There shall be in and for the Borough an Advisory Board of Health in accordance with the provisions of N.J.S.A. 26:3-3.
The Advisory Board of Health shall consist of seven members and shall be appointed by the Mayor and confirmed by the Council to serve for four-year terms. The terms of not more than two members shall expire in any one year, except in the case of vacancies, which shall be filled for the unexpired terms only.
A. 
Appointments. The Mayor, with the confirmation of the Council, may appoint two alternate members and designate them as "Alternate No. 1" and "Alternate No. 2."
B. 
Terms; vacancy. The terms of the alternate members shall be for two years, except that the terms of the alternate members first appointed shall be two years for Alternate No. 1 and one year for Alternate No. 2, so that the terms of not more than one alternate member shall expire in any one year. A vacancy occurring otherwise than by expiration of term shall be filled by the Mayor with the confirmation of the Council for the unexpired term only.
C. 
Conflicts of interest; voting order. An alternate member shall not be permitted to act on any matter in which he has either directly or indirectly any personal or financial interest. An alternate member may, after public hearing if he requests one, be removed by the governing body for cause. An alternate member may participate in discussion of the proceedings but may not vote except in the absence of or disqualification of a regular member. A vote shall not be delayed in order that a regular member may vote instead of an alternate member. In the event that a choice must be made as to which alternate member is to vote, Alternate No. 1 shall vote first.
The Advisory Board of Health shall elect a Chairperson and Secretary from among its own members. The Chairperson shall preside at all meetings and the Secretary shall keep and maintain minutes of all meetings of the Advisory Board of Health. All members of the Advisory Board shall serve without compensation, except that the members of the Advisory Board may be reimbursed by the Borough, with prior approval, for expenses incurred while performing any function as a member of the Advisory Board.
The powers and duties of the Advisory Board of Health are as follows:
A. 
Advise and consult with the Borough Council and Monmouth County Department of Health with respect to the public health needs and programs of the Borough.
B. 
Review and make recommendations to the Borough Council and Monmouth County Department of Health with respect to public health hazards in and about the Borough.
C. 
Study and report on proposed health-related ordinances to the Borough Council and Monmouth County Department of Health.
The Advisory Board of Health shall not contract any debt or debts of any kind beyond the amount of the appropriation made for its use by the Mayor and Council of the Borough.
