Every owner of property within the Township shall, within 60 days after notice from the Township Commissioners, construct or reconstruct a sidewalk and/or curb, which shall conform to all applicable requirements of this article, in front of or alongside of such property. If the property owner fails to comply with the notice, the Township may cause the work to be done in the manner provided under the First Class Township Code.
Every owner of property within the Township shall, within 30 days after notice from the Township Commissioners, repair any sidewalk and/or curb, in the manner stipulated in such notice, in front of or alongside of such property. If the property owner fails to comply with the notice, the Township may cause the work to be done in the manner provided under the First Class Township Code.
Any owner of property within the Township may, of his/her own volition and without notice from the Township Commissioners, construct, reconstruct or repair a sidewalk and/or curb in front of or alongside such property, provided that he/she shall first obtain permission (in the form of a permit or written approval) from the Administrator or Township Commissioners and shall conform to all requirements of this article applicable to sidewalks and/or curbs constructed, reconstructed or repaired upon the order of the Township Commissioners.
Such sidewalks and curbs shall be constructed or reconstructed, as the case may be, of concrete only, with expansion joints, according to specifications adopted from time to time by the Township Commissioners. Such sidewalks shall be five feet minimum in width, starting at the curb; provided, however, that on the easterly side of California Avenue between Harrison Street and McKinley Avenue the sidewalk shall be four feet in width. There shall be no grass plots between curb and sidewalk. Existing sidewalks and curbs of a material other than concrete, and which at the time of their construction conformed to the requirements of the Township then in effect, may be repaired of the same material of which they were constructed. Such work or repair shall be subject to the inspection and approval of the Township, but when the Township Commissioners shall determine that the reconstruction of any sidewalk and/or curb, rather than the repair thereof, shall be necessary, such sidewalk and/or curb shall be reconstructed of concrete.
Lines and grades shall be set by the property owner in accordance with plans presented to the Administrator or Commissioners or, in the absence of plans, by the Administrator upon the request of the Commissioners. Grades provided by the Administrator shall be at the expense of the Township. Such sidewalks and/or curbs shall be constructed or reconstructed according to the lines and grades as given. If for any reason the stakes furnished by the Administrator shall be disturbed or removed, they shall be reset by the Administrator or in his/her absence the Township Engineer at the expense of the property owner.
In all instances where access to premises by vehicles is desired by the owner of such premises, the curb may be cut down and proper provisions may be made for a driveway across the sidewalk, such work to be done according to specifications adopted from time to time by the Township Commissioners.
The Administrator may at any time during the course of the work of construction, reconstruction or repair of any sidewalk or curb visit the site of such work to ascertain whether such work is being done according to requirements, and the Administrator or one of his/her assistants shall visit any such site whenever requested by the property owner. Within two days after the completion of any such work, the owner of the property shall notify the Administrator of such fact, so that he/she may inspect such work in order to determine whether the requirements hereof have been strictly observed and followed. Whenever he/she finds that any such work does not conform to the requirements of this article and to the specifications adopted thereunder, he/she shall order that such work be brought into conformity therewith by the owner of such property. In case the owner thereof fails or refuses to do so, the Township Commissioners shall order the reconstruction or repair of the portion of such sidewalk or curb not in conformity therewith.
The Township Secretary shall keep a record, in a book provided for the purpose, of all notices served upon property owners under this article, showing in each instance the name of the owner or owners of the property, the date of service of such notice, upon whom served and the manner of service.
Whoever violates any provision of this article or any regulations and specifications adopted hereunder shall be fined not more than $600 for each offense, plus costs of prosecution, and, in default of payment of such fine and costs, imprisoned for a term not exceeding 30 days. Each day that a violation is permitted to exist after notice in writing shall have been served by the Administrator shall constitute a separate offense.
