All previous subdivision regulations for the
Town of Bergen are hereby replaced.
The time limitations set forth in these regulations
and the corresponding provisions of Town Law may be varied when required
for the purpose of complying with the provisions of the State Environmental
Quality Review Act (SEQR) (Part 617 of Article 8 of the Environmental
Conservation Law).
In the event of any conflict or inconsistency
between land subdivision regulations[1] and the public works specifications, it is the responsibility
of the subdivider to bring such alleged inconsistency or conflict
to the Planning Board's attention, in writing, for a decision an its
decision shall be final and binding.
Where the conditions imposed by any provision
of these regulations are more restrictive than comparable conditions
imposed by any other provisions of these regulations, or of any other
ordinance, resolution or regulation, the provisions which are more
restrictive shall govern.
The adoption of these regulations shall not
affect or impair any act done, offense committed or right incurred
or acquired or liability, penalty, forfeiture or punishment that was
incurred prior to the time these regulations take effect under the
regulations relative to subdivision in said Town.
If any clause, sentence, paragraph, section,
or any part of this chapter shall be adjudged by a court of competent
jurisdiction to be invalid, such judgment shall not affect, impair
or invalidate the remainder hereof, but shall be confined in its operation
to the clause, paragraph, section, or part directly involved in the
controversy in which such judgment shall have been rendered.
