No person, firm or corporation shall erect, construct, reconstruct
or remodel any structure within the Township involving any connection
with any sewer line or lateral without having first obtained a building
permit from the Township Secretary.
A.
The Township Secretary shall issue a building permit upon application
made therefor upon such application form as may be from time to time
required by the Township and upon payment of the fee therefor as is
hereinafter provided, if the proposed erection, construction, reconstruction,
extension or remodeling complies with all of the Township ordinances
and regulations.
B.
The application for the building permit shall be made on such form
as the Township shall from time to time require, which form shall
require such information as the Board of Commissioners may from time
to time by motion designate.
C.
No building permit shall be granted for a longer period than six
months except upon special authorization of the Board of Commissioners.
D.
The Township Secretary shall have the right to revoke a building
permit on the failure of the permit holder to comply with the requirements
of all Township ordinances and regulations. Upon the revocation of
such permit, all work permitted thereby shall cease. The holder of
the permit shall have the right to appeal from the revocation of the
permit by the Township Secretary to the next regular meeting of the
Board of Commissioners or a special meeting of the Commissioners held
for that purpose.
Within 10 days of the completion of the erection, construction,
reconstruction, extension and remodeling of any structure for which
a building permit is required or has been issued, the person, firm
or corporation hereby required to obtain such a permit shall notify
the Township Secretary in writing, by filling in and returning the
detachable stub affixed to the building permit, of the date of completion
of the work for which the permit was issued, which date shall be inserted
by the Township Secretary on the building permit application.
The issuance of a building permit shall not impose any liability
upon the Township or any of its agents or officials or employees for
any damage done to persons or property in connection with the work
done under such permit, but the permit holder or any other person
responsible shall be and remain liable for any and all damage, of
whatever kind or nature, resulting from or occurring in connection
with or by reason of such work.
No person whose property bounds upon any state highway, street
or right-of-way shall obtain a building permit without first obtaining
a permit from the Commonwealth of Pennsylvania, Department of Transportation.
A copy of such permit shall be presented to the Township at the time
of the application for the building permit. No building permit in
the Township shall be issued without such requirements being strictly
complied with.
Whoever violates any provision of this chapter shall be fined
not more than $1,000, plus costs of prosecution, and, in default of
payment of such fine and costs, imprisoned for a term not exceeding
30 days. Each day's neglect to comply with the provisions of
this chapter shall be deemed a new offense and subject in all respects
to the same penalty as the first offense, and separate proceedings
may be instituted and separate penalties imposed for each day's
offense after the first conviction.
