§ 329-1 Word and phrase usage.

Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle I of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

§ 329-2 Official time standard.

Whenever certain hours are named in this chapter, they shall mean either Eastern standard time or Eastern daylight saving time as may be in current use in the Township.

§ 329-3 Parking regulations not exclusive.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.

§ 329-4 Parking prohibited during state of emergency.

A. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary "EMERGENCY NO PARKING" signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of "EMERGENCY NO PARKING" signs when weather conditions, accidents, fire, public celebrations, etc., dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that "EMERGENCY NO PARKING" signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
B. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and menace to the safe and proper regulations of traffic, and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
C. 
The effectiveness of this section is contingent upon the signs being erected as required by law.

§ 329-5 Parking prohibited at all times on certain streets.

No person shall park a vehicle at any time upon any of the streets or parts thereof described.

§ 329-6 Parking prohibited during certain hours on certain streets.

No person shall park a vehicle between the hours specified upon any of the following described streets or parts of streets from November 15 to April 15.

§ 329-8 Parking time limited on certain streets.

No person shall park a vehicle for longer than the time limit shown at any time between the hours listed of any day (except Sundays and public holidays) upon any of the following described streets or parts of streets.[1]

§ 329-9 Handicapped parking.

A. 
Handicapped person parking established. In accordance with the power conferred upon municipal governing bodies under N.J.S.A. 39:4-138, 39:4-197 and 39:4-198, the Township Committee of the Township of Mansfield may by resolution, to be adopted from time to time as the need arises, establish and fix the location of restricted parking spaces for use by handicapped persons in front of schools, hospitals and other public buildings and in shopping and business districts.
B. 
Regulation. Each resolution that may be adopted from time to time by the Township Committee establishing restricted parking, as provided for in this section, shall specify the location, number, width, length and markings of the restricted parking spaces so established. Three certified copies of each resolution, as may be adopted, together with three copies of any and all maps or exhibits expressly incorporated by reference into the resolution shall be placed and kept on file in the office of the Township Clerk, and a copy thereof shall be made available to any person desiring to examine and review the same.
C. 
Procedures on development applications to Planning Board. Whenever the Township Planning Board requires the placement of handicapped parking spaces for an application for development within their jurisdiction, such approval shall be conditioned upon the adoption of a favorable resolution of the Township Committee and the placement and erection of appropriate signs pursuant to N.J.S.A. 39:4-198 by the developer at developer's expense. Developer shall submit a proposed form of resolution consistent with Subsection B above together with a resolution of approval by the Planning Board, as the case may be, maps identifying the location, number, width, length and markings of handicapped parking spaces so established to the Municipal Attorney at least 10 days prior to a regular public meeting of the Township Committee at which action is desired to be taken.
D. 
Identification required. No person shall park a motor vehicle in a restricted parking space reserved for use by handicapped persons unless such person has been issued a special vehicle identification card pursuant to the provisions of Section 2 of P.L. 1949, c. 280 (N.J.S.A. 39:4-205) and Section 1 of P.L. 1977, c. 202 (N.J.S.A. 39:4-197.5) and unless there is properly displayed upon such parked vehicle a certificate for which a special identification card has been issued pursuant to N.J.S.A. 39:4-206.
E. 
Penalty. Any person parking a motor vehicle in a restricted parking space without a special vehicle identification card shall be liable to a fine of $250 for the first offense and, for subsequent offenses, a fine of at least $250 and up to 90 days' community service on such terms and in such form as the court shall deem appropriate, or any combination thereof.

§ 329-23 Fire lanes. [1]

No person shall park, stop or permit to stand any vehicle, in whole or in part, within any fire lane established in accordance with any statute, ordinance or regulation.

§ 329-24 Violations and penalties.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this chapter, or any supplement thereto, shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days, or both.
