To control the hours of business and operations and to protect the citizens of the Town, no persons shall keep open or suffer to be kept open any store, shop, restaurant or diner or other place of trade, entertainment or place of business under his control in this Town after 1:00 a.m., nor shall any persons open any such store, shop or other place specified in this section before 4:00 a.m. without first having obtained a license for permission to operate between the hours of 1:00 a.m. and 4:00 a.m.
A license to operate between the hours of 1:00 a.m. and 4:00 a.m. may be granted by the Town Council if, in its opinion, the health, safety and well-being of the residents of the Town would not be adversely affected. The Town Council shall consider the following in its determination to either grant or deny the application to operate between the hours of 1:00 a.m. and 4:00 a.m.:
A. 
The location of the premises.
B. 
The type of business.
C. 
The size of the property.
D. 
The proposed hours of operation.
E. 
The security available during the hours of operation.
F. 
Demonstrated need on part of applicant.
Nothing contained in this article shall be construed to prevent druggists from opening their shops at any time for the purpose of selling medicines for the use of the sick.
Violations of the provisions of this article shall be punishable as provided in Chapter 1, Article III, of the Code of the Town of East Greenwich.
