§ 78-1 Definitions.

As used in this chapter, the following terms shall have the meanings indicated:
DRY FILL
Wood, stumps, masonry materials, rock, brick, dirt, stone, bituminous materials, stone and similar materials.
GARBAGE
Putrescible animal and vegetable waste resulting from the handling, preparation, cooking and consumption of food.
REFUSE
All putrescible and nonputrescible solid waste (excluding body waste), including but not limited to garbage, rubbish, ashes, street cleanings, dead animals, abandoned automobiles and solid market and industrial wastes.
RUBBISH
Nonputrescible solid waste consisting of both combustible and noncombustible wastes, such as paper, wrappings, cigarettes, cans, bottles, yard clippings, leaves, wood, glass, bedding, crockery, building materials and similar materials.

§ 78-2 Dumping on public or private property prohibited.

A. 
No person, firm, corporation, unincorporated association or organization shall dump or deposit or cause to be dumped or to be deposited any garbage, refuse or rubbish on any public or private property within the Township of East Hanover, except for those specific materials for recycling which may be legally deposited only at the Municipal Environmental Center.
B. 
No person, firm, corporation, unincorporated association or organization shall dump or deposit or cause to be dumped or cause to be deposited any dry fill on any public or private property within the Township of East Hanover without the express written consent of the owner and without having secured a permit therefor.

§ 78-3 Permit application fee.

A. 
A person, firm, corporation, unincorporated association or organization intending to dump or deposit or cause to dump or cause to deposit dry fill on any private or public land in East Hanover must apply to the Township Clerk for a permit to do so. The applicant shall provide its name, address, telephone number, the nature of the fill to be dumped or deposited, the source of the same and written permission from the owner of the property authorizing such dumping or depositing and including the name, address and telephone number of the property owner. No permit shall be issued until the permission has been verified.
B. 
The fee for a permit to dump or deposit or cause to dump or cause to deposit dry fill on any private or public land in East Hanover shall be $25.

§ 78-4 Violations and penalties.

Any person, firm, corporation, unincorporated association or organization which violates § 78-2 of this chapter may be fined up to $1,000. Any person who violates § 78-2 of this chapter may, in addition to the fine authorized in the preceding sentence, be imprisoned for not more than 90 days for such offense. Such penalties shall also apply, in the discretion of the court, to a person or persons who had actual knowledge of the activities set forth in § 78-2 hereof, committed by a firm, corporation, unincorporated association or organization and who had managerial status within such firm, corporation, unincorporated association or organization sufficient to prevent such prohibited acts, but who did not act to prevent such acts.
