Where, owing to special conditions, a literal
enforcement of the provisions of these regulations will result in
unreasonable hardship, the Carroll Township Board of Supervisors,
after review by the Planning Commission, may make such reasonable
alterations thereto as will not be contrary to the public interest
and so that the spirit of these regulations shall be observed and
substantial justice done.
Applications for any alteration of requirements
shall be submitted to the Planning Commission in writing by the applicant
at the time the application for development is filed with the Planning
Commission. The application shall state fully the grounds and all
facts relied upon by the applicant.
Applications for any alteration shall be reviewed
by the Planning Commission. After review, the Planning Commission
shall submit its recommendations to the Board of Supervisors in writing
along with the reasons for such recommendation.
A.
Whenever a request for the alteration of a requirement
is approved, the Board of Supervisors shall record its action and
the grounds for such approval in its minutes. The Board of Supervisors
shall transmit a copy of the action and the grounds for such approval
of any alteration to the applicant applying for the alteration.
B.
Whenever a request for the alteration of a requirement
is denied, the Board of Supervisors shall record its action and the
grounds for such denial in its minutes. The Board of Supervisors shall
transmit a copy of the action and the grounds for such denial of any
