A. 
Except as provided in Subsection B hereof, this chapter shall govern the terms of employment of all employees of the City government of the City of Englewood.
B. 
The provisions hereof shall apply to Chiefs and Deputy Chiefs of the Police and Fire Departments but, unless expressly otherwise provided herein, shall not apply to other members of the Police and Fire Departments.
Pursuant to the laws of the State of New Jersey, and subject to such laws, the provisions hereof may be changed or modified by, and shall be deemed changed or modified to the extent necessary to conform to, the provisions of any collective negotiation agreement approved by resolution of the Council and executed pursuant to such resolution.
Subject to the provisions hereof, the Council may, by resolution, supplement and implement the provisions hereof and establish additional policies governing employment by the City government.

A. 
The power to hire employees of the City government and the power to terminate the employment of such employees shall be vested in the City Manager, provided that Council confirmation shall be required for the hiring of, or the termination of the employment of, a department head.
B. 
Subject to the provisions of any applicable collective negotiation agreement, prior to the hiring of any employee to fill any position, such position shall be posted internally in accordance with collective bargaining agreements and, if seeking external applicants, on the City’s website.

Subject to the provisions of this chapter and any other standard policies which may be established by the Council by ordinance, the City Manager shall establish and issue directives, rules, orders, and policies governing employment by the City government and the conduct, actions, and procedures to be followed by City employees, and it shall be the duty of the City Manager to implement the policies hereby established and any other standard personnel policies established by the Council.

The Human Resources Department heretofore established is hereby continued, such office to be operated under the supervision of the City Manager.

The Human Resources Department shall have and perform the following duties and responsibilities, together with such other duties and responsibilities as shall be prescribed by the Council or the City Manager, all of which are to be performed and fulfilled in accordance with standard personnel policies established by the Council and directives issued by the City Manager.
A. 
Establishment and maintenance of personnel records of City employees.
B. 
Administration of the City's personnel policies and administration of collective negotiation agreements covering City employees.
C. 
Recruitment of personnel and establishment of criteria for employment by the City and criteria for the filling of positions within the employ of the City.
D. 
Advising the Council and the City Manger respecting personnel matters.
E. 
Assisting such person as shall be designated by the City Manager to conduct collective negotiations, and assembling and providing necessary data and information for use in such negotiations.
F. 
Reviewing and recommending changes and modifications, where necessary or advisable, in the classification plan for City employees.

No person shall be hired for a permanent position within the employ of the City unless such person shall first have been medically examined by the City Physician, or such other physician as shall be designated by the City Manager, and unless such physician shall advise that such person is physically and medically qualified for and capable of fulfilling the duties of such position.
