As used in this chapter, except as the context may otherwise require, the following terms shall have the meanings indicated:
ADMINISTRATOR
The Business Administrator appointed pursuant to the Charter and this chapter, or any assistant or acting administrator serving in place of the Business Administrator pursuant to the Charter or chapter.
CHARTER
Mayor-Council Plan E of Chapter 210 of the Laws of New Jersey 1950, N.J.S.A. 40:69A-1 et seq., as amended and supplemented, and any and all statutory provisions of the State of New Jersey applicable to the municipality.
DEPARTMENT
An organizational unit of the municipal government established or designated by this Charter as a department and any agency or instrumentality of the government not allocated or assigned to such an organizational unit.
DIRECTOR
The administrative head of a department.
MUNICIPALITY
The Township of Marlboro, in the County of Monmouth, State of New Jersey.
TERM OF OFFICE
Shall commence at 12:01 p.m. on January 1 unless otherwise stated in the general law or this chapter.
All ordinances, including amendments and supplements thereto, of the Township of Marlboro heretofore in existence as of January 1, 1972, except such as may be inconsistent with any and all provisions of the Optional Municipal Charters Law, including amendments thereto, are hereby continued as the controlling local law of the Township.
Whenever under the Administrative Code or any other ordinance of the Township, or any rule, regulation or order, duly promulgated by any officer or agency of the Township by authority of law, any act or forbearance is prohibited or declared to be unlawful or an offense or the doing of any act is required, and no specific penalty is provided with respect thereto, the violation of any such provisions of the ordinance, rule, regulation or order shall be punishable by one or more of the following: imprisonment in the county jail or in any place provided by the Township for the detention of prisoners for any term not exceeding 90 days or by a fine not exceeding $2,000 or a period of community service not to exceed 90 days. In case of a continuing violation, each day of the violation shall constitute a separate offense. In the case of a fine imposed upon a corporation, the fine and costs may be collected in a civil action in such manner as may be prescribed by law.
