[HISTORY: Adopted by the Borough Council of the Borough of Kingston (now Town Council of the Municipality of Kingston) 12-14-1970; amended in its entirety 3-6-1995 by Ord. No. 1995-9. Subsequent amendments noted where applicable.]
It is hereby recognized that the Hoyt Library, the establishment and maintenance of which were provided for by an ordinance of the former Borough of Kingston, approved February 20, 1911, and an ordinance of the Consolidated Borough of Kingston, approved January 17, 1927, shall continue to be maintained in the Old Family Homestead Building of the late Frank W. Hoyt as a free, public, nonsectarian library for the use of the residents of the Municipality of Kingston and vicinity, and that the said building shall be used not only for the purpose of a free, nonsectarian public library, as aforesaid, but also for the purpose of reading and writing rooms for the residents of the Municipality of Kingston and vicinity.
A. 
The said Hoyt Library, having been established prior to the effective date of the Library Code of Pennsylvania, so continues to be under the exclusive control of the Board of Directors, to be composed of nine (9) members hereinafter specified.
B. 
Membership. The Mayor and the President of Council of the Municipality of Kingston, by virtue of their respective positions/offices, shall at all times be voting members of said Library Board. The remaining seven (7) members of the Board shall be appointed by nomination of the Mayor to the Town Council, who must approve by a majority vote the recommended appointment.

C. 
Term of office. The term of office shall be for a three-year period. All terms shall be overlapping terms with the intent to have three (3) three-year terms expiring each year. Also, it is intended that the terms all expire on December 31 in the last year of the term. In order to put in place the format with regard to both the overlapping of terms and the expiration of terms, all appointments occurring initially in the adoption of this chapter shall be adjusted to less than a three-year term, in order to establish the format of appointing three (3) Board members per year.

Vacancies. All vacancies that occur on the Board shall be filled by the individuals designated above, and said appointments shall be effective for the remaining or unexpired term of the Board member for whom the person is being designated to fill.
E. 
Compensation of Board Members. All Board members shall serve without compensation of any type.
The Board of Directors shall have control over the affairs of the Library. All moneys appropriated for the establishment and/or maintenance of the Library and all moneys, if any, received from other sources for its use shall be under the exclusive control and shall be disbursed under the direction of the Board of Library Directors. Such Board of Library Directors shall have the power to contract with the Board of Directors of another library to establish a cooperative plan for improving library services. The Board shall also have a duty to make a report, annually, to all municipalities providing funding to the Library, setting forth the moneys received by such Library from the municipality and the dispositions thereof, and the accounts of the Treasurer of said Board shall be audited as in the case of other municipal expenditures. Furthermore, the annual report shall contain an itemized statement of all receipts from whatever sources, and expenditures, and shall show the condition of the Library and any branches thereof, the number of volumes, maps, pamphlets and other materials, the number added by purchase, gift or otherwise, the number lost or withdrawn, the number of registered borrowers and readers and a statement of the circulation of material, with such other information and suggestions as may seem desirable. A copy of each report made to the Municipal Officer shall be sent to the State Library in Harrisburg.
The Board of Library Directors shall organize as soon as may be convenient and after appointment by electing a President, Secretary and Treasurer from its membership, and such other officers and agents as the Board may deem necessary. The Treasurer shall give bond to the municipality with satisfactory surety in such amount as the municipality requires.
The municipality shall continue to make appropriations for the purpose of maintenance of said Library, and such amount or amounts as shall be annually appropriated in the budget of the Municipality of Kingston. Such appropriations may be out of the current revenue of the municipality or out of moneys raised by the levy of special taxes to establish and/or maintain a library.
A. 
The Board of Directors shall prepare and present to the Mayor and Town Council, by December 1 of each year, a budget for the following year.
B. 
The Board of Directors shall give free library service to the residents and taxpayers as provided for in Section 415 of the Library Code enacted 1961, June 14th, P.L.324, Article I, Section 101.
