Whenever any words and phrases are used in this
chapter, the meaning respectively ascribed to them in Subtitle 1 of
Title 39 of the Revised Statutes of New Jersey shall be deemed to
apply to such words and phrases used herein.

Whenever certain hours are named in this Chapter,
they shall mean either Eastern Standard Time or Eastern Daylight Savings
Time as may be in current use.

a.
The Chief of Police or, in his/her absence, disability
or inability to act, the Township Manager is hereby authorized to
provide by regulation for the closing of any street or portion thereof
to motor vehicle traffic on any day or days during specified hours
on any day or days whenever he/she finds that such closing is necessary
for the preservation of the public safety, health or welfare.
b.
Any regulations promulgated by the Chief of Police
and in accordance with paragraph a. above, shall provide for the posting
of proper warning signs of such closing on any street or portion thereof
during the time the same is closed in pursuance thereof.
c.
Any violation of this regulator, promulgated thereunder
shall be punished by a fine not to exceed $50.
d.
Any regulation adopted that mandates the closing of
any street for a period greater than 48 consecutive hours shall not
become effective unless and until it has been submitted to and approved
by the Commissioner of the Department of Transportation.

Any vehicle parked in violation of this chapter
shall be deemed a nuisance and a menace to the safe and proper regulation
of traffic, and any Police Officer may provide for the removal of
such vehicle. The owner shall bear the reasonable costs of removal
and storage which may result from such removal before regaining possession
of the vehicle.

Unless another penalty is expressly provided
by New Jersey Statute, every person convicted of a violation of a
provision of this chapter or any supplement thereto shall be liable
to a penalty of not more than $50 or imprisonment for a term not exceeding
15 days or both and a $1 Automated Traffic System surcharge.

If any part or parts of this Chapter are, for
any reason, held to be invalid, such decision shall not affect the
validity of the remaining portions of this chapter.

All former traffic ordinances of the Township
of Deptford are hereby repealed, and all ordinances or parts of ordinances
in conflict with or inconsistent with the provisions of this chapter
are hereby repealed, except that this repeal shall not affect or prevent
the prosecution or punishment of any person for any act done or committed
in violation of any ordinance hereby repealed prior to the taking
effect of this chapter.

The provisions of this chapter imposing a time
limit on parking shall not relieve any person of the duty to observe
other, more restrictive, provisions prohibiting or limiting the stopping
or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138,
any other New Jersey Statute or as hereinafter provided.

a.
Upon the declaration of an emergency, there shall
be no parking upon any streets or sections of streets where temporary
EMERGENCY NO PARKING signs are displayed. The Chief of Police or,
in his/her absence, the ranking Police Officer is authorized to declare
any emergency and to direct the posting of EMERGENCY NO PARKING signs
when weather conditions, accidents, road construction, fire or public
celebration dictate or require avoidance of hazards or other conditions
which interfere with the free flow of traffic. Notification that EMERGENCY
NO PARKING signs are being or will be posted shall be given to the
operator or owner of any vehicle which has been parked prior to the
posting of the signs.
b.
Upon the declaration of any road construction or public
celebration, there shall be no parking upon any streets or sections
of streets where temporary EMERGENCY NO PARKING signs are displayed.
c.
Any unoccupied vehicle parked or standing in violation
of this section shall be deemed a nuisance and a menace to the safe
and proper regulation of traffic and any Police Officer may provide
for the removal of such vehicle. The owner shall pay the reasonable
costs of removal and storage before regaining possession of the vehicle.
The effectiveness of this subsection is contingent upon the signs
being erected as required by law.

a.
With the exception of those roads listed on Schedule
A listed below, parking of any vehicle, trailer or other type obstruction
on any portion of a public road, street or highway in the Township
is prohibited whenever snow has fallen the accumulation of snow is
such that it covers the public road, street or highway.
b.
The parking prohibition shall remain in effect after
the snow has ceased and until the streets, roads or highways have
been plowed sufficiently and to the extent that parking will not interfere
with the normal flow of traffic.
c.
Any unoccupied vehicle or standing in violation of
this section shall be deemed a nuisance and a menace to the safe and
proper regulation of traffic within the Township and any Police Officer
may provide for the removal of such vehicle. The owner shall pay reasonable
costs of storage and towing which may result from such removal.
d.
Penalty. Unless another penalty is expressly provided
by New Jersey Statute, every person convicted of a violation of a
provision of this section shall be liable to a penalty of no more
than $50 or imprisonment for a term not to exceed 15 days or both.
For the purposes of this section, each calendar day in which the violation
continues to exist shall be deemed a new and separate violation.

The governing body hereby finds and declares
that problems of traffic control occur and traffic must be moved through
or around street construction, maintenance operations, and utility
work, above and below ground which requires blocking the roadway and
obstructing the normal flow of traffic; and that such obstructions
are or can become dangerous when not properly controlled. In order
to better promote the public health, safety, peace and welfare, it
is necessary to establish controls and regulations directed to the
safety and expeditious movement of traffic through construction and
maintenance zones and to provide safety for the work force performing
these operations.
The Township of Deptford, in the County of Gloucester,
State of New Jersey, does hereby adopt the current Manual on Uniform
Traffic Control Devices hereafter known as M.U.T.C.D., except as hereby
supplemented and amended, as it controls and regulates whenever construction
maintenance operations of utility work obstructs the normal flow of
traffic. Any person, contractor, or utility, who fails to comply with
the provisions of M.U.T.C.D. while performing such work is in violation
of this section.

It shall be the responsibility of the person,
contractor, or in the case of a public utility agreement, wishing
to conduct work on, under or above the roadway to contact the Police
Department in order to arrange a pre-construction meeting in order
to submit plans for the safe movement of traffic during such period
of construction work. Any person, contractor or utility who fails
to comply with this section prior to the start of such work or whose
plans are not approved by the Police Department is in violation of
this section.

The person, contractor, or utility shall provide
the Police Department with at least two emergency contact phone numbers
to be called in case of emergency problems at the construction or
maintenance site prior to the start of any work. If for any reason
emergency contact cannot be reached, or if the emergency contact person
does not respond to the call from the Police Department to correct
a hazardous condition, the Township may respond to correct such hazardous
condition. The reasonable fees for such emergency service by the Borough
shall be charged to the person, contractor, or utility for such condition.

There shall be no construction, maintenance
operations, or utility work on any roadway in the Township before
the hour of 9:00 a.m. or after 4:00 p.m. This time limit may be adjusted
to permit work prior to 9:00 a.m. or after 4:00 p.m. by the Township
Manager. If it is determined by the Officer in charge that the construction
or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would
substantially delay traffic or cause a safety or health hazard, the
work shall then be permitted only between 9:00 a.m. and 4:00 p.m.

Road closing and/or traffic detours shall not
be permitted unless approved by the Police Department.

Traffic directors shall be posted at all construction
or maintenance sites when determined by the Police Department that
same is necessary to provide for the safety and expeditious movement
of traffic.

The Police Department shall have the authority
to stop work, including the removal of equipment and vehicles, stored
material within the street right-of-way, back filling of open excavations
and/or other related work, in order to abate any nuisance and/or safety
hazard or for any violation of this section.

It is to be expressly understood that no materials,
vehicle or equipment are to be placed in the roadway or sidewalk or
until all construction, signs, lights, devices and pavement markings
are installed.

Any person, contractor or utility who commits
a violation of this section shall, upon conviction thereof for a first
offense, pay a fine of not less than $100 nor more than $500 and/or
be imprisoned in the county jail for a term not exceeding 90 days.
For a second offense, the person, contractor or utility shall, upon
conviction thereof, pay a fine of not less than $250 and/or be imprisoned
in the County Jail for a term not exceeding 90 days.
A separate offense shall be deemed committed
on each day during or on which a violation occurs or continues.

are inconsistent with the provisions of this section are hereby repealed
to the extent of any such inconsistency.

This section shall take effect after approval
by the Commissioner of Transportation 20 days after passage and publication
as prescribed by law.

The owners of the premises referred to in subsections

for each parking space reserved for the use of handicapped persons,

Parking areas designated. Handicapped parking spaces
shall be those spaces which are identified with a clearly visible
sign displaying the MUTCD sign R7-8, and a designation of the penalty
for violation shall be placed on the sign of parking space.
b.
Prohibitions. No person shall park, stop or stand
a motor vehicle at any time in an area designated as reserved for
the benefit of physically handicapped individuals provided at any
public or semi-public parking facility within the Township.
Handicapped person identification cards, registration
and wheelchair symbol license plates. Only handicapped persons may
park in designated area upon registration and issuance of handicapped
person identification card and wheelchair symbol license plates by
the Director of the New Jersey Division of Motor Vehicles in concurrence
with the Division of Rehabilitation Services in the New Jersey Department
of Labor (N.J.S.A. 39:4-204 through 2-7.1).

c.
Required handicapped spaces. All parking lots containing
10 or more spaces shall make provisions for Handicapped Parking.
Pursuant to the Zoning Code of the Township
of Deptford, Ordinance No. 0.1.89 adopted 5-11-1989, Article 2200,
subsection 22020, every parking lot containing 10 or more spaces shall
provide for the handicapped parking spaces calculated according to

Handicapped spaces shall be located in close
proximity to principal users and shall be provided with barrier-free
access to same. Where multiple users are to be served by a common
parking lot, handicapped spaces shall be proportionately distributed
throughout the parking lot.

d.
Enforcement. The terms and provisions of this section
shall be enforced by the Deptford Township Police Department (or Department
of Public Safety) and such other persons as the Township Manager may
designate.
e.
Violations and penalties. Anyone who shall violate
any of the provisions set forth in this section shall be liable for
a fine of $100 for the first offense, a fine of at least $100 and
up to 90 days community service or such terms and in such form as
the court shall deem appropriate, or a combination thereof.
f.
Removal of snow and or ice.
1.
Required. Handicapped parking spaces established pursuant
to N.J.S.A. 52:27D-19 et seq. within the jurisdiction of the Township
shall not be blocked or made inaccessible by the plowing or placement
of snow within the perimeters of designated handicapped parking spaces.
To the extent that handicapped spaces are impeded or blocked as set
forth above, the owner of the property will be cited for violating
this section. In addition, the contractor and/or person(s) responsible
for the placement of snow in a handicapped space and/or the person(s)
that directs the placement of such snow may additionally be cited
for violating this subsection.
2.
Penalties. Anyone who shall violate the provisions
set forth in this section shall be liable for a fine of not less than
$100 nor more than $1,000 or imprisonment for a term not exceeding
90 days or both. Each day such violation is committed or permitted
to continue shall constitute a separate offense and shall be punishable
as such thereunder.

In accordance with the provisions of N.J.S.A.
40:48-2.46, on the following private property that is open to the
public and to which the public is invited, the movement of traffic
shall be controlled by the types of regulations indicated. No person
shall operate or park a vehicle in violation of the following regulations.
The owners of the premises referred to in this
section shall provide and install signs and pavement markings as required,
which signage and markings shall be in accordance with the current
Manual On Uniform Traffic Control Devices (MUTCD). The cost of signs
and installations shall be the responsibility of the owner of the
property. The owner shall, subsequent to the initial procurement and
installation, maintain such signs and pavement markings in good condition
at no cost or expense to the Township of Deptford.
The penalty for a violation and conviction of
this section shall be not less than $50 nor more than $1,000 and/or
imprisonment in the County Jail for a term not to exceed 90 days,
or by a period of community service not to exceed 90 days.

a.
DEPTFORD CROSSING SHOPPING CENTER.
1.
Written consent filed. The Department of Public Safety
and the Bureau of Traffic Engineering and Public Safety Programs,
New Jersey Department of Transportation, conducted an investigation
to determine the feasibility of establishing the provisions of Subtitle
One of Title 39, along with various traffic regulations at the Deptford
Crossing Shopping Center; and, as a result of the field investigation,
various traffic regulations have been found to be warranted pursuant
to the provisions of N.J.S.A. 39:5A-1 et seq.
The Deptford Crossing Association has filed
a written consent with the Township that the provisions of Subtitle
one, Title 39 of the Revised Statutes of New Jersey be made applicable
to the semi-public roads, streets, driveways and parking lots at the
Deptford Crossing Center and the following regulations shall be enforceable.

2.
Parking areas designated. All vehicles must park only
in designated areas and between the lines provided.
3.
Handicapped parking. All stalls shall be 12 feet wide
as shown on the site plan filed with the Township Clerk and signed
with R7-8 (reserved parking sign and penalty plate) in the designated
parking areas for persons who have been issued Handicapped Parking
permits by the Division of Motor Vehicles.
4.
Through streets. The following street or parts of
streets described are hereby designated as Through Streets. Stop signs
shall be installed on the near-right side of each street intersections

Installation and maintenance of pavement markings

DEPTFORD MALL.
1.
Written consent filed. The Department of Public Safety
and the Bureau of Traffic Engineering and Public Safety Programs,
New Jersey Department of Transportation, conducted an investigation
to determine the feasibility of establishing the provisions of Subtitle
One of Title 39 along with various traffic regulations at the Deptford
Mall; and as a result of the field investigation, various traffic
regulations have been found to be warranted pursuant to the provisions
of N.J.S.A. 39:5A-1 et seq.
Strouse-Greenberg and Company, Inc., has filed
a written consent with the Township that the provisions of Subtitle
One, Title 39 of the Revised Statutes of New Jersey be made applicable
to the semi-public roads, streets, driveways and parking lots at the
Deptford Mall and the following regulations shall be enforceable.

Parking areas designated. All vehicles must park only
in designated areas and between the lines provided.
3.
Handicapped parking. All stalls shall be 12 feet wide
as shown on the plat filed with the Township and signed with R7-8
(reserved parking sign and penalty plate), in the designated parking
areas for persons who have been issued Handicapped Parking permits
by the Division of Motor Vehicles.

known as Deptford Plaza and located on Route 41.
The aforesaid owners consent to the provisions
of Title 39 being made applicable to the semi-public roads, streets,
roadways, driveways, and parking lots of Deptford Plaza.

the offender shall be liable to a penalty of not more than $50 or
imprisonment for a term not exceeding 15 days, or both; except that

seq., N.J.S.A. 39:123 et seq. or N.J.S.A. 39:4-140 et seq., the offender
