No dog, cat or other domesticated animal or any nondomesticated animal shall be suffered or permitted to run at large in this Borough either upon the public streets or highways or upon property other than that of the owner of such dog, cat or other animal.
No person shall allow any dog, cat or other domesticated animal or any nondomesticated animal confined on that person's premises to make any loud or harsh noise or disturbance which interferes with or deprives the peace, quiet, rest or sleep of any person within the Borough.

No person shall allow any dog, cat or other domesticated animal or any nondomesticated animal owned by such person or under such person's control to defecate, defile, befoul, corrupt or otherwise desecrate any sidewalk, walkway, public property or the property of another or destroy or damage the property of another; provided, however, that in the event any animal shall defecate or otherwise leave animal waste upon any such area designated above, it shall not be a nuisance if the person in charge of said animal shall immediately remove all animal waste deposited by the animal by any sanitary method and the animal waste deposited in the owner's own garbage or disposed of in some other sanitary method. The waste deposit shall be properly wrapped, packaged and protected so as to prevent unsightly disposal, smell or interference with the health and welfare of the residents of the Borough of Honesdale.

No person shall walk, transport or maintain outside that person's own private property any dog, cat or other domesticated animal or any nondomesticated animal owned by such person or under such person's control unless that person shall at all times have upon his or her person the necessary utensils to immediately remove all feces or other animal waste which is or may be deposited by said animal while said animal is outside the private property of that person. For purposes of this section, "utensil" shall mean, by way of illustration and not by means of limitation, pooper-scooper, pet shovel, pet bucket and/or any other similar devices to immediately remove any animal feces or waste which may be deposited by said animal while said animal is upon any public property whatsoever within the Borough of Honesdale or on any private property within the Borough of Honesdale without the permission of the owner of said property.

Any person who shall violate any of the provisions of this article shall, upon conviction thereof, be sentenced to pay a fine of not less than $100 and no more than $600 and all costs of prosecution for each and every offense and, in the default of payment of such fine and costs, to imprisonment for not more than 30 days. Each day's violation of any of the provisions of this article shall constitute a separate offense.
