Advertising merchandise for sale, by any person,
as a "going-out-of-business sale" or in terms substantially similar
to "going-out-of-business sale" for a period in excess of 90 days
or to advertise more than one such sale within any given consecutive-day
period of 360 days shall be an unlawful practice. The three-hundred-sixty-day
period shall commence on the first day of such sale.
Permits for going-out-of-business sales shall
be issued by the East Hanover Zoning Officer. Said permit shall be
valid for a period of 30 days.
Renewal or extension of a permit is allowed,
with each extension valid for a period of 30 days. However, in no
event may the total period of the going-out-of-business sale exceed
90 days. Further, there shall be provided a steadily increasing fee
schedule for extensions of such permits.
Pursuant to N.J.S.A. 40:14-152, the Police Department
is authorized to enforce this Article and to issue summonses for that
purpose.
Any person convicted of a violation of the provisions
of this Article shall be liable to a penalty of not more than $1,000
and/or imprisonment for a term not exceeding 90 days and/or 90 days'
service in a work program for each violation. For any person in violation
of this Article, each day in violation shall constitute an additional,
separate and distinct violation.
