It is unlawful for any person to operate or use a bicycle propelled
wholly or in part by human power upon any of the streets or alleys of the
Village without a license therefor. The Chief of Police shall issue, upon
written application therefor, bicycle licenses, which shall be effective for
four calendar years. Such license, when issued, shall entitle the licensee
to operate such bicycle for which the license has been issued upon the streets
and alleys, exclusive of sidewalks, in the Village.
The Chief of Police shall issue with each license a reflective decal
for the bicycle so licensed. The license and decal shall have corresponding
numbers thereon in numerical order, beginning with the number one, and shall
show thereon the year for which the same were issued. A register shall be
kept by the Chief of Police showing the date of the issuance of license cards
and decals, to whom issued, and the numbers thereof and such other information
as may be required by the Chief of Police. Decals shall be suitable for attachment
upon bicycles, and it shall be the duty of the licensee to keep such decal
attached to the bicycle so licensed.

All persons engaged in the business of buying secondhand
bicycles shall maintain a record for one year showing the name and address
of the person from whom each bicycle is purchased, the frame number thereof
and the number of the decal found thereon, if any.
B.Â
It is unlawful for any person engaged in the business
of buying secondhand bicycles to purchase any such secondhand bicycle from
a minor under 17 years of age.
C.Â
All persons engaged in the business of selling new or
secondhand bicycles shall maintain a record for one year showing a list of
all sales made by such dealers, which list shall include the name and address
of the person to whom sold, the kind of bicycle sold, together with the description
and frame number thereof and the number of the decal attached thereto, if
any.
D.Â
The lists required above shall be available for inspection
during regular working hours, at the dealer's place of business, to members
of the Police Department.
It shall be the duty of every person who sells or transfers ownership
of any bicycle to report such sale or transfer by returning to the Police
Department the license issued to such person as licensee thereof, together
with the name and address of the person to whom the bicycle was sold or transferred.
Such report shall be made within seven days of the date of said sale or transfer.
It shall be the duty of the purchaser or transferee of such bicycle to apply
for a transfer of the license thereof within seven days of the sale or transfer.
It is unlawful for any person to willfully or maliciously remove, destroy,
mutilate or alter the number of any bicycle frame licensed pursuant to this
article. It is unlawful for any person to remove, destroy, mutilate or alter
any license plate, license or card during the time in which such license plate
or card during the time in which such license plate or card is operative.
The Police Department may stamp numbers on the frames of bicycles on which
no serial numbers can be found or on which the numbers are illegible or insufficient
for identification purposes.

The fees shall be set by resolution of the Village Board and may be
changed from time to time in the same manner.
Any person violating any provision of this article shall be punishable
by a fine of not more $10.

The Village Board of the Village of LeRoy has received information regarding
bicyclers, skateboarders, roller skaters and in-line skaters especially on
Main Street in the Village, riding bicycles or skateboards or skating on sidewalks
in ways that endanger pedestrians on sidewalks, and endangering themselves
when riding or skating in the traffic lanes. Such activities can also be dangerous
when engaged in other areas of the Village as well. Thus said Board finds
it advisable and necessary to regulate the use of bicycles, skateboards, roller
skates and in-line skates in and around the streets and sidewalks of the Village
in order to protect the health and safety of the operators of such devices,
as well as the general public. This article shall apply within the Village
of LeRoy whenever bicycles, skateboards, roller skates or in-line skates are
operated upon any public street or highway, and private road open to public
motor vehicle traffic, or any public sidewalks or private sidewalk open to
public pedestrian traffic.
As used in this article, the following terms shall have the meaning
indicated:
A manufactured or assembled device consisting of an upper portion
that is intended to be secured to a human foot, with a frame or chassis attached
along the length of the bottom of such upper portion, with such frame or chassis
holding two or more wheels that are longitudinally aligned, and used to skate
or glide, by means of human foot and leg power, while having such device attached
to each such foot or leg.
Any shirt, vest, jacket or any other readily visible piece of apparel
equipped with a reflective surface such as phosphorescent tape or an equivalent
reflective surface.
Its ordinary dictionary definition.
Any platform of wood, plastic, fiberglass or similar material with
roller skates or other types of attached wheels and used for humans to ride
upon by gliding or moving by foot propulsion on hard surfaces.

Every person operating a bicycle, skateboard, roller
skates or in-line skates upon a public highway, road or street dedicated or
otherwise, within the Village of LeRoy shall be subject to the provisions
of this article as well as all other ordinances and local laws of the Village
of LeRoy and Article 34 of the Vehicle and Traffic Law of the State of New
York.
B.Â
Operation upon sidewalks and roadway.
(1)Â
No operator of a skateboard or roller skates shall operate
such devices upon a sidewalk or roadway within the central business district
within the Village of LeRoy which is defined as the area of the Village zoned
as the Central Commercial C-2 District by the Village of LeRoy Zoning Law.[1] No operator of a bicycle or in-line skates shall operate such
devices upon a sidewalk within said central business district.

Whenever any person shall operate a bicycle, skateboard,
roller skates or in-line skates upon a sidewalk or roadway everywhere within
the Village, such person shall yield the right-of-way to a pedestrian and
shall give an audible signal before overtaking and passing such a pedestrian.
No operator of a bicycle, skateboard, roller skates or in-line skates
shall operate such devices within the Village of LeRoy at night unless he
or she is wearing reflective clothing, which shall be visible from a distance
of not less than 50 feet and a maximum of 300 feet from the front, side and
rear of the bicycle, skateboard, roller skates or in-line skates when directly
in front of the lawful beams of headlights on a motor vehicle.
The operator of a bicycle, skateboard, roller skates or in-line skates,
emerging from an alley, driveway or building, shall, upon approaching a sidewalk,
yield the right-of-way to all pedestrians approaching said sidewalk.
No person shall stand, park or otherwise place in a position of temporary
storage a skateboard upon a highway, street, sidewalk or against any building
abutting a sidewalk in such a manner that shall obstruct or render injury
to a pedestrian or interfere with vehicular traffic.
No operator of a bicycle, skateboard, roller skates or in-line skate
shall attach the same or himself to any vehicle being operated.
The parent or a minor child or the guardian of a minor child shall not
authorize or knowingly permit any such child to violate any provisions of
this article.
Any police officer or peace officer who shall observe any person operating
a bicycle, skateboard, roller skates or in-line skates in violation of this
article shall take possession of the bicycle, skateboard, roller skates or
in-line skates and issue a dated, written notice of such violation to the
person, if over 16 years of age, and to the person and his or her parent or
guardian, if under 16 years of age, together with a copy of this article.
In case of the first offense, the bicycle, skateboard, roller skates or in-line
skates will be returned to the person at the police station upon the appearance
of the person if the person is 16 years of age or older, of the appearance
of the person accompanied by his or her parent or guardian if the person is
under 16 years of age. In the case of the second offense, upon the expiration
of 15 days of the date of violation, the bicycle, skateboard, roller skates
or in-line skates will be returned to the person at the police station upon
the appearance of the person, if the person is 16 years of age or older, or
the appearance of the person accompanied by his or her parent or guardian
if the person is under 16 years of age. In the case of the third violation,
upon the expiration of 60 days from the date of the offense, the bicycle,
skateboard, roller skates or in-line skates shall be returned to the person
at the police station upon the appearance of the person, if the person is
16 years of age or older, or the appearance of the person accompanied by his
or her parent or guardian if the person is under 16 years of age. In the case
of any further violations by the same person, upon the expiration of one year
from the date of the violation, the bicycle, skateboard, roller skates or
in-line skates will be returned to the person at the police station upon the
appearance of the person, if the person is 16 years of age or older, or the
appearance thereof of the person accompanied by his or her parent or guardian
if the person is under 16 years of age.
If, as a result of a violation of this article, any police officer or
peace officer impounds a bicycle, skateboard, roller skates or in-line skates,
which bicycle, skateboard, roller skates or in-line skates are not claimed
at the police station after the expiration of 1Â 1/2 years after the date
of the violation, the police may dispose of the bicycle, skateboard, roller
skates or in-line skates in accordance with the provisions for disposing of
property under the New York State Personal Property Law as lost and found
property.
