Pursuant to the First Class Township Code, a Parks and Recreation Board is hereby established for the Township of Lower Pottsgrove.
The Parks and Recreation Board shall consist of five members, who shall be appointed by the Board of Commissioners for terms of five years in such order that at least one, but no more than two, members' terms shall expire annually. The aforesaid appointments for a specific term notwithstanding, a Board member may stay in office until a successor is appointed by the Board of Commissioners, except that the members first appointed shall be appointed so that the terms of not more than two members expire annually. All persons appointed shall serve their full terms unless voluntarily resigned or removed by the Board of Commissioners for malfeasance or nonfeasance of duty. Parks and Recreation Board members shall hold no other elected or appointed office in the Township, nor be an employee of the Township.
Vacancies occurring other than by expiration of term shall be filled by appointment by the Board of Commissioners for the unexpired term and shall be filled in the same manner as original appointments.
The members of the Parks and Recreation Board shall serve without pay but may be reimbursed by the Township for reasonable expenses incurred in performing their duties, at the sole discretion of the Board of Commissioners.
A. 
The Parks and Recreation Board shall elect its own Chair, Vice Chair, Secretary, and any other officers deemed necessary, to serve for a period of one year.
B. 
Township staff shall be administratively responsible for effectuating the policies and programs recommended by the Parks and Recreation Board. All such policies, upon recommendation for approval by the Parks and Recreation Board, shall be referred to the Board of Commissioners for its approval. No policy shall be final or effective until approved by the Board of Commissioners.
A. 
The Parks and Recreation Board shall initiate, provide and recommend to the Board of Commissioners, from time to time, plans for the acquisition, construction, maintenance, equipping, operation, programming, management, financing and regulation of any public parks, parkways, playgrounds, play fields, and other recreational programs and facilities owned by the Township which would be of benefit to Lower Pottsgrove Township residents. To facilitate these recommendations, the Parks and Recreation Board shall keep an inventory of all open space and recreation facilities owned by Lower Pottsgrove Township. The Board may cooperate with one or more municipalities, school districts, and/or regional organizations for these purposes. Any agreement, understanding or arrangement which would or may have the effect of being legally binding upon the Township must first be approved by the Board of Commissioners.
B. 
The Parks and Recreation Board shall have no jurisdiction or authority to enter into any contract or to incur any obligation or expense which is binding upon the Township other than the expenditure of funds provided to it by the Township's annual budget, provided that said funds are expended within the same budget year and expended in accordance with the Township's policy on purchasing.
The Parks and Recreation Board shall make and alter rules and regulations for its organization and procedures, provided that said rules and regulations shall be consistent with the ordinances of the Township of Lower Pottsgrove, the laws of the Commonwealth of Pennsylvania and shall be approved by the Board of Commissioners.
The Parks and Recreation Board, at such times as directed by the Board of Commissioners, shall annually review the proposed budgets for parks and recreation for the ensuing year, as prepared by Township staff, to be submitted to and approved by the Board of Commissioners.
A. 
All funds appropriated by the Commissioners and budgeted for operation of the Board shall be disbursed only by the fiscal disbursing officer of Lower Pottsgrove Township or as directed by the Township Manager.
B. 
Any funds received by the Township from parks and recreation permit fees or other funds designated by the Board of Commissioners as funds, in addition to funds appropriated to the Parks and Recreation budget, to be utilized for parks and recreation purposes and under the jurisdiction of the Parks and Recreation Board shall be deposited in the appropriate parks and recreation accounts but may only be expended with approval of the Board of Commissioners, provided that funds received by gift, bequest or otherwise shall be disbursed in accordance with the terms of such gift or bequest or the terms of acceptance thereof.
C. 
Every effort shall be made by Township staff and the Parks and Recreation Board to make only budgeted expenditures. However, as there may be the necessity for unforeseen purchases during a budget year, the following shall apply for such purchases:
(1) 
Purchases under $1,000 may be made at the Township Manager's, Assistant Township Manager's, or Parks and Recreation Board's discretion, provided that three telephone or written quotes are provided for purchases of $500 or more.
(2) 
Purchases between $1,000 and $3,999 shall be approved by a majority vote of the Parks and Recreation Board, provided that three telephone or written quotes are provided.
(3) 
Purchases of $4,000 or more shall be made only at the recommendation of the Parks and Recreation Board and approval of the Board of Commissioners. Three written quotes shall be provided for projects of $4,000 to $9,999. Formal bids are required for projects over $10,000.
A. 
The Parks and Recreation Board shall exercise the authority granted herein over any park or recreation place acquired hereafter or now existing and activities thereon unless otherwise specified by the Board of Commissioners.
Meetings of the Parks and Recreation Board shall be held at such times and at such places as shall be determined by the rules and regulations of the Board but no less frequently than on a quarterly basis.
A. 
The Parks and Recreation Board shall keep records of meetings and activities and shall make an annual report, which shall be printed in the annual municipal report and/or other public forum acceptable to the Lower Pottsgrove Township Board of Commissioners.
B. 
This annual report shall include an analysis of the Township's parks, recreation areas, facilities and recreation programs, with particular reference to the extent and adequacy of the programs and effectiveness in view of the public expenditures involved and the public needs to be met. The Parks and Recreation Board shall make such other and additional full and complete reports to the Commissioners at such other times as the Parks and Recreation Board shall deem necessary or when requested by the Board of Commissioners.
All powers and duties which are now or may hereafter be provided by statute of the Commonwealth of Pennsylvania or by the ordinances of Lower Pottsgrove Township relating to the development and operation of parks and recreation systems and public parks and playgrounds shall be and remain vested in the Board of Commissioners, except as otherwise herein provided.
