It is the purpose of this article to comply with the New Jersey Statewide
Mandatory Source Separation and Recycling Act, P.L. 1987, c. 102,[1] and the New Jersey Recycling Act of 1981, P.L. 1981. c. 278,[2] as well as the provisions of the Bergen County Long-Term Solid
Waste Management Plan Amendment.
As used in this article, the following terms shall have the meanings
indicated:

Residential sector definitions.
Beverage containers made of a lightweight silver-sheet, metallic
element.
Cardboard of the type to make cardboard boxes, cartons, pasteboard
and similar corrugated and kraft paper material.
All metal scrap containing steel and/or cast iron.
All containers made from silica or sand, soda ash and limestone,
the product being transparent or translucent and being used for packaging
or bottling of various matter of a brown, white (clear) or green color and
all other material commonly known as glass excluding, however, blue glass,
plate glass and glass commonly known as "window glass."
Green herbage sending up spike-like shoots or blades.
Those materials naturally formed from trees and bushes that are suitable
for composting and mulching purposes.
A paper product, shall be deemed to include the type of distributed
usually daily or weekly, having printed thereon news, opinion, advertisements,
and other matter of public interest.
A hermetically sealed, or made airtight with a metal or plastic cap,
container with a minimum wall thickness of not less than ten-thousandths (0.010)
inch, and composed of thermoplastic synthetic polymeric material.
Cans made of steel or tin. The most common are tin-plated steel cans
which contain food.
Used oil from motor vehicles, lawnmowers and motorcycles.
Used appliances such as refrigerators, washers, dryers and stoves.
Includes leaves, grass, clippings, tree stumps, branches, limbs and
brush.

Source-separated nonputrescible recyclable material generated from
the construction, alteration, repair, maintenance and/or demolition of structures
within Northvale. This material shall include concrete, bricks, block, ferrous
and nonferrous scrap, asphalt, asphalt shingles, recyclable wood scrap and
any and all other material generated from the construction, alteration, repair,
maintenance and/or demolition of structure within the Borough of Northvale.

RECYCLING COORDINATOR
SOLID WASTE
General definitions.
Includes all individuals, partnerships, corporations, owners, tenants,
lessees, firms, societies, schools, churches and associations, either profit
or nonprofit, within the Borough of Northvale.
The term used to include all materials, designated by this article
or future ordinances, to be separated from solid waste placed at curbside
for separate pickup.
Any process by which materials which would otherwise become solid
waste are collected, separated or processed and returned to the economic mainstream
in the form of raw materials or products.
The person appointed by the Mayor and approved by the Council who
shall be authorized to coordinate the borough's Recycling Program and
assist with the enforcement of the provisions of this article and the rules
and regulations promulgated hereinafter.
The term shall include all garbage, rubbish and waste matter usually
disposed of under the municipal garbage contract and normally placed at curbside
by the residents and commercial occupants in the Borough of Northvale for
usual collection at regular intervals by the contractor holding the borough
garbage contract.
A.Â
The positions of Recycling Coordinator and Deputy Coordinator
are hereby created and established within the Borough of Northvale.
B.Â
The Recycling Coordinator and Deputy shall be appointed
by the Mayor for a one-year term.
C.Â
Subject to the approval of the Mayor and Borough Council,
the Recycling Coordinator shall establish and promulgate reasonable rules
and regulations as to the manner, days and times for the collection, storage,
transportation, sale and/or marketing of said recyclable materials in order
to encourage the preservation of material resources while minimizing the cost
of the recycling program to the Borough of Northvale.

The Recycling Coordinator shall annually submit a recycling
tonnage report to the New Jersey Office of Recycling and such other reports
required by the Bergen County Utilities Authority, with copies to the Borough
Council and Mayor.
A.Â
Effective May 1, 1994, it shall be mandatory for all
occupants of residential property to separate recyclable material from solid
waste within the Borough of Northvale for the purposes of recycling.
B.Â
Designation of recyclable materials.
(1)Â
Mandatory residential. The following are identified as
mandatory materials:

Glass beverage containers, aluminum cans and tin cans
shall be washed and rinsed clean, with all wraparound labels removed. All
bottle caps and lids shall also be removed. Said glass beverage containers,
aluminum cans, plastic and tin cans may either be separated or commingled
and placed in reusable containers for curbside collection on designated days.
(2)Â
Newspapers shall be bundled separately in units not to
exceed 30 pounds in weight and 12 inches in height. Bundles may be placed
in paper boxes or placed at the curb for collection on days and at times and
in such manner, as shall be designated by the Recycling Coordinator under
rules and regulations promulgated by this article.
(3)Â
Ferrous scrap shall be separated from other recyclable
materials and placed in a reusable container for curbside collection on designated
days.
(4)Â
White goods shall be picked up at the user's residence
by the Northvale DPW. It is the responsibility of the residential user to
notify the DPW and schedule an appointment for said pickup. White goods shall
not be placed at curbside unless so ordered by the DPW and only on scheduled
appointment days. There will be a fee of $15 for the pickup of each white
good item.

Yard waste shall be placed in containers supplied by
the borough and deposited at the curb on designated days. Leaves shall be
placed in the street only after October 15 of each year and will be picked
up as permitted by weather conditions. The aforementioned containers shall
be the property of the borough. Each container will have an ID number and
will be registered with the DPW. If a resident loses the container, a replacement
must be purchased by the resident at his/her own expense.

Used oil shall be separated and disposed of in receptacles
provided for said purpose at the DPW.
A.Â
Persons owning, leasing, renting or having control of
properties, the primary use of which is not as a single- or two-family residence,
effective May 1, 1994, shall:

Separate recyclable material from solid wastes within
the Borough of Northvale for the purposes of recycling.
B.Â
Designation of recyclable materials.

Mandatory commercial and light industrial. The following
are identified as mandatory materials:

Glass beverage containers, plastic containers and aluminum cans shall be washed, rinsed and cleaned in accordance with the provisions of § 170-16C(1) of this article. Glass beverage containers and aluminum cans may either be separated or commingled and placed in reusable containers for curbside collection on designated days.
(2)Â
Corrugated cardboard, high-grade paper and mixed paper
may either be bundled separately or bundled together in units not to exceed
(30) pounds in weight and 12 inches in height. Bundles may be placed in paper
boxes for collection on days and at times and in such manner as shall be designated
by the Recycling Coordinator.
(3)Â
It shall be the duty of the commercial and light industrial
users to dispose at their own cost and expense all construction and demolition
debris, ferrous scrap and white goods through an approved private agency as
defined by the DPW. It shall be the further duty of said users to obtain a
weight slip and submit same to the Borough Recycling Coordinator.
(4)Â
Used motor oil shall be disposed of in accordance with the provisions of § 170-16C(6).
A.Â
Recycling site disposal. At the option and expense of
persons required to separate newspapers, corrugated cardboard, high-grade
paper and/or mixed paper, the same may be brought to the Recycling Center
owned by the Borough of Northvale.
B.Â
Volunteer or charitable recycling drive disposal. Nothing
herein contained shall be construed to limit volunteer, charitable or other
organizations from conducting newspaper drives. The date, time, place and
nature of these collections shall be presented in advance and in writing to
the Recycling Coordinator, who shall approve or disapprove the date, time,
place and nature of the collection in accordance with regulations promulgated
by the Recycling Coordinator.
C.Â
Rules and regulations. The Mayor and Council authorizes
the Borough Recycling Coordinator or his agent to establish and promulgate
rules and regulations in accordance with the provisions hereof. This article
shall be enforced by the Recycling Coordinator, by the Department of Health,
Police and Public Works, by the Construction Official's Office and such
other employees or departments of the borough as designated by the Mayor and
Council.

Any person who violates any provision of this article and the rules
and regulations issued pursuant thereto, shall, upon conviction thereof, be
subject to a fine not less than $25 nor more than $1,000.
