A.
There shall be a Department of Administration, the
head of which shall be the Business Administrator.
B.
No Business Administrator shall be qualified for the
office unless that person possesses a bachelor's degree from an accredited
college or university. An applicant who does not meet this educational
requirement may substitute two years of paid, full-time municipal,
county or state management experience in a governmental unit for every
one year of college that he or she is lacking. In addition, no Business
Administrator shall qualify unless that person has at least one of
the following:
C.
There shall be appointed by the Mayor an Assistant
Business Administrator. The duties of said person shall include all
jobs and responsibilities assigned by the Business Administrator,
including the responsibilities for special projects as defined and
assigned by the Business Administrator.
A.
There shall be within the Department of Administration
a Division of Administration, the head of which shall be the Business
Administrator.
B.
Powers and duties. Under the direction and supervision
of the Mayor, the Administrator:
(1)
Shall assist in the preparation of the budget.
(2)
Shall administer a centralized purchasing system.
(3)
Shall be responsible for the development and administration
of a sound personnel system.
(4)
Shall serve as chief of staff to the Mayor.
(5)
Shall prescribe and enforce rules and regulations
for the efficient management of the municipal government not inconsistent
with the Charter and this chapter.
(6)
Shall coordinate the operation and administration
of the various departments, divisions, offices and agencies of the
municipal government.
(7)
Shall maintain continuing review and analysis of budget
operations, work programs and costs of municipal services.
(8)
Shall perform such other duties as this chapter may
require or as the Council may otherwise prescribe.
(9)
Shall assign and transfer employees temporarily from
one department to another as efficient administration may require.
C.
Preparation of budget document.
(1)
Form of document.
(a)
The budget document shall be in such form as
is required by law for municipal budgets, and there shall in addition
be appended thereto a detailed analysis of the various items of expenditure
and revenue. Such analysis shall include, for each department, division
and agency, the total number of positions of each class and grade
authorized by the budget compared with the corresponding number actually
employed at the beginning and end of the preceding budget period.
So far as practicable, the detailed analysis shall support the various
expenditure estimates in terms of the cost of performance of functional
programs and activities, stating separately operating and capital
costs.
(b)
As soon as the Business Administrator determines
that such supporting analysis is practicable with respect to the work
of any department or any functional program or activity, the budget
document shall include appropriate statements of the cost of performance,
measured as the quantitative, countable units of work.
(2)
Budget operation. The Business Administrator shall
supervise the administration of each annual budget. Immediately after
the budget has been enacted and after consultation with the heads
of the departments, he shall establish quarterly, or such other period,
allotments of appropriations to each department. At the beginning
of each allotment period, the amount specified shall become available
to each department for obligation during that period. Such allotments
for any department may be modified, upon request of the head of the
department, by the Business Administrator or by direction of the Mayor.
(3)
The Business Administrator shall file with the appropriate
official a copy of each allotment and modification thereof. An encumbrance
of budget appropriations and such allotments shall be maintained by
the Department of Finance.

A.
There shall be within the Department of Administration a division
of Central Purchasing, the head of which shall be the Business Administrator.
B.
Powers and duties. As the head of the Division of Central Purchasing,
the Business Administrator shall:
(1)
Purchase, store and distribute all supplies, materials and equipment,
and contract for all services required by any department, office or
agency of the Township government, and contracts awarded for any supplies,
materials or equipment or contractual services shall be pursuant to
a written requisition from the head of the department, office or agency
whose appropriation will be charged and the certification that a sufficient
unencumbered balance of appropriation is available to pay therefor.
All such contracts shall conform to the provisions relating to Township
contracts generally as set forth.
(2)
Establish and enforce specifications with respect to such services,
supplies, materials and equipment.
(3)
Supervise the inspection of all deliveries of supplies, materials
and equipment and the rendition of contractual services and determine
their quality, quantity and conformance with specifications.
(4)
Have charge of any and all central storerooms and warehouses which
may be established.
(5)
Transfer to or between departments, offices and agencies, and from or to central stores, such supplies, materials and equipment as need appears and arrange for the sale of surplus or obsolete items therefor, subject to the provisions of Subsection B(6).
(6)
Attend to and conduct through his office the sale at auction of the
following items of personal property as herein provided:
(a)
Upon the direction of the Police Department, such goods, chattels,
automobiles or other property coming into the possession of the Police
Department under and by virtue of the provisions of N.J.S.A. 40A:14-157.
(b)
Such goods, chattels and other property coming into the possession
of the Municipal Clerk from any institution, department or agency
of the Township.
(c)
Abandoned automobiles.

The Purchasing Agent shall process the sale of abandoned automobiles,
through the State Division of Motor Vehicles, Form C 087 AVJ, request
for motor vehicles, junk title certificate and shall comply with all
applicable requirements of N.J.S.A. 39:10A-1. Such forms shall be
furnished by the Police Department.

The cost of the aforesaid certificate shall be added to the
auction price bid.

The purchaser at said sale shall remove all license plates from
the automobile and deliver same to the Purchasing Agent, who, in turn,
shall forward said plates to the State Division of Motor Vehicles.

It is hereby made a condition of redemption by the owner that
he obtain and deliver to the Purchasing Agent a certification by the
Violations Clerk of the Municipal Court that there are no outstanding
traffic violations involving said automobile.
[5]
The cost of the motor vehicle junk title certificate shall be
added to the charges to be paid by the owner upon redemption before
sale.
[6]
All moneys shall be paid to and received by the Division of
Central Purchasing and shall be deposited with the Township.
C.
Purchasing Agent.
(1)
There is hereby created the position of Purchasing Agent for the
Township of Marlboro.
(2)
The Purchasing Agent shall be appointed by the Mayor.
(3)
The Purchasing Agent is required to possess a valid Qualified Purchasing
Agent certificate, as issued by the New Jersey Division of Local Government
Services, Department of Community Affairs.
(4)
The Purchasing Agent shall have, on behalf of the Township Council
of the Township of Marlboro, the authority, responsibility and accountability
for the purchasing activity pursuant to Local Public Contracts Law
(N.J.S.A. 40A:11-1 et seq.); to prepare public advertising for and
to receive bids and requests for proposals for the provision or performance
of goods, services and construction contracts; to award contracts
pursuant to New Jersey law in accordance with the regulations, forms
and procedures promulgated by state regulatory agencies; and conduct
any activities as may be necessary or appropriate to the purchasing
function of the Township of Marlboro. The bid threshold shall be that
amount established in accordance with to N.J.S.A 40A:11-3(c).
(5)
The Business Administrator, is authorized to award a contract, without
competitive bidding on behalf of the Township for performance of any
work, or the furnishing of any services, materials or supplies when
the cost or price of such contract does not exceed, in the contract
year, the bid threshold established by pursuant to N.J.S.A 40A:11-3(c).
The Business Administrator, or his/her designee, shall prepare requests
for resolution for purchases or commodities or services over the bid
threshold following the procurement guidelines established by statute.
The Division of Licensing shall:

Issue licenses and permits in accordance with the
ordinances of the Township, with the exception of:
(2)
Licenses and permits issued by the Building Inspector pursuant to Chapter 125, Construction Codes, Uniform.
(4)
Permits and licenses issued by the Division of Health
pursuant to general law or Township ordinances.
(5)
Such other licenses and permits which by statute are
required to be issued by a specific Township official.
B.
Perform such other functions, powers and duties as
may be prescribed by law or ordinances.
A.
There shall be within the Department of Administration
a Division of Drug Abuse and Control, the head of which shall be the
Business Administrator.
B.
The Business Administrator shall be advised by a Drug
Abuse and Control Committee consisting of nine members to be appointed
by the Mayor, one of which may be a member of the Police Department
of the Township, such appointments to be for staggered terms of three
years. The Mayor shall designate one member to serve as Chairman for
each calendar year, and the Chairman shall be the head of the Committee
of Drug Abuse and Control. The Drug Abuse and Control Committee shall
have the following duties and responsibilities:
(1)
To study and make recommendations to the Mayor and
Township Council concerning the problem of drugs and drug traffic
within the Township.
(2)
To study and make recommendations to the Mayor and
Township Council concerning matters of policy affecting the control
of drugs and drug traffic within the Township.
(3)
To provide or arrange for shelter and custodial care
of victims of drug abuse and drug traffic.
(4)
To provide or arrange for the necessary social services
for the victims and their families of drugs and drug traffic.
(5)
To cooperate with other public agencies and institutions
to aid victims of drug abuse and drug traffic.
(6)
To initiate special cooperative programs with the
Freehold Regional Board of Education and with other appropriate regional
drug control agencies.
A.
There shall be within the Department of Administration
a Division of Public Information, the head of which shall be the Township
Administrator.
B.
The Division of Public Information will perform a
variety of tasks involved in the collection, preparation and dissemination
of information pertaining to the goals, programs and achievements
of the administration and Council.
