[HISTORY: Derived from Ch. XV of the 1964 Code of Ordinances of the City of of Monessen. Amendments noted where applicable.]
It shall be unlawful for any milk dealer engaged in bottling milk for sale in the City of Monessen to sell or deliver any milk in the City of Monessen without first obtaining from the Health Officer of the city a certificate that the fee for inspecting and testing such milk has been paid for the current year.

Editor's Note: See also 31 P.S. § 520-1 et seq., specifically 31 P.S. § 660b, which provides that statutory provisions are established to provide uniform requirements and that no municipality shall adopt requirements other than those, although it appears from the Notes of Decision that local governing bodies are not prohibited from promulgating regulations which are at least as restrictive as state regulations.
The cost or fee for such inspection is hereby fixed for each calendar year for every farmer and for each calendar year for each milk processor or distributor as set from time to time by resolution of the City Council.
Any person, firm or corporation selling or delivering milk in the City of Monessen in violation of this chapter shall, upon conviction thereof in a summary proceeding before any District Justice having jurisdiction of such offense, be sentenced to pay a fine of not more than $300 or to undergo imprisonment not exceeding 90 days, or both. Each day on which any such violation shall be committed or shall continue shall constitute a separate offense or violation.
