[Adopted by Ord. No. 2-77 (§ 8-1 of the 1975 General Ordinances); as amended through Ord. No. 8-88]
There is hereby established in the Township a State Uniform Construction Code enforcing agency to be known as the "Building Department," consisting of a Construction Official, Building Subcode Official, fire protection and such other subcode officials for such additional subcodes as the Commissioner of the Department of Community Affairs, State of New Jersey, shall hereafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the enforcing agency.
Each official position created in § 158-1 hereof shall be filled by a person qualified for such position pursuant to N.J.S.A. 52:27D-119 et seq., as amended, and N.J.A.C. 5:23; provided that, in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one official position may be held by the same person; provided that such person is qualified pursuant to N.J.S.A. 52:27D-119 et seq., and N.J.A.C. 5:23 to hold each such position. Appointments of the officials, unless otherwise provided by law or other sections of this revision, shall be made by the Township Committee.
The public shall have the right to do business with the enforcing agency at the municipal building, except for emergencies and unforeseen or unavoidable circumstances.
Appeals from the decisions by the enforcing agency shall be made to the Warren County Board of Appeals pursuant to Article 15 of the New Jersey Uniform Construction Code Regulations.
A. 
General.
(1) 
The fee for plan review, computed as a percentage of the fee for a construction permit, shall be paid at the time of application for a permit. The amount of this fee shall then be deducted from the amount of the fee due for a construction permit when the permit is issued. Plan review fees are not refundable.
(2) 
The fee to be charged for a construction permit will be the sum of the basic construction fee plus all applicable special fees, such as elevator or sign fees. This fee shall be paid before a permit is issued.
(3) 
The fee to be charged for a certificate of occupancy shall be paid before a certificate is issued. This fee shall be in addition to the construction permit fee.
(4) 
Basic construction fees shall be the sum of the parts computed on the basis of the volume or cost of construction, the mechanical systems and equipment, the number of plumbing fixtures and stacks, the number of electrical fixtures and devices and the number of sprinklers and standpipes at the unit rates provided herein, plus any special fees. In each case, the minimum fee for basic construction work shall be $25.
B. 
Plan review. The fee for plan review shall be 20% of the amount to be charged for a construction permit.

C. 
Building subcode fee. The building subcode fee shall be as follows:

(1) 
New construction. New construction permit fees shall be based upon the volume of the proposed structure, and the rate per cubic foot shall be determined by the proposed use pursuant to Section 302.0, Use Group Classification, of the International Building Code/2006, NJ Edition. Fees shall be as established in New Jersey Administrative Code 5:23-4.20(c)(2), as may be amended from time to time.
(2) 
Renovations; alterations; repairs. Permit fees for renovations, alterations and repairs shall be based upon the estimated cost of the work and be as established in New Jersey Administrative Code 5:23-4.20(c)(2), as may be amended from time to time.
(3) 
The minimum fee shall be $50.
(4) 
Permit fees for additions. Permit fees for additions shall be computed on the same basis as for new construction for the added portion.
(5) 
Combination renovations and additions. For combination renovations and additions, the fee shall be computed as the sum of the fees computed separately in accordance with Subsection C(2) and (4) above.
(6) 
Temporary structures (i.e., tents, construction trailers and similar structures): $25 each.
(7) 
Pools:
(a) 
Aboveground: $100.
(b) 
In-ground: $250.

D. 
Plumbing subcode fees. The plumbing subcode fee shall be as follows:

(1) 
A fee of $20 for each fixture or stack for all fixtures, except as listed in Subsection C(2) through (7). The minimum fee shall be $50. For the purposes of computing this fee, fixtures or stacks shall include, but not be limited to, lavatories, kitchen units, slop sinks, urinals, water closets, bathtubs, shower stalls, laundry tubs, floor drains, dishwashers, clothes washers, drinking fountain, roof drain.
(2) 
A fee of $50 for each sewer pump.
(3) 
A fee of $75 for each backflow preventer (lawn sprinkler), installation or demolition of liquid propane or oil tank, and commercial heating and equipment. A flat fee of $75 for fuel oil/gas piping (up to three fixtures).
(4) 
A fee of $80 for each water heater, water service, and sewer connection.
(5) 
A fee of $100 per special device for grease traps, interceptor/separators, water conditioners, hot water boilers, steam boilers or similar devices.
(6) 
A flat fee of $100 for cross-connections and backflow preventers subject to testing and requiring inspection.
(7) 
A fee of $300 for each water-cooled air-conditioning or refrigerant unit.
E. 
Electrical subcode fees. The electrical subcode fee shall be as follows:

There shall be a minimum fee of $50 in all of the above categories.
(3) 
Mechanical systems and equipment fees. The mechanical fee shall be 10% of the building subcode fee for new structures. For the installation or replacement of mechanical systems or equipment in existing structures, the fee shall be based on the cost of work, utilizing the same schedule as used for the building subcode. The minimum fee shall be $50.
F. 
Fire protection subcode fees.The fire-protection fee shall be 10% of the building subcode fee for new structures. For the installation or replacement of fire-protection systems or equipment in existing structures, the fee shall be based on the cost of work, utilizing the same method as used for the building subcode. The minimum fee shall be $50.

G. 
Demolition permit fee.

(1) 
The fee for a demolition permit shall be based upon the alleged use of the building or structure as heretofore existed, pursuant to Section 202.0, Use Group Classification of the International Building Code/2006, NJ Edition.
(2) 
The demolition permit fee for buildings or structures falling within the Use Group Classifications S or U shall be $100 for demolition of structures being undertaken at one time or one lot.
(3) 
The demolition permit fee for buildings or structures falling within all remaining use group classifications shall be $300 per building or structure.
(4) 
There shall be no fee for the demolition of buildings or structures which have been condemned and/or ordered to be demolished by the Township of Mansfield.
H. 
Removal of building fee. The fee for a permit for removal of one building from one lot to another or to another location on the same lot shall be $10 per $1,000 of the estimated cost of moving, plus the estimated cost of new foundations and all work necessary to place the building in its completed condition in the new location.

I. 
Sign construction fee. The fee for a permit to construct a sign shall be $2 per square foot surface area of the sign, computed on one side only for double-faced signs. The minimum fee shall be $50.

J. 
Certificate of occupancy fees.

(1) 
For a certificate of occupancy, the fee shall be 10% of the new construction permit fee. The minimum fee shall be $40.
(2) 
The fee for a continued certificate of occupancy for all use group classifications shall be in the amount of the $100 per building or structure.
(3) 
For a temporary certificate of occupancy, there shall be a fee of $100.
K. 
Mechanical systems and equipment.

L. 
Sprinklers and standpipes. The fee for sprinklers and standpipes shall be as follows:

N. 
Alternate plan review. The fee for plan review of a building for compliance under the alternate systems and nondepletable energy source provisions of the energy subcode is as follows:
(1) 
For one- and two-family homes and light commercial structures having the indoor temperature controlled from a single point: $100.
(2) 
For all other structures: $500.
O. 
Variance.
(1) 
The fee for an application for a variation, in accordance with N.J.A.C. 5:23-2.10, shall be as follows:
(a) 
For Class I structures: $250.
(b) 
For Class II and Class III structures: $50.
(2) 
For resubmission of an application for a variation:
(a) 
For Class I structures: $100.
(b) 
For Class II and Class III structures: $25.
P. 
Reinspection. Fees for the periodic agency reinspection of equipment and facilities granted a certificate of approval for a specified duration in accordance with N.J.A.C. 5:23-2.23 shall be as follows:
(1) 
For elevators, escalators and moving walks requiring reinspection every six months: $100.
(2) 
For each five-year inspection and witnessing of tests on elevators: $300.
(3) 
For dumbwaiters requiring reinspection every 12 months: $100.
(4) 
For hazardous uses and places of assembly requiring reinspection every three months:
(a) 
For occupancies of up to 12,000 square feet: $10.
(b) 
For each additional 10,000 square feet, or part: $5.
(5) 
For cross connections and backflow preventers that are subject to testing, requiring reinspection every three months:
(a) 
For each device when they are tested, thrice annually: $20.
(b) 
For each device when they are broken down and tested, once annually: $50.
(6) 
For sprinklers requiring reinspection every 12 months:
(a) 
For systems of up to 100 sprinkler heads: $100.
(b) 
For each 150 additional sprinkler heads, or part: $5.
Q. 
Annual permits.
(1) 
The fee to be charged for an annual construction permit shall be charged annually. This fee shall be a flat fee based upon the number of maintenance workers employed by the facility and who are primarily engaged in work that is governed by a subcode. Managers, engineers and clericals shall not be considered maintenance workers for the purpose of establishing the annual construction permit fee. Annual permits may be issued for building/fire protection, electrical and plumbing. Fees shall be as follows:
(a) 
One to 25 workers, including foreman, per worker: $250.
(b) 
Each additional worker over 25: $100.
(2) 
Prior to the issuance of the annual permit, a training registration fee of $100 per subcode shall be submitted by the applicant to the Department of Community Affairs, Bureau of Construction Code Enforcement, Training Section, along with a copy of the construction permit (Form F-170). Checks shall be made payable to "Treasurer, State of New Jersey."
R. 
Reinstatement of lapsed permit fee. The fee for the reinstatement/extension of a lapsed permit shall be $10 for each six-month lapsed period starting at the date the permit was issued.

S. 
Extra inspection fee. There shall be a charge of $15 for each extra inspection required due to the fault of the owner, builder or contractor, or their agents.

T. 
Surcharge fee. In order to provide for the training, certification and technical support programs required by the Uniform Construction Code Act[1] and the regulations promulgated pursuant thereto, the enforcing agency shall collect, in addition to the fees specified above, a surcharge fee of $0.0016 per cubic foot of volume of new construction and $80 per $1,000 of value for all other construction. Such surcharge fee shall be remitted to the Bureau of Housing Inspection, Department of Community Affairs, as provided for in the regulations. All fees may be rounded to the nearest dollar amount.

The Construction Official shall, with the advice of the subcode officials, prepare and submit to the Township Committee biannually, a report recommending a fee schedule based on the operating expenses of the agency, and any other expenses of the agency, and any other expenses of the Township fairly attributable to the enforcement of the State Uniform Construction Code Act.[1]

A. 
In order to provide for the training, certification and technical support programs required by the Uniform Construction Code Act and the regulations, the enforcing agency shall collect, in addition to the fees specified above, a surcharge fee computed in accordance with the New Jersey Administrative Code (N.J.A.C.) per cubic foot of volume of new construction. The surcharge fee shall be remitted to the Bureau of Housing Inspection, Department of Community Affairs, on a quarterly basis for the fiscal quarter ending September 30, December 30, March 31 and June 30, and not later than one month next succeeding the end of the quarter for which it is due.
B. 
The enforcing agency shall report annually at the end of each fiscal year to the Bureau of Housing Inspection, and not later than July 31, the total amount of the surcharge fee collected in the fiscal year.
Any and all ordinances or parts thereof inconsistent with the provisions of this section are hereby repealed to such extent as they are so in conflict or inconsistent; provided, however, that the adoption of this section shall not prevent or bar the continuance or institution of any proceedings for offenses heretofore committed in violation of any existing ordinance of the Township of Mansfield.

In the event such regulations now or hereafter adopted set mandatory standards, rules, fees or fees in excess of the fees set forth herein, or other matters that are inconsistent with the provisions of this article, then the provisions of this article shall be deemed amended to comply with the provisions of the regulations that are mandatory and that established fees in excess of those set forth herein.
