Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle 1 of Title 39 of
the Revised Statutes of New Jersey shall be deemed to apply to such
words and phrases used herein.

Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Saving Time,
as may be in current use in the Borough.
A.
Regulations not exclusive. The provisions of this chapter imposing
a time limit on parking shall not relieve any person of the duty to
observe other more restrictive provisions prohibiting or limiting
the stopping, standing or parking of vehicles as set forth in N.J.S.A.
39:4-138, any other New Jersey Statute or as hereinafter provided.
B.
Parking prohibited during state of emergency.
(1)
Upon the declaration of an emergency, the Chief of Police or, in
his or her absence, the ranking police officer is authorized to declare
an emergency and to temporarily modify traffic patterns or flow or
direction of streets, as well as any and all parking regulations where
weather conditions, accidents, fires or public celebration, public
demonstration, or other emergent circumstances dictate or require
the avoidance of hazards or other conditions which interfere with
the free flow of traffic. Notification that modifications to traffic
patterns and/or parking regulations are being or will be posted shall
be given to the operator or owner of any vehicle which has been parked
prior to the posting of the signs.

(2)
Any unoccupied vehicle parked or standing in violation of this section
shall be deemed a nuisance and menace to the safe and proper regulation
of traffic, and any police officer may provide for the removal of
such vehicle. The owner shall pay the reasonable costs of removal
and storage which may result from such removal before regaining possession
of the vehicle.
(3)
The effectiveness of this subsection is contingent upon the signs
being erected as required by law.
C.
Parking prohibited at all times on certain streets. No person shall
park a vehicle at any time upon any of the streets or parts thereof
described in Schedule I attached to and made a part of this chapter.

E.
Stopping or standing prohibited during certain hours on certain streets.
No person shall stop or stand a vehicle between the hours specified
in Schedule III of any day (except Sundays and public holidays) upon
any of the streets or parts of streets described in Schedule III attached
to and made a part of this chapter.

F.
Parking time limited on certain streets. No person shall park a vehicle
for longer than two hours between the hours of 8:00 a.m. and 6:00
p.m. upon any street on any day (except Saturdays, Sundays and public
holidays) within the Borough unless a different time limit or effective
time period is set forth with respect to any of the streets, or parts
of streets, described in Schedule IV attached to and made a part of
this chapter.

G.
Method of parking.

(1)
No vehicle or part thereof, including its contents or load, shall
be parked on any street in the Borough, which streets have been designated
by pavement or other markings indicating the spaces within which any
such vehicle shall be parked, otherwise than within the confines of
one of such spaces and so as not to interfere with or impede the free
flow of traffic.
(2)
No vehicle or part thereof, including its contents or load, shall
be parked on any municipality-owned or -controlled parking lots in
the Borough, which parking lots have been designated by pavement or
other markings indicating the spaces in which any such vehicle shall
be parked, otherwise than within the confines of one such space and
so as not to interfere with or impede the free flow of traffic.
H.
Tow away. Any unoccupied vehicle parked or standing in violation
of this chapter shall be deemed a nuisance and a menace to the safe
and proper regulation of traffic, and any police officer, and/or parking
enforcement officer, may provide for the removal of such vehicle.
The owner shall pay the reasonable costs of the removal and storage,
which may result from such removal before regaining possession of
the vehicle.

I.
Permit parking in designated areas.

(1)
Creation of permit parking areas. The streets and portions of streets
identified in Schedule XIX, attached to and made a part of this chapter,
are hereby designated as permit parking areas to be known as "Residential
Parking District Number 1" and "Residential Parking District Number
2."
(2)
Parking permits for unlimited parking in designated areas.
(a)
Any resident of the street or portion of the street designated
on Schedule XIX, attached to and made a part of this chapter, may
obtain a permit to park such a vehicle on the street or parts thereof,
and that vehicle shall not be subject to the parking time limits that
would otherwise apply to the streets or parts thereof; provided the
vehicle is owned or operated on a regular basis by a resident of that
street, or portion thereof, designated on the attached Schedule XIX.

(b)
A parking permit authorizes a resident, whose vehicle displays
a valid parking permit, to park on the designated street without regard
to the designated time limits that otherwise apply to the street (except
for snow or other emergency restrictions). A person parking a vehicle
on the designated parking street without the permit shall be subject
to the parking time limits that otherwise apply to the street.
(3)
Application for permit.
(a)
An application for a parking permit shall be made by a resident
of a designated street to the Parking Utility Operations Manager on
forms as are prescribed by the Borough Administrator.
(b)
The application for a permit shall contain information to verify
that the applicant is a bona fide resident of the street for which
application has been made and has legal title to or the right to possession
of the motor vehicle to be registered. The information shall include,
but not be limited to the following:
(c)
A parking permit may not be issued to any person for any motor
vehicle for which one or more citations issued by the Borough for
parking or other motor vehicle violations remain unpaid.
(4)
Residency required for permit. A permit shall be issued only to residents
of a designated parking street. For the purposes of this subsection,
"resident" means any person with a valid driver's license who lives
or resides in a structure approved for residential occupancy and who
is the owner of or a tenant in the structure, or who can demonstrate
some other indication of right of occupancy.
(5)
Expiration of permit. A permit expires and is void when the permittee
no longer resides, as defined in this subsection, within the designated
street for which the permit was issued. A permittee shall remove a
permit sticker from any vehicle registered to park on a designated
street upon its expiration or upon moving outside of the designated
street. Permits shall be transferred or replaced from one vehicle
to another during the permit year solely in accordance with the provisions
of this chapter governing such replacement permits.
(6)
Permit fee. No fee shall be charged for a residential parking permit.
The permit year shall commence on June 1 and terminate on May 31.
Residential parking permits may be renewed from year to year by qualified
residents on or before May 31 of each year.
(7)
Display of permit. The parking permit shall be affixed to the left
rear window or left side window of the vehicle in such a manner as
to be clearly visible to a person enforcing parking regulations. The
design and content of the permit shall be as prescribed by the Borough
Administrator. The color of a parking permit shall vary for each parking
district.
(8)
Replacement of permit. When a vehicle to which a permit is affixed
is sold, transferred, demolished or in any other manner rendered unusable
to the permittee, the permittee shall remove the permit from the vehicle
and may request the issuance of a replacement permit. The permit shall
be considered void and the permittee shall notify the Parking Utility
Operations Manager, and in his absence, the Borough Clerk, of the
change in status of the vehicle. An application for a replacement
permit shall be in accordance with the provisions for an application
for an original or renewal permit. The replacement permit shall be
issued and be valid for the unexpired term of the original permit,
except that a replacement permit may not be issued to any person or
any motor vehicle for which one or more citations issued by the Borough
for parking or other motor vehicle violations remain unpaid.
(9)
Temporary permit. The Parking Utility Operations Manager, and in
the absence of the Parking Utility Operations Manager, the Borough
Clerk, shall issue a temporary residential parking permit for use
by a bona fide visitor to a residence within a residential parking
district. Not more than one temporary residential parking permit shall
be issued to any residence at any one time. Said temporary permit
for visitors shall be for the specific term of the visit, but not
to exceed 15 days. An application for a temporary permit shall be
made by a resident of a district on a form as shall be prescribed
by the Borough Clerk.
J.
Parking prohibited on streets during snow emergency.

(1)
Whenever snow has fallen and the accumulation is such that it covers
the street or highway, an emergency shall exist, and no vehicle shall
be parked on any Borough street between 11:00 p.m. and 7:00 a.m.
(2)
Any vehicle parked in violation of this section shall be deemed to
be a nuisance and a menace to public safety, and any public safety
officer may provide for the removal of such vehicle. The owner shall
pay the reasonable costs of removal and storage of the vehicle before
regaining possession thereof.
(3)
This parking prohibition shall remain in effect until after the snow
has ceased and until the streets have been sufficiently plowed and
cleared of snow and to the extent that parking will not interfere
with the normal flow of traffic or impede the passage of emergency
vehicles.
(4)
During
a snow emergency, as defined in this section, owners, tenants and/or
their agents shall be prohibited from plowing or otherwise depositing
snow onto Borough streets.
K.
Reserved parking for electric charging vehicles.

ELECTRIC VEHICLE
RESERVED PARKING FOR RECHARGING OF ELECTRIC VEHICLE
Definitions. As used in this section, the following terms shall have
the meanings indicated:
Any car, truck or other vehicle that does not produce a tailpipe
or evaporative emissions or is a plug-in hybrid electric vehicle (PHEV).
Any parking spaced designated by the Borough for the recharging
of an electric vehicle.
(2)
Restrictions.
(a)
It shall be unlawful for any person to park or leave standing
a vehicle in a stall or space designated for the recharging of electric
vehicles unless the vehicle is connected for electric charging purposes.
(c)
Parking spaces for reserved parking for recharging of electric
vehicles shall designated and identified by green pavement and/or
curb markings, a green painted charging pictograph symbol and appropriate
signage.
(d)
Designation of reserved parking space for recharging of electric
vehicle. The first reserved parking space for the recharging of electric
vehicles designated by the Borough shall be located on the north side
of Monmouth Street adjacent to Borough Hall at 90 Monmouth Street.
The governing body may designate such additional reserved parking
spaces for recharging of electric vehicles as it deems necessary and
appropriate, and said designation can by effectuated by a resolution
adopted by the governing body, and provided that any space so designated
complies with all of the requirements of this subsection.
(e)
Fees. The fees to be charged by the Borough for the use of a
space or stall designated as reserved parking for recharging of electric
vehicle shall be $2 per hour. This fee may be amended by a resolution
adopted by the governing body.

A.
Trucks over four tons excluded from certain streets. Trucks over
four tons gross weight are hereby excluded from the streets or parts
of streets described in Schedule V, except for the pickup and delivery
of materials on such streets, Schedule V, being attached to and made
a part of this chapter.

The streets or parts of streets described in Schedule VI, attached
to and made a part of this chapter, are hereby designated as one-way
streets in the direction indicated.

Through streets. Pursuant to the provisions of N.J.S.A. 39:4-140,
the streets or parts of streets described in Schedule VII, attached
to and made a part of this chapter, are hereby designated as through
streets. Stop signs shall be installed on the near right side of each
street intersecting the through street except where yield signs having
sides 36 inches in length are provided for in the designations.

B.
Stop intersections. Pursuant to the provisions of N.J.S.A. 39:4-140,
the intersections described in Schedule VIII, attached to and made
a part of this chapter, are hereby designated as stop intersections.
Stop signs shall be installed as provided therein.

C.
Yield intersections. Pursuant to the provisions of N.J.S.A. 39:4-140,
the intersections described in Schedule IX, attached to and made a
part of this chapter, are hereby designated as yield intersections.
Yield signs having sides 36 inches in length shall be installed as
provided therein.

A.
Loading zones. The locations described in Schedule X, attached to
and made a part of this chapter, are hereby designated as loading
zones. No person shall park a vehicle in said locations during the
times indicated other than for the loading or unloading of goods and
materials.
B.
Dropoff zones. The locations described in Schedule XXII, attached
to and made a part of this chapter, are hereby designated as dropoff
zones. No person shall park a vehicle in said locations during the
times indicated other than for the letting off, or taking on, of passengers.

The locations described in Schedule XI, attached to and made
a part of this chapter, are hereby designated as taxi stands.

The locations described in Schedule XII, attached hereto and
made a part hereof, are hereby designated as bus stops. No vehicle
other than a bus, picking up or discharging passengers, shall be permitted
to occupy said location between the hours indicated.
A.
Left-turn prohibition. No person shall make a left turn at any of
the locations described in Schedule XIII, attached to and made a part
of this chapter.

B.
U-turn prohibition. No person shall make a U-turn at any of the locations
described in Schedule XIV, attached to and made a part of this chapter.
C.
No turns. No person shall make a turn at any of the locations described
in Schedule XV, attached to and made a part of this chapter.
D.
Lane use reservations. The lane locations described in Schedule XVI,
attached to and made a part of this chapter, are designated as "lane
use reservations," and traffic shall move only as indicated.
E.
Right turn on red traffic signal prohibited. No person shall make
a right turn when facing a steady red signal (stop) indication whenever
an official sign is present prohibiting such turn on the red signal
as described in Schedule XVII.

A.
The streets or parts of streets described in Schedule XVIII, attached
to and made a part of this chapter, shall have the speed limits designated
in such schedule.
B.
Regulatory and warning signs shall be erected and maintained to effect
the above designated speed limits as authorized by the Department
of Transportation.

The following streets and locations are hereby designated as
tow-away zones. Any vehicle parked or standing as to obstruct or impede
a normal flow of traffic, block entrances or exitways, including driveways,
pedestrian walkways, or present in any way a safety or traffic hazard,
may be removed by the towing of said vehicle at the owner or operator's
expense, within the discretion of the Borough of Red Bank Police Department,
pursuant to Title 39 and the Borough of Red Bank Code:

A.
Unless another penalty is expressly provided by New Jersey Statute,
every person convicted of a violation of a provision of this chapter
or any supplement thereto shall be liable to a penalty of not more
than $50 or imprisonment for a term not exceeding 15 days, or both.
B.
All former traffic ordinances of the Borough of Red Bank covered
in this traffic chapter are hereby repealed, except that this repeal
shall not affect or prevent the prosecution or punishment of any person
for any act done or committed in violation of any ordinance hereby
repealed prior to the taking effect of this chapter.
