In case any building or structure is erected,
constructed, altered, repaired, converted, or maintained, or any building,
structure or land is used in violation of this chapter or of any ordinance
or other regulation made under authority conferred hereby, the proper
local authorities of the Township or an interested party, in addition
to other remedies, may institute any appropriate action or proceedings
to prevent such unlawful erection, construction, reconstruction, alteration,
repair, conversion, maintenance or use, to restrain, correct or abate
such violation, to prevent the occupancy of such building, structure
or land, or to prevent any illegal act, conduct, business or use in
or about such premises.
Except where otherwise specifically set forth, for each and every violation of any provision of this chapter, the owner, contractor or other persons interested as general agent, architect, building contractor, owner, tenant or any other persons who commit or take part or assist in any violation of these chapters, or who maintain any building or premises in which any violation of these chapters shall exist and who have failed or refused to abate such violation within a specified time period not more than 10 days after written notice has served upon him either by mail or by personal service shall upon conviction, for each and every violation shall be subject to penalties as set forth in § 1-17 herein. Each and every day that such violation continues after such notice shall be considered as separate and specific violation of this chapter.
In addition to the powers given to the Zoning
Officer as prescribed elsewhere by this chapter, the owner of, or
any person having interest in, any property in the Township may make
complaint for any violation of this chapter or any provisions or section
thereof, and upon conviction in such case, the penalties hereinbefore
provided shall be imposed.
In addition to the remedies herein provided,
any person violating this chapter or any provisions or section thereof
may be proceeded against by the Township of Mansfield, by the Zoning
Officer, or by the owner of any property in the Township, by appropriate
action or by proceeding in equity or otherwise to prevent and enjoin
any threatened violation of this chapter.

A.
Any person
or business entity that fails to comply with any condition incorporated
in a resolution memorializing the approval of a land subdivision,
site plan or variance application shall, upon conviction, be subject
to a fine of not less than $100 nor more than $1,000 per day, or community
service, or both, in the discretion of the court. Each and every day
such violation continues shall be considered a separate and distinct
violation. In addition to the foregoing, the Township shall be entitled
to apply to the Superior Court for an injunction to prohibit continuation
of the approved application for failure to comply with or adhere to
any of the conditions imposed in connection with any of the foregoing
approvals.
B.
The Zoning
Officer shall have the ability to enforce this section regarding the
violation of any zoning or planning approvals to issue violations
for the noncompliance therewith.
