No person shall in any manner injure or destroy any shade tree on any village property or hitch any horse or other animal to such shade tree or near enough thereto so that such shade tree may be injured thereby.
A. 
Any person, firm or corporation who or which shall plant any shade tree on village or private property shall plant such tree at least six feet from the sidewalk or sidewalk right-of-way.
B. 
No street trees other than small trees may be planted under any overhead utility line.[1]

Any person committing an offense against any provision of this chapter shall be guilty of a violation punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
