It shall be the responsibility of each owner who builds a new residential structure or who renovates an existing residential structure to 50% or more of its value at the time a building permit application is filed to install smoke detectors in such residential structure as hereinafter provided. Said smoke detectors shall be capable of sensing visible and invisible particles of combustion and providing suitable audible alarm thereof and shall be installed in the manner hereinafter provided.
A. 
At least one smoke detector shall be installed at the top of each stairway leading to a sleeping area or, if no stairway leads to a sleeping area, in the hallway leading to the sleeping area, in such a manner as to assure that rising smoke is not obstructed in reaching the detector and the detector intercepts rising smoke before it reaches the sleeping area. A "sleeping area" is defined as the area or areas of the family living unit in which the bedroom or sleeping rooms are located. Where bedrooms or rooms ordinarily used for sleeping are separated by other use areas (such as kitchens or living rooms, but not bathrooms or closets), they shall be considered as separate sleeping areas for the purpose of this section.
B. 
At least one smoke detector shall be installed in each kitchen area.
As an alternative to self-contained smoke detectors, an approved fire detection system may be installed. Each fire detection system must be individually approved and a permit issued therefor by the Department of Fire and Rescue Services.
All devices, combinations of devices and equipment required herein are to be installed in conformance with the Building Code[1] and this section and approved by the Milton Borough Fire Chief. Such approval shall be permanent unless the Chief subsequently finds that the equipment is hazardous or unreliable, in which case the Chief may suspend or revoke approval. The Chief may in any such case determine whether replacement of existing installation shall be required.

In new residential dwellings, smoke detectors shall be powered by self-monitored batteries or wired directly (hard-wired) to the building's power supply. In existing dwellings, it is preferred that smoke detectors be wired directly to the power supply; however, said detectors may be powered by self-monitored batteries or operated in a plug-in outlet which is fitted with a plug restrainer device, provided that the outlet is not controlled by any switch other than the main power supply.
All applications for building permits under this chapter shall contain a drawing showing the proposed locations of smoke detectors as required by this article in buildings to be constructed or renovated.

A. 
Any person, partnership or corporation who or which shall violate any provision of this article shall, upon conviction thereof in a summary proceeding, be sentenced to pay a fine of not more than $1,000, plus costs of prosecution, and, in default of payment of such fine and costs, which persons, the members of such partnership or the officers of such corporation shall be subject to imprisonment for a period not in excess of 30 days. Each day that a violation continues shall constitute a separate offense. All fines collected for violation of this chapter shall be paid over to the Borough of Milton.
B. 
In addition to the remedies and penalties provided in this chapter, the Borough of Milton may institute any appropriate action in law or in equity to prevent, restrain, correct or abate any action, conduct or condition which constitutes a violation of this article.
