As used in this article, the following terms shall have the meanings indicated:
PERSON
Any private individual or corporate or other business entity.
REFUSE
Any substance of the type to be discarded as worthless or useless, including but not limited to rubbish, trash, garbage, ashes, sand or sludge.
A. 
The accumulation of refuse of any type upon private property in the Township is hereby prohibited.
B. 
The dumping of refuse of any type upon public or private property in the Township is hereby prohibited.
C. 
In the construction of this section, the District Justice hearing any case involving a violation of this section shall consider the defense of having obtained a permit from the Pennsylvania Department of Environmental Protection to be an affirmative defense. Therefore, the burden shall not be upon the Township to prove that no permit from the Pennsylvania Department of Environmental Protection was obtained.

A. 
Violators will be issued a written warning and granted 30 days to comply with this article.
B. 
Whoever violates § 110-2 who has not obtained a permit for accumulation or dumping of refuse by the Pennsylvania Department of Environmental Protection shall be fined not more than $1,000 plus costs of prosecution, and, in default of payment of such fine and costs, imprisoned for a term not exceeding 30 days.
