This article is adopted by the Mayor and Council of the Borough of Northvale for the purpose of keeping roads within the Borough of Northvale in repair and safe and convenient for travel during all seasons of the year.
It shall be unlawful for any person:
A. 
To cast, throw or spill any dirt, sand, ashes, gravel, brick, stones, wastepaper or other similar loose material on any road in the Borough of Northvale.
B. 
To mix any dry or wet concrete, cement or plaster of any kind or description upon the surface of any road in the Borough of Northvale.
C. 
To spill any turpentine, kerosene, gasoline, petroleum, lubricating oil or other highly inflammable oils or their volatile products or to allow any of such fluids to escape upon the surface of any borough road or to operate any tank trucks or other vehicle from which any of such fluids are permitted to escape.
D. 
To flush or cause to be drained or pumped to the surface of any road in the Borough of Northvale any fluid waste of any kind.
E. 
To place or cause to be placed on any road in the Borough of Northvale any permanent or temporary obstruction of whatever kind.
F. 
To throw snow or ice on the traveled portion of any road in the Borough of Northvale after the same has been cleared or plowed or to pile in front of any crosswalk so as to obstruct same.
The Superintendent of the Department of Public Works shall have power to compel the removal of any obstruction placed on any road in the Borough of Northvale in violation hereof.
The word "person," as used within, shall include any individual, partner or member of any partnership or association and the officers, agents or employees of any corporation who are responsible for any violation of any of the provisions hereof.
The Superintendent of the Department of Public Works and the Northvale Police Department are each independently charged with the enforcement of all the provisions of this article.
No person shall throw or drop any bundle, object, article, litter or debris of any nature from a vehicle, whether in motion or not, when such vehicle is on any public street in the borough.
A. 
"Bundle, object, article, litter or debris of any nature," as used in this section, shall be deemed to include a lighted cigarette, cigar, match or live ashes or any substance or thing in and of itself likely to cause a fire, but such inclusion shall not be deemed to in anywise limit the generality of said words "bundle, object, article, litter or debris of any nature."
B. 
There shall be rebuttable presumption that the registered owner of the vehicle from which a bundle, object, article, litter or debris was thrown or dropped was the person who committed the act. In the absence of the registered owner being present in the vehicle, then the presumption shall be that the driver of the vehicle is the person who committed the act. If the registered owner is a corporation, then the presumption shall be that the agent of the corporation who is assigned the vehicle involved was the person who committed the act.
Any person or persons, firm or corporation who or which violates any provision of this chapter shall be punishable as provided in Chapter 1, General Provisions, article II, General Penalties. Each day any such violation shall be continued shall constitute a separate and distinct offense, and conviction shall not excuse the violation or permit it to continue.
