
Within a reasonable time following the burial, the grave shall be identified by a permanent marker of noncorrosive metal or stone.
The term "deceased human body" does not include the ashes of a body that has been cremated.
A violation of this chapter shall constitute an offense punishable by a fine not to exceed $100.
