This chapter is adopted for the purpose of protecting,
preserving and assuring the health, welfare, safety and morals of
the residents and inhabitants of the Town of Stanford and sojourners
therein, as well as preventing riots, disorderly crowds and/or assemblies
therein, unsafe, unsanitary or other conditions leading to creating,
causing, inciting or making possible a threat to the health, welfare
and safety of the Town, its orderly administration and control by
duly elected, acting or authorized officers, agents and/or employees
and the prevention of the spread of disease and the creation of unhealthy
conditions, the violation of sanitary requirements, the elimination
of excessive crowds, traffic congestion and/or other such hazards
to the public safety and welfare and the preservation of the peace
in said Town, its residents, inhabitants, property owners, both public
and private and sojourners therein, together with the protection of
public property in said Town and the general health, welfare, safety
and morals of the towns surrounding, adjacent or near to the Town
of Stanford, in the County of Dutchess and the state, county and Town
roads and/or highways leading thereto and therefrom.
No public or private assembly, group, gathering,
crowd or congregation of people within the confines of the Town of
Stanford shall be permitted or allowed in excess of 3,000 in number
upon any property, land or parcel of land, whether improved or not
and whether contiguous or not, without a permit therefor being obtained
as hereinafter provided.
A.Â
Application for permit. The application for a permit
shall be in writing and signed by the applicant and shall be accompanied
by a fee of $100. It shall state:
(1)Â
The name and address of the applicant.
(2)Â
The name and address of each partner if the applicant
is a partnership.
(3)Â
The name and address of each officer and director
if the applicant is a corporation.
(4)Â
A complete description of the premises upon which
the public or private assembly, group, gathering, crowd or congregation
is to be located, and the proposed date or dates same is to be held,
including site plan for the utilization of such premises, showing
parking areas, sanitary facilities, curb cuts, manner and means of
shelter, supervision and for granting food and water supply, medical
facilities and facilities for the prevention of fire and, in addition
thereto, such other requirements as are deemed necessary by the below-mentioned
agencies, whose approval must be secured before the application is
submitted to the Town Clerk of the Town of Stanford: the Planning
Board of the Town of Stanford, the Dutchess County Board of Health,
the office of the Sheriff of the County of Dutchess and the Fire District
within which the subject premises are located. Approval by such agencies
shall be indicated by endorsement on said application.

The name and address of the owner or owners of such
premises.
B.Â
The application, after having been approved by said
agencies, shall be filed with the Town Clerk at least 10 days prior
to the next regular meeting of the Town Board. The applicant and all
other parties interested shall appear at said Town Board meeting.
All such applications shall, after investigation and after a public
hearing, be approved or rejected by the Town Board after which the
application shall be filed with the Town Clerk and the applicant notified
in writing by the Town Clerk of the action taken thereon.

The Town Clerk of the Town of Stanford, only upon
approval of such application by the Town Board, shall issue a permit.
D.Â
No such permit shall be secured, granted or given
unless:
(1)Â
The applicant or applicants, or if a corporation,
all the officers thereof, shall have made, executed, acknowledged
and delivered to said Town Clerk a surety bond in form and content
satisfactory to the Town Attorney of the Town of Stanford, the same
to be a surety bond in the penal sum of not less than $50,000 to assure
complete compliance with this chapter and with any and all terms and
conditions imposed by any of the aforesaid agencies whose approval
must first be secured. Said surety bond shall be signed by the applicant
or applicants as principals and signed by a commercial surety company
satisfactory to said Town Attorney as surety.
(2)Â
There shall be delivered to said Town Clerk a liability
insurance policy naming said Town as an insured in the amounts of
$500,000/$1,000,000 and covering the assembly as set forth in the
application. Said policy shall be in form and content and written
by a company all satisfactory to said Town Attorney.
Any person, firm, partnership, association or
corporation who shall violate any of the provisions of this chapter
shall be guilty of a misdemeanor and, upon conviction thereof, shall
be punishable by a fine of not more than $1,000 for each violation
or by imprisonment in the county jail for not more than one year,
or by both fine and imprisonment.
