For the purpose of this article, the terms used herein are defined as follows:
DEAD-END STREET
A right-of-way over which there is a right of public passage but which does not join another street, road or highway at both of its termini.
HIGHWAY
An improved right-of-way over which there is a public right of passage and which traverses this Borough from one side to another and which includes any portion of streets, roads or highways comprising it, as well as the term "through street."
OWNER
Any person, firm, association or corporation having an interest in the subject matter hereof, including, for the purposes of this article, the owner, developer, applicant, agent, engineer or other person representing such "owner" as defined herein.
PAVEMENT SPECIFICATIONS FOR ROADS, STREETS AND HIGHWAYS
Those certain written pavement specifications for roads, streets and highways in the Borough of Washington, Warren County, New Jersey, consisting of four pages prepared by George W. Oakes, Jr., Washington Borough Engineer, dated March 1, 1972, and on file in the Washington Borough Clerk's office, which written specifications are herewith incorporated by reference and made a part hereof.
ROAD
A general term; a right-of-way, improved or unimproved, over which there is a public right of passage.
STANDARD CONSTRUCTION DETAILS
Those certain drawings entitled "Standard Construction Details," showing typical half sections for fifty-foot, sixty-foot and sixty-six-foot streets; six-by-eight-by-twenty-inch concrete curb; four-inch concrete sidewalk; concrete headwall, storm drain inlet; storm sewer manhole and sanitary manholes, as shown on Sheets 1 and 2 of the Standard Construction Details, drawings dated March 1, 1972, of the Borough of Washington, Warren County, New Jersey, prepared by George W. Oakes, Jr., Washington Borough Engineer, and on file in the Washington Borough Clerk's office, which drawings are herewith incorporated by reference and made a part hereof.
STREET
A right-of-way, improved or unimproved, over which there is a public right of passage but which is primarily intended to serve only a limited portion of this Borough.
After this article becomes effective, no street, road or highway shall be accepted by the Borough Council and taken over as a municipal thoroughfare to be maintained as such at the public expense unless it shall conform to the following minimum specifications and requirements and the specifications as shown on the Standard Construction Details included in the pavement specifications for roads, streets and highways:
A. 
The width of the right-of-way shall be at least 50 feet on newly laid out roads and streets and at least 60 feet on highways.
B. 
The minimum graded width of the right-of-way shall be 50 feet for streets and 60 feet for highways. All newly laid out roads, streets or highways shall be graded the full width of the right-of-way.
C. 
The width of the paved area of the right-of-way on a dead-end street shall be at least 30 feet, with curbs on both sides.
D. 
On all other roads, streets or highways, the paved width of the right-of-way shall be as follows:
(1) 
On fifty-foot rights-of-way: 36 feet, with curbs on both sides.
(2) 
On sixty-foot rights-of-way: 36 feet, with curbs on both sides.
(3) 
On sixty-six-foot rights-of-way: 44 feet, with curbs on both sides.
E. 
All pavements shall be constructed in accordance with the pavement specifications for roads, streets and highways and with the following, which are hereby declared to be minimum requirements for engineering plans, specifications, type of road to be built, materials and method of construction:
(1) 
All roads, streets and highways, as defined herein, are to be built in accordance with the pavement specifications and Standard Construction Details. The plans and specifications shall include center-line profiles, typical cross sections for all streets, roads or highways, provide for proper drainage within the road, street or highway, graded width, at intersections, and for all slopes related to the proper drainage of the immediate vicinity. Grades for all roads, streets or highways are to be a minimum 0.80%, maximum 10%.
(2) 
All roads or streets shall be built to the following minimum requirements and specifications: four-inch compacted thickness, bituminous stabilized base course with two-inch FA-BC-1 surface course, mix No. 5. The materials and construction shall be in accordance with the pavement specifications and Standard Construction Details.
F. 
The location and width of sidewalks shall be as shown on the Standard Construction Details.
G. 
An adequate drainage system to handle all drainage at all times and prevent ponding within the right-of-way or on abutting properties must be provided. The locations of catch basins, inlets, outlets, manholes and other parts of the system are to be accurately and distinctly shown on the maps to be filed in the Borough Clerk's office. All drainage pipe sizes and rates of grade are to be clearly shown. All drainage systems shall be in conformity with the appropriate minimum specifications of the New Jersey Department of Transportation.
H. 
In any residential development, an adequate sanitary sewer must be provided, complete with connections carried to six inches behind the curbline, manholes and all other necessary structures, within the public right-of-way.
I. 
In the event any ditch, pipeline or watercourse crosses the right-of-way, proper provisions must be made for its crossing of the public right-of-way shown on the map. If the watercourse is such as to come under the jurisdiction of the Warren County Board of Chosen Freeholders, written approval of the location of the road, street or highway and the provisions made for the crossing must accompany the map.
J. 
The title to the right-of-way must be approved by the Borough Attorney, and any deed of dedication, releases of mortgages or other title instruments reasonably required by the Attorney must be provided at the cost and expense of the owner, and the owner shall likewise pay the cost and expenses of publication of any ordinance which, in the opinion of the Borough Attorney, is required for acceptance of any such road, street or highway.
At least 10 copies of the survey or map of the road, street or highway, one of which shall be made on translucent white tracing cloth with colorfast, waterproof ink and two of which shall be heavy cloth print duplicates, shall be filed with the Borough Clerk's office when application is made to the Borough for approval of said map or survey and the acceptance of the road, street or highway shown thereon.
The approval of any maps and plans for the purpose of enabling owners to comply with the provisions of R.S. 46:23-2(e) shall not be deemed an acceptance of any roads, streets or highways shown thereon, nor shall the Borough of Washington, prior to the final adoption of an ordinance for the purpose of approval and acceptance, be in any way obligated to maintain or exercise jurisdiction over any of such roads, streets or highways.
The Borough Council, in its discretion, may refuse to approve or accept any road, street or highway, notwithstanding compliance with all the provisions of this article, when, in its judgment, the public interest renders such approval or acceptance inadvisable. It may also permit exceptions and variations to the foregoing requirements when good cause therefor is shown and the public interest will not be adversely affected thereby. In any case, the Borough Council may refuse to accept any road, street or highway until such time as the same is fully completed in accordance with the provisions herein.
The written pavement specifications and Standard Construction Details on file in the Borough Clerk's office and referred to herein are an integral part of this article, and the requirements and specifications therein are to govern.
