No cesspool, septic tank or similar receptacle into which there is discharged or deposited drainage from toilets, human excreta or material containing human excreta shall hereafter be constructed, reconstructed or installed in the Borough of Northvale unless a permit therefor shall first have been issued by this Board at a fee of $1.
Each cesspool, septic tank or similar receptacle hereafter constructed, reconstructed, installed, maintained or used in the Borough of Northvale shall comply with the following requirements:
A. 
The side walls shall be substantially constructed to prevent caving.
B. 
All openings shall be so covered as to prevent the entrance of flies and mosquitoes into the receptacle.
C. 
Each such receptacle shall be so located that any part thereof or auxiliary drainage system connected therewith shall be at least eight feet from any property line.
The owner, tenant or other person having control of any premises upon which there is a privy, cesspool or other receptacle for human excreta shall cause the contents of the same to be removed as frequently as necessary to prevent such excremental matter or liquid containing the same from overflowing upon the surface of the ground, and no such person shall permit such excremental matter or liquid containing the same to overflow onto the surface of the ground or to leach into or enter any well or spring, the waters of which are used for drinking or household purposes.
No person shall occupy or use any building or premises which are not provided with a privy vault, septic tank or cesspool and proper adequate toilet facilities constructed in accordance with the requirements of this chapter and the Chapter 84, Construction Codes, Uniform.
No person or persons shall build or construct, reconstruct or maintain any receptacle for manure within 25 feet of any street or neighboring residences.
No house or kitchen slops, sink drainage, laundry waste or other decomposable or putrescible waste liquids shall be discharged or deposited in or upon any sidewalk, street, highway or public place in the Borough of Northvale or in such place or manner as to reach any sidewalk, street, highway or public place in the borough or in or upon any private property within a distance of eight feet from any property line; nor shall such waste liquids be otherwise disposed of or permitted to accumulate in any manner that will create a nuisance detrimental to the public health; provided, however, that this section shall not apply to any sewerage system approved by the State Department of Health.
No surface, spring or subterranean waters shall be permitted or caused to accumulate on any private property or permitted or caused to be drained into or upon any street or public place in such a manner as to create a condition hazardous or dangerous to public health.
Whatever is dangerous to human health or whatever renders the ground, water, air or food a hazard or injury to human health is hereby prohibited and declared to be a nuisance.
