Borough of Northvale, NJ Chapter 211 Food Handlers

Article I Training Course

§ 211-1 Definitions.

As used in this article, the following terms shall have the meanings indicated:

FOOD-HANDLING ESTABLISHMENT

Any fixed or mobile restaurant in which food or drink is prepared or processed for human consumption, be it for on- or off-premises consumption.

SUPERVISOR

Any person charged with the responsibility of overseeing the operations, including the supervision of employees engaged in the preparing or processing of food or drink intended for human consumption, be it for on- or off-premises consumption.

§ 211-2 Certificate required.

A. All retail food establishments are required to have in their employment a supervisor who has a valid food handler's certificate on the premises at all such times the establishment is in operation or open for business. Establishments shall provide personnel to an approved food handler training course in the following manner:

(1) Take-out and miscellaneous establishments: one person per shift.

(2) Restaurants of 49 seats and below: one person per shift.

(3) Restaurants of 50 seats and above: two persons per shift.

(4) Supermarkets: one store manager and one person from each department per shift.

(5) Hotels/motels: one person from each food-handling department or restaurant per shift.

B. A food handler's certificate, renewable every two years, shall be issued to any person successfully completing a course of instruction given or approved by the Northwest Bergen Regional Health Commission. All courses shall be in compliance with current New Jersey State Department of Health guidelines for food course training. The cost of such course shall be borne by the applicant.

§ 211-3 Certificates not transferable.

No person to whom a food handler's certificate is issued shall give, loan, transfer or permit the same to be used by any other person for any purpose whatsoever.

§ 211-4 Enforcement.

Any establishment not in compliance with any provision of this article shall be subject to fines/cost not to exceed $1,000. The Board of Health may suspend the retail food establishment license of any person, partnership, corporation or establishment in violation of this article for a period not more than three days, pursuant to the authority of the Board of Health to license and regulate food establishments as provided by N.J.S.A. 26:3-31(c).
