The purpose of this article is to establish standards for the construction of streets within the Township of Maidencreek so that they may be adequate to accomplish the purposes for which said streets are intended and to provide for the dedication of the same to public use, it being hereby declared that the enactment of this article is necessary for the protection, benefit and preservation of the health, safety and welfare of the inhabitants of the Township.
Unless the context specifically and clearly indicates otherwise, the meaning of terms used in this article shall be as follows:
ENGINEER
The Engineer of the Township of Maidencreek appointed by the Township Supervisors.
STREET
(As defined in Chapter 190, Subdivision and Land Development, of the Code of the Township of Maidencreek.)
A. 
Includes street, avenue, boulevard, road, highway, freeway, parkway, lane, alley, court, and any other ways used or intended to used by vehicular traffic or pedestrians, whether public or private. Included is all the land between the street right-of-way lines whether improved or unimproved. Streets may comprise pavement, shoulders, gutters, sidewalks, street signs, speed limit sign, streetlights, division strips, or other areas within the street right-of-way lines.
B. 
Streets shall be classified according to function as follows:
(1) 
ARTERIAL STREET (MAJOR)A street serving a large volume of comparatively high-speed and long-distance traffic, including all streets classified as main and secondary highways by the Pennsylvania Department of Transportation.
(2) 
COLLECTOR STREETA street which, in addition to providing access to abutting properties, intercepts minor streets to provide a route serving dwelling units or lots to give access to community facilities and/or other collector and major streets. Streets in industrial and commercial subdivisions shall be considered collector streets.
(3) 
(a) 
CUL-DE-SAC (SINGLE ACCESS STREET)A minor street intersecting another street at one end and terminating in a vehicular turnaround at the other end.
(b) 
HALF (PARTIAL) STREETA street generally parallel and adjacent to a property line, having a lesser right-of-way width than normally required for improvement and use of the street.
(c) 
MARGINAL ACCESS STREETA minor street, parallel and adjacent to a major street (but separated from it by a reserve strip) which provides access to abutting properties or lots and control of intersections with the major streets.
(d) 
MINOR STREET (LOCAL ACCESS)A street used primarily to provide access to abutting properties.
(e) 
PRIVATE STREETA privately owned street not dedicated by the Township.
(f) 
SERVICE STREET (ALLEY)A minor right-of-way providing secondary vehicular access to the side or rear of two or more properties.

TOWNSHIP
The Township of Maidencreek.
All work done pursuant to the provisions of this article shall be inspected by, and be subject to the approval for compliance herewith of, the Township, including, but not limited to, all posted signs, energized streetlights, compliance to PennDOT highway occupancy permits and improvements and line painting.
The Township will accept into its street system only those streets which have been constructed in accordance with specifications and requirements of this article and Chapter 190, Subdivision and Land Development, and all other ordinances, regulations, resolutions, and controls of the Township. Proof of compliance with the specifications and requirements of this section of this article shall be provided by written request of the Township to inspect and/or observe the work during construction and installation of the same or by providing boring data as required by the Engineer, and in accordance with the requirements for testing the appropriate materials and method of application detailed in Pennsylvania Department of Transportation Form 408, latest revision. The costs of such inspection, observation and tests shall be borne by the developer and/or contractor.
The Township shall accept into its street system only those streets constructed in accordance with this article and Chapter 190, Subdivision and Land Development, upon receipt of a fully executed deed of dedication and plans in proper form for adoption along with an improvements maintenance guarantee for 18 months, in an amount not less than 5% of the total cost of improvements as provided in Chapter 190, Subdivision and Land Development. A resolution and ordinance for acceptance shall be prepared and/or approved by the Township Solicitor for recording and filing with all costs incidental thereto for processing to be paid by the grantor.
The cost and expense of any type of improvement mentioned hereinbefore shall be paid for by the developer, as provided for in Chapter 190, Subdivision and Land Development, or by the owners of the real estate abutting on the street or roadway or part thereof whereon such improvement is made. Should the Township make the improvement, the cost and expense thereof may be collected from the developer or from the owners of the real estate abutting on such street or roadway, or part thereof by an equal assessment on the front feet. Such proportionate cost and expense or assessment shall be computed by the Township. The Supervisors shall collect said cost and expense or assessment in the manner provided by law.
Should the forms, specifications and/or regulations of the Commonwealth of Pennsylvania which are incorporated herein by reference thereto be subsequently amended, replaced or in any other way changed, said amended forms, specifications and/or regulations may be incorporated herein, or such other forms, specifications and/or regulations as may be deemed by the Supervisors necessary or desirable may be incorporated herein by resolution of said Supervisors, duly adopted, copies of which resolution shall be available at the office of the Township.
