As used in this chapter, the following terms shall have the meanings indicated:
BOROUGH
Any official or agent of the Borough of Harveys Lake, Luzerne County, Pennsylvania.
SHORE POINT
Any private dock, boat landing, beach or lands abutting the waters of Harveys Lake.
UNSUPERVISED SWIMMING
Includes any swimming activities in the waters of Harveys Lake, not including water skiing or scuba diving, without the presence of a safety craft or recreational boat within 100 feet of such activity or without the use of a life preserver, ski jacket or other similar safety device.
WAKE LINE
The point at or about 100 feet from the aforesaid shore points abutting the waters of Harveys Lake at which the Fish Commission of the Commonwealth of Pennsylvania prohibits recreational use of motorboats. Such point shall be designated by a buoy placed in said waters.
This chapter is enacted for the specific purpose of regulating the health and welfare of the Borough, its inhabitants and those who use the waters of Harveys Lake for recreational purposes.
From and after the passage of this chapter, it shall be unlawful for any person or persons to conduct unsupervised swimming activity in the waters of the Borough of Harveys Lake at any distance beyond the wake line as designated in the definition of "wake line" in § 43-1.
Any person or persons violating any of the provisions of this chapter shall be issued a warning by the Borough for the first violation of such chapter. Upon any and all repeated violations of these provisions, such person or persons shall be issued a summary citation and upon conviction thereof shall be fined $50. Default of the payment of such fine and costs shall result in imprisonment for a period not to exceed 30 days.
