The provisions of this article shall apply except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic control device.

A.ย 
Parking is prohibited on all public roads in the Village of Suffern, except public roads in the Central Business District as defined in ยง 254-25.1, whenever snow is accumulating on the roadway and if snowfall has been forecast. Upon the commencement of snowfall, parking on all such public roads is prohibited until snowfall has ceased and the street is cleared of snow to the curb or edge of pavement. Parking shall be prohibited on all public roads in the Central Business District whenever temporary โ€œno parkingโ€ signs are posted for snow control or removal. Notwithstanding any other provision of this chapter, a violation of this section shall be punishable by a fine of $100 per offense.
B.ย 
In addition to the prohibition set forth in ยงย 254-15A, parking is prohibited on all public roads in the Central Business District, as defined in ยงย 254-25.1A of this chapter, from 3:00 a.m. to 6:00 a.m.
No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule XI (ยงย 254-61), attached to and made a part of this chapter.
No person shall stop a vehicle upon any of the streets or parts of streets described in Schedule XII (ยงย 254-62), attached to and made a part of this chapter.
No person shall stand a vehicle upon any of the streets or parts of streets described in Schedule XIII (ยงย 254-63), attached to and made a part of this chapter.

A.ย 
Legislative intent. The Board of the Village of Suffern hereby intends to reinforce and supplement, and to be construed in a manner not inconsistent with the Sanitary Code of the County of Rockland, as enacted by the Board of Health of the Rockland County Health District pursuant to ยงย 347 of the Public Health Law, and as from time to time may be amended.
B.ย 
Operation of motor vehicle; idling of engine restricted.
(1)ย 
No person shall cause or permit the engine of a motor vehicle, except to idle for longer than three consecutive minutes when the motor vehicle is not in motion.
(2)ย 
Notwithstanding Subsection A, this article shall not be construed to restrict the idling of:
(a)ย 
Any vehicle in use by law enforcement, public safety or police officers, emergency service officials, first aid, medical technicians and personnel, and fire safety personnel in the performance of duties or in the course or responding to an emergency.
(3)ย 
In any proceeding relating to a violation of the restrictions on idling, it shall not be a defense that a sign required by this section was absent at the time of the violation.
No person shall park a vehicle between the hours specified in Schedule XIV (ยงย 254-64) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XIV, attached to and made a part of this chapter.
No person shall park a vehicle for longer than the time limit shown in Schedule XV (ยงย 254-65) at any time between the hours listed in said Schedule XV of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XV, attached to and made a part of this chapter.
No person shall park a vehicle upon any of the streets or parts thereof described in Schedule XVI (ยงย 254-66) except at the angle designated and only within the painted stall lines. On all streets or portions thereof where angle parking is now or shall hereafter be authorized, all vehicles parked thereon shall be parked with the front thereof nearest the curb.
No person shall park a vehicle in a space designated as a handicapped parking space in Schedule XVII (ยงย 254-67), except as provided in Article IV of this chapter.

The locations described in Schedule XVIII (ยงย 254-68), attached to and made a part of this chapter, are hereby designated as loading zones. Such loading zones shall be off limits to other than vehicles using them for the purposes intended during such hours and on such days as may be posted thereon for the information of the public. Loading zones shall be barred to parking by the general public during the hours posted thereon. At times other than those reserved for its purpose, the loading zone shall be available for public parking subject to all other generally applicable laws and regulations. The days and hours of operation of the loading zones shall be such as are prescribed from time to time by resolution of the Village Board.

Passenger parking zones are defined as all on street parking locations on Lafayette Street, Orange Avenue, Chestnut Street, Wayne Avenue and Suffern Place, including handicapped parking spaces, and fifteen-minute parking spaces, except those locations as designated as loading zones as described in ยงย 254-23. Such passenger parking zones shall be off limits to vehicles using them for loading and unloading purposes other than for passengers, and for vehicles to park in accordance with the applicable regulations.
The locations described in Schedule XIX (ยงย 254-69), attached to and made a part of this chapter, are hereby designated as taxi stands.
The locations described in Schedule XX (ยงย 254-70), attached to and made a part of this chapter, are hereby designated as bus stops.

A.ย 
Definitions. For the purpose of this section, the following terms shall have the meanings set forth herein:
CENTRAL BUSINESS DISTRICT
An area which includes Lafayette Avenue from its intersection with Orange Avenue to its intersection with Washington Avenue; Orange Avenue from its intersection with Chestnut Street to its intersection with Lafayette Avenue; Chestnut Street from the railroad tracks to its intersection with Orange Avenue.
VALET PARKING
A system whereby the operator of a motor vehicle provides custody of an idling motor vehicle to a person authorized to drive the motor vehicle to another location for the purpose of providing off-street parking of the same and subsequently returning the motor vehicle to said person by delivering the motor vehicle to the same location.
B.ย 
Valet parking. No person shall operate, permit or cause to be operated valet parking unless a permit therefor has been issued by the Board of Trustees pursuant to the provisions of this section. The Board of Trustees may, upon application, issue a permit for valet parking in the Central Business District, upon compliance with the following standards, criteria and procedures:
(1)ย 
Valet parking may be authorized only between the hours of 5:00 p.m. and 1:00 a.m.
(2)ย 
The applicant must demonstrate the manner in which valet parking is to be accomplished, including the location at which cars will be received and returned and parked, the anticipated daily volume of usage and the establishments which will utilize such arrangement.
(3)ย 
If valet parking is to be accomplished by contract with an independent operator ("operator"), a copy of the contract must be provided, which contract is subject to approval by the Board of Trustees.
(4)ย 
A list of the identities of the individuals who will operate the valet parking, ages, social security numbers, motor vehicle operator's license numbers, a list of traffic infractions within the past three years and a list of criminal convictions, if any, must accompany such application.
(5)ย 
Certificate of insurance.
(a)ย 
The applicant and operator must provide a certificate of insurance from an insurance carrier licensed to do business in the State of New York, demonstrating the following insurance coverages:

Liability: $1,000,000/$3,000,000.
[2]ย 
Property damage: $50,000/$150,000.
(b)ย 
The certificate of insurance shall also name as an additional insured the Village of Suffern, its agents, employees, officers and officials. Such certificate shall provide at least 30 days' notice of cancellation and shall be subject to the approval of the Board of Trustees.
(6)ย 
The applicant and operator shall execute an agreement, in a form to be approved by the Village Attorney, agreeing to defend, indemnify and hold harmless the Village of Suffern, its agents, employees, officers and officials, from all claims, judgments and expenses of any kind, including attorney's fees arising from the valet parking operations.
(7)ย 
Upon receipt of a complete application, the application shall be referred to the Superintendent of the Department of Public Works, the Chief of Police, the Parking Authority and such other agencies or employees as are deemed appropriate for a review and recommendation with respect to the safety of the proposed operations. The application shall be accompanied by a fee in accordance with the Standard Fee Schedule.[1]

(8)ย 
Upon receipt of the recommendations and report from the Superintendent of Public Works, the Chief of Police and such other agencies or persons to which the application has been referred, the Board of Trustees shall hold a public hearing on such application, which hearing shall be advertised in the manner provided in Chapter 32, Adoption of Local Laws, Article I, of the Code of the Village of Suffern.
(9)ย 
In approving such application, the Board of Trustees may impose such reasonable conditions and restrictions as it deems appropriate to safeguard the safety and convenience of the public.
(10)ย 
A permit issued to conduct valet parking shall be valid for such time as the Board of Trustees may provide, which period may not exceed one year. The procedures set forth herein must be complied with annually as a prerequisite thereof, except no public hearing on a renewal application shall be required unless the Board of Trustees deems it advisable to conduct a public hearing on a particular application.

(11)ย 
An applicant or operator who fails or neglects to comply with the conditions or restrictions imposed as a condition of a permit pursuant to the provisions of this chapter shall be subject to the penalties set forth in ยงย 254-47 of this chapter, and such permit may be suspended for a specified period of time or may be revoked by direction of the Chief of Police. An owner or operator who is aggrieved by such suspension or revocation may appeal such determination to the Board of Trustees in writing within five days of said suspension or revocation. The aggrieved applicant or owner may submit the particulars of his appeal in writing to the Board of Trustees within five days of said suspension or revocation or may demand a hearing within said five-day period. If a hearing is demanded, the Board of Trustees may designate a hearing officer to hear such appeal and to render a report and recommendation to the Board of Trustees. The Board of Trustees may sustain, modify or reverse such suspension or revocation.
(12)ย 
A person operating or causing to be operated valet parking without a permit issued pursuant to the provisions of this chapter shall be subject to the penalties set forth in ยงย 254-47 of this chapter.

No person shall park a vehicle upon any street or parts thereof described in Schedule XXI (ยงย 245-71), attached to and made a part of this chapter.

The following is prohibited on all Village streets for more than 1/2 hour, except when actively delivering or providing a permitted service:
A.ย 
Parking of trucks with a weight in excess of five tons;
B.ย 
Parking of tractors and/or trailers:
C.ย 
Parking of vehicles with commercial plates, taxi, livery, or limousine plates or vehicles with painting, signs or any type of writing associated with advertising or denoting a commercial enterprise;
D.ย 
Parking of mobile homes, boats, recreational vehicles or their trailers.
